Present the Chairman and Professors Rogers(P43658) - Cabell(P39304)- Bonnycastle(P43623) - Emmet(P43625) & Harrison.(P25515)-

[EVENT: Library:Access/use policies  1839-09-07] The Librarian made application through the Chairman to change the day for taking out and returning books to the Library by students, from saturday to monday.

On motion made and seconded - Resolved that the application be granted.-

[EVENT: University Administration:Banking  1839-09-07] The Chairman laid before the Faculty the Bank reports for June, July and August which have been received since the last meeting of the FACULTY -

[EVENT: Boarding Action:granted 1839-09-07] George W. Carr(P26997) made application through the Chairman for permission to board with his relation Miss Lucy Terrell(P43999) -

On motion made and seconded, resolved that his application be granted.-

[EVENT: Student Status:Readmission Action:granted 1839-09-07] Mr. William D. Chisholm(P39586) who dismissed last Session for leaving the University without permission, made application through the Chairman for re-admission.-

Mr. Bonnycastle(P43623) offered the following resolution which was seconded and passed -

Resolved, that Mr. Chisholm(P39586) be permitted to Matriculate on giving a Special Pledge, that he will not hereafter leave the University without permission.-

[EVENT: Boarding Action:postponed 1839-09-07] Mr. Charles Irving(P25739) of Buckingham(PL4762) who will be 16 on the 5th of March next, made application through the Chairman for permission to matriculate - He will occupy a dormitory with his first cousin who is over 21 years old -

On motion made and seconded - Resolved, that Mr. Irving's(P25739) application be referred to the board of Visitors, the Faculty having no power to grant it.-

[EVENT: Boarding Action:postponed 1839-09-07] Mr. Marcellus McKennie(P35688) who will be 16 on the 4th of March made application through the Chairman for permission to matriculate -

He will board with his father who resides near the University -

On motion made & seconded - Resolved, that Mr. McKennie's(P35688) application be referred to the Board of Visitors - the Faculty having no power to grant it -

[EVENT: Student Status:Admission Action:granted 1839-09-07] Mr. John A. Talley(P32182) who was at Rundolph Macon College(PL8386) in 1832 and who came without a Certificate from said College made application through the Chairman for permission to matriculate - He is now over the age of 23 - On motion made and seconded - resolved that his application be granted.-

Mr. Henry C. Lay(P25610) who will be 16 in December made application through the Chairman for permission to attend lectures, till he shall attain the age of 16 - On motion made and seconded - resolved that his application be granted on his pledging himself to observe the laws in the meantime and to matriculate in December.-

[EVENT: Boarding Action:granted 1839-09-07] Mr. Richard B. Gooch(P32133) made application through the Chairman for permission to board with Miss Terrell(P43999) who is the particular friend of his father and mother - On motion made & seconded resolved, that his application be granted.-

Messrs. Joseph D. Shields(P27155), F. E. Morancy(P27216), Thomas Towles(P24008) and John J. Barbour(P31480) who have attained the requisite age for boarding out of the University, made application through the Chairman for permission to occupy Dr. Blaettermann's(P43621) rooms and to board some at Mr. Conway's(P43888) others at Mrs. Jones'(P44167)-

On motion made and seconded - resolved that their application be granted on their giving the usual special pledges.-

[EVENT: Student Status:Readmission Action:granted 1839-09-07] Mr. William E. Hopkins(P39116) a student of last Session to whom the Faculty by its resolution of July 5th determined to refuse admission during the present Session; made application through the Chairman for permission to matriculate - Mr. Hopkins having made explanations to the Chairman in regard to his conduct and want of proficiency last Session - On motion made and seconded - Resolved that he be permitted to re enter the University.-

[EVENT: Student Status:Withdrawal from University Action:granted 1839-09-07] Mr. Andrew R. Moom(P44233) with his mother's consent, made application

for permission to withdraw from the University - On motion made and seconded- resolved, that his application be granted.-

[EVENT: Student Status:Admission Action:granted 1839-09-07] Mr. Bell(P28600) made application through the Chairman for permission to matriculate - He was a student of Wm & Mary() - went to Norfolk(PL4200) without leave, and was advised to withdraw to avoid the Action of the Faculty - went to Texas where he has practised law -

On motion made and seconded - Resolved, that Mr. Bell(P28600) be allowed to matriculate on condition that within a reasonable time he produce a Certificate or other satisfactory testimonials of good character.-

[EVENT: Boarding Action:postponed 1839-09-07] Mr. David Sutton(P33599) made application thro' the Chairman for permission to board out of the University on account of ill health - he is under the age made requisite by the enactments to entitle him to this privelege, but his father Dr. Sutton(P33599) is very desirous that it should be extended to him - On motion made and seconded -

Resolved, that his application be referred to the favorable consideration of the board of Visitors.-

[EVENT: Boarding Action:granted 1839-09-07] Mr. Lewis(P30661) made application through the Chairman for permission to occupy a room in Hotel C. He will board with Col. Woodley(P44018) and teach his children.-

[EVENT: Boarding Action:granted 1839-09-07] Mr. John R. Bowdoin(P42749) made application thro' the Chairman for permission to occupy the same rooms - He is a relation of Mr. Tucker(P43619) and will board with Professor Tucker(P43619) -

A motion was made seconded and passed that the room be granted to Mr. Turner.(P25903)

[EVENT: University Administration:Personnel Decision  1839-09-07] The application of Mr. Christian Grimme(P44234) for a licinse to teach Fencing, Gymnastics &c to the students of the University was taken up and his testimonials considered - thereupon a motion was made seconded and passed, that his application be granted on condition

that his terms be satisfactory be the faculty.-

[EVENT: Boarding Action:granted 1839-09-07] Miss Lucy Terrell(P43999) made application through the Chairman for a license to keep an out boarding house for the students of the University - A motion was made seconded and passed that her application be granted.-

[EVENT: Boarding Action:granted 1839-09-07] Mrs. Maria Jones(P44167) made application thro; the Chairman for a renewal of her license to keep an out boarding house for the Students of the University - Whereupon

Dr. Harrison(P25515) offered the following resolution which was seconded and passed

Resolved that the Faculty in view of the disorders of Mrs. Jones'(P44167) boarding house the last Session cannot grant her application for the renew al of her license, but on the condition that she shall give such special written pledges of future good order at her house as shall be approved by the Faculty -

Mr. Bonnycastle(P43623) voted in the negative because such pledges have been taken in other cases and not observed.-

[EVENT: Student Status:Admission Action:granted 1839-09-07] Mr. James F. Jones(P38847) who was expelled from William and Mary(CB0008)for posting a follow student as a Coward, made application thro' the Chairman for permission to matriculate -

Dr. Cabell(P39304) offered the following resolution which was seconded and passed -

It appearing from the written statement of Mr. Dew(P44235) President of William and Mary(CB0008) that Mr. James F. Jones(P38847) was expelled from that College for an offence not punishable by expulsion in this institution -

Resolved that he be allowed to matriculate on giving special and satisfactory assurances to the Chairman -

[EVENT: BoV Meeting  ] Professor Rogers(P43658) offered the following resolution which was

The Board of Visitors at their late meeting having recommended to the Faculty the adoption of some further means of promoting the Cultivation of composition among the Students - Resolved that a committee be appointed to take the subject into consideration and report upon the same.- Whereupon Messrs. Rogers(P43658), Cabell(P39304) and Emmet(P43625) were appointed to constitute the Committee

[EVENT: BoV Meeting  ] [EVENT: Library:Books  ] The Chairman appointed Dr. Harrison(P25515), Mr. Bonnycastle(P43623) and Dr. Blaettermann(P43621) a committee, under aresolution of the Board of Visitors, to examine the books given to the Library by the late Christian Bohn.-

[EVENT: Boarding Action:granted 1839-09-10] Mr. Charles A. Rose(P26180) made application through the Chairman for permission to board with his particular friend Miss Terrell(P43999) -

On motion made and seconded, resolved that his application be granted.-

[EVENT: Boarding Action:denied 1839-09-10] Mr. William M. Ragland(P32763) made application thro' the Chairman for permission to board with Miss Terrell(P43999) on the ground of particular friendship-and that he boarded there on a former occasion -

On motion made and seconded - Resolved, that his application be refused.-

[EVENT: Student Status:Dropping a Class Action:postponed 1839-09-10] [EVENT: Course Reference:Moral Philosophy  ] Mr. Jaq. P. Taliaferro(P23353) made application through the Chairman for permission to leave the School of Moral Philosophy with the view to devote himself exclusively to law - The Professor being absent the Faculty declined acting in this case-

[EVENT: Boarding  ] The Chairman stated to the Faculty, that he had suggested to Mrs. Jones(P44167) the following conditions upon which he supposed, the Faculty would be willing to renew her licinse for keeping an out Boarding house - and that Mrs. Jones(P44167) had informed the Proctor, that she was willing to sign a pledge to comply with the said conditions.-

1st To prevent all gaming and drinking by the boarders in their rooms, or on the premises.-

Second - To take no student as a boarder, until he shall have ontained leave to board out of the University -

Third - To entertain or allow to remain in the house no dismissed student, nor any suspended student during the time of his suspension .-

Fourth - To Prevent disturbances of, or rudeness towards persons passing along the road by any boarder; and as far as practicable to discourage frequent collections of the boarders in the road or street about the premises.-

Fifth - Toreport promptly to the Chairman any violation of these regulations by any boarder.

Lastly - To observe all laws enacted by the visitors realting to private boarding houses.-

On motion made and seconded - Resolved, that Mrs. Jones(P44167) be licinsed to keep an out boarding house, on signing the foregoing conditions.-

A motion was made seconded an passed that these conditions except the fourth be prescribed to the keepers of all the out boarding houses.

Present the Chairman and Professors - Rogers(P43658) and Cabell(P39304) - there being no quorum they adjourned - subsequently Professor Cabell(P39304) proposed to request one of the absent members to attend - Professors Bonnycastle,(P43623) Griffith(P43661) and Blaettermann(P43621) then a appeared and joined the meeting.

[EVENT: Boarding Action:granted 1839-09-17] Messrs. James T. Gee(P24263) and Joel W. Jones(P29179) made application through the Chairman for permission to board with Isaac White Esq.(P44035) - Mr.Gee(P24263) has not matriculated; Mr. Jones(P29179) has matriculated and taken board with Mr. Conway.(P43888) - Mr. Conway(P43888) has given his consent that Mr. Jones(P29179) may leave his Hotel - neither has attainedtthe age required, to entitle him to the privelege - Mr. Jones(P29179) besides the particular friendship subsisting between Mr. white(P44035) and himself grouns his application on ill health -

Mr. Gee(P24263) was requested to appear before the Faculty - he will be 19 on the 18th of March - Mr. White(P44035) is his particular friend and is related to Mr. Jones(P29179) - both visited Mr. White(P44035) during the last Session regularly - Mr. Gee(P24263) expected to board with Col. Woodley,(P44018) but was disappointed - his health is not good, and during vacation was advised by his physician not to return to College -

On motion made and Seconded - Resolved that the application of Messrs. Gee(P24263) and Jones(P29179) be granted, on condition that the price of board &c be approved by the Chairman.-

[EVENT: Student Status:Dropping a Class Action:granted 1839-09-17] Mr. B. D. Howard(P35989) made application through the Chairman for permission to leave Mathematics and take Natural Philosophy - On motion made and seconded resolved, that his application be granted.-

[EVENT: Student Status:Dropping a Class Action:granted 1839-09-17] Mr. Benjamin F. White(P40598) applied thro' the Chairman for permission to leave Chemistry and take Mathematics - On motion made and seconded - Resolved, that his application be granted.-

The Chairman laid before the Faculty Mr. Christian Grimme's(P44234) rates for Fencing, and use of the Gymnasium(PL8500) - On motion made and seconded - Resolved that the said rates be approved-

Mr. Lewis Kaupe(P44236) made application through the Chairman for licinse to teach dancing &c to the students of the University - on motion made and seconded - resolved that his application be laid upon the table.-

[EVENT: Boarding Action:granted 1839-09-17] Mr. John A. Washington(P24225) who is over the requisite age for boarding out of the University, made application for permission to board with Charles Meriweather Esq.(P44237) - On motion made and Seconded - Resolved. that his application be granted.-

[EVENT: Boarding Action:granted 1839-09-17] Mr. Benjaman F. Poters(P44238) made application thro' the Chairman for permission to occupy a room at Mr. Bigelow's(P44106) and board with Mrs. Jones(P44167) - On motion made and seconded - Resolved, that his application be granted on his giving the usual special pledges.-

[EVENT: Student Status:Readmission Action:denied 1839-09-17] Mr. John H. McAfee(P22105) who was dismissed last Session for being engaged in the riot of November 12th made application thro' the Chairman for readmission - On motion made and Seconded - Resolved 1/3 that his application be refused.-

[EVENT: Student Status:Readmission Action:granted 1839-09-26] Mr. Francis H. Kennedy(P39957) who was dismissed last Session for being concerned in the riot of the 12th November, made application thro' the Chairman for readmission into the University - He returned to the University to study and offers to give any special pledges which may be required of him; On motion made and seconded, Resolved that Mr. Kennedy's(P39957) application be granted on his giving the usual special pledges.-

[EVENT: Student Status:Readmission Action:granted 1839-09-26] Mr. John H. McAfee(P22105) whose application for readmission was erfused at the last meeting, renewed the same through the Chairman,- Whereupon motion made and seconded - Resolved that Mr. McAfee(P22105) be readmitted into the University of his giving to the to the C Chairman the usual special pledges.-

[EVENT: Boarding Action:denied 1839-09-26] Mr. Edward B. Davis(P29328) who was permitted to board out of the University last session on the plea of ill health, made application thro' the Chairman for permission to board at Capt. Perrow's(P44168) on the same ground - On motion made and seconded - Resolved that his application be not granted.-

[EVENT: Student Status:Dropping a Class Action:granted 1839-09-26] Mr. Thomas B. Jordan(P24670) made application thro' the Chairman for permission to quit the School of Civil Engineering and take some other - On motion made and seconded - Resolved that his application be granted.-

[EVENT: Course Reference:Natural Philosophy  ] [EVENT: Student Status:Dropping a Class Action:granted 1839-09-26] Mr. Edwin Gibbs(P28328) made application thro' the Chairman for permission to quit the School of Ancient Languages and take Natural Philosophy - On motion made and seconded - Resolved that his application he granted.-

[EVENT: University Administration:Personnel Decision  ] Mr. Enoch C. Breeden(P44239) made application thro' the Chairman for

a licinse to teach Dancing, &c to the students of the University-

On motion made and seconded Resolved, that Mr. Breeden(P44239) be permitted to give lessons in Dancing &c to the Students, at some private house out of the precincts approved by the Chairman, and under such restrictions as to time and price and under such regulations as the Chairman may prescribe.-

Mr. Louis Kaupi's(P44115) application for a licinse to teach Dancing &c to the Students of the University was on motion made seconded and passed, taken up and considered -

Whereupon, on motion made and seconded -

Resolved, that Mr. Kaupi(P44115) be permitted to give lessons in Dancing to the students, under the same restrictions prescribed in Mr. Breeden's(P44239) Case - and on condition that he give to the Chairman satusfactory testimonials as to his qualifications &c -

[EVENT: Official University Celebrations and Events Action:denied 1839-09-26] Mr. Enoch C. Breeden(P44239) made application through the Chairman for permission to occuping for dancing the large room in the basement story of the Old Library -

On motion made and seconded that his application be not granted -

Mr. A. J. Stringfellow(P31716) made application thro' Chairman for permission to visit Georgetown D. C.(PL4300) on occasion of the college Commencement which is soon to take place -

On motion made and seconded - Resolved that Mr. Stringfellow 's(P31716) application be not granted -

Blaettermann,(P43621) Harrison,(P25515) Cabell,(P39304) Emmet(P43625) & Rogers(P43658).-

[EVENT: Student Misconduct:Physical Assault  ] The Chairman laid before the Faculty a written communication from Clo. Ward(P43873), complaining of the violent conduct of Mr. John S. Moon(P37487) in throwing a knife at the servant while at table in the dinning room.-

A motion was made seconded and passed, that Mr. Moon(P37487) be sent for - He appeared and stated that he could not obtain the attendance of the servant- that he had several times before neglected him - He said he would not have considered it proper to have acted considerately - His reason for throwing the knife at the servant was, that he had spoken to him frequently and was only answered by laughing.- the knife was thrown at his legs - He reckons his intention was to strike him.- He did not know it would do any good to complain to Col. Ward(P43873) - He had complained to the servant frequently without effect.-

Col. Ward(P43873) was requested to appear before the Faculty - He said that in his note he had made the mildest statement, that the case woud admit of - He had just stepped into the kitchen, and returned immediately- Mr. Moon's(P37487) behavior had not been as good as he could wish the boarders are generally very orderly.- The servant is active and attentive - He has four male servants, besides a boy and girl in attendance on table.- Mrs. Ward(PP43909) was at the end of one table, and Mr. Moon(P37487) not for from her at another.- She was much alarmed - the knife was thrown across the table - Mrs. Ward(PP43909) sits at the end one of one table, and Col. W.(P44338) Walks round to superintend the servants and make them perform their duty - The servant is not insolent - thinks it was Mr. Moon's(P37487) desire to have his exclusive attendance.-

Dr. Harrison submitted the following resolution which was seconded and passed

[EVENT: Student Status:Suspension  1839-09-30] It appearing to the Faculty that Mr. John S. Moon(P37487) was guilty of a serious breach of the laws and of good order at his hotel, by throwing a knife at servant in attendance on the table.

Resolved, that he be suspended for a month and required to spend the time of suspension at his father's-

[EVENT: Exception:Denied  1839-09-30] Mr. Blair(P28490) made application through the Chairman for leave of absince three weeks to visit home. Has not the consent of his mother, and offers no good reason why the application should be granted.-

On motion made and seconded - Resolved, that his application be not granted.-

The Chairman laid before the Faculty a communication from Mr. Enoch C. Breeden(P44239) in relatation to the price charged by him for Dancing, Waltzing &c and asking the Faculty not to reduce the price lower than therein stated -

On motion made and seconded -

[EVENT: University Administration:Personnel Decision  ] Resolved, that Mr. Breedin's(P44239) price for Dancing as stated in his communication be approved by the Faculty, on condition that his Session be 8 instead 6 of weeks-

The Faculty met 'October 16th, 1839

Present the Chairman and Professors Harrison,(P25515) Cabell,(P39304) Tucker,(P43619) Bonnycastle(P43623) and Blaettermann(P43621) -

[EVENT: University Administration:Banking  1839-10-16] The Chairman laid before the Faculty, the bank report for September.-

The Chairman informed the Faculty on the report of the Proctor, that Messrs. Samuel Oldham,(P41838) F. E. Morancy,(P27216) Jules G. Olivier(P38282) and Thomas H. Watts(P37123) dined at a tavorn in Charlottesville on the inst.

[EVENT: Student Misconduct:Drinking  ] The Chairman stated to the Faculty that Professor Harrison(P25515) informed him, that on the instant he found Messrs. Thomas C. Williamson(P28039) and Benjamin M. Rice(P25453) Rice drinking at the bar of Terrell and Hill's tavern - The Chairman upon sending for these gentleman and investigating the case, found that it was not Mr. Williamson(P28039) who was seen by Professor Harrison,(P25515) but James Blackmon(P43285) - but Mr. Williamson(P28039) dined at the tavern.- the Chairman has reason to beleive that Mr. Blackmon(P43258) has been in the habit of keeping liquor in his room.-

[EVENT: Student Misconduct:Uniform Violation  ] The Chairman informed the Faculty that on another occasion recently Mr. Benjamin J. Barbour(P38272) dined at a 'tavern.- that Mr. William H. I'Anson(P27351) about a week age was seen by Professor Harrison (P25515) at Fitch's tavern without uniform - He informed the Chairman that he was there by accident, and then determinde to visit Miss Lyons(P44240). Mr. C. M. Towles(P34053) was saturday last in Charlottesville, without Uniform as to coat and vest - Mr. Early(P42190) was out of Uniform as to coat.- Mr. Samuel G. Davis(P25288) was out of Uniform in Charlottesville as to coat - and Mr. Thomas B. Jordan(P24670) as to pants and vost- Mr. Jules G. Olivier(P38282) was at the same time and place out of Uniform as to pants.

A motion was made seconded and passed, that the foregoing gentlemen be sent for

Mr. James Blackmon(P43285) appeared, and confessed, that he drank wine at the tavern.- the following questions were then propounded to him. 1. How many glasses did you drink? 2. Did you purchase the liquor? 3. Was it your first visit to the tavern? 4. Have you been in the habit of keeping liquor in your room? those questions Mr. Blackmon(P43285) refused to answer.-

Mr. Benjamin H. Rice(P25453) appeared, and said that he was invited in the tavern by a friend, and took a glass, only one of wine it was his first visit to the taver, except once to see his brother.

The Chairman stated to the Faculty that Mr. Blackmon(P43285) in purchasing liquor must have violated the anti-credit law - in as much as he has been since his matriculation entirely without funds.

[EVENT: Student Status:Dismissal Action:granted 1839-10-16] Professor Cabell(P39304) offered the following resolutions which were seconded and passed,

It appearing to the satisfaction of the Faculty that Mr. James Blackmon(P43285) visited a public tavern on saturday evening last and drank at the bar thereof, and in so doing violated the Anti-Credit law, and there being further reason to beleive that he had before visited taverns and kept ardent spirits in his dormitory -

Resolved, that he be dismissed from the University, and interdicted from the precincts.

[EVENT: Student Status:Suspension Action:granted 1839-10-16] It appearing to the satisfaction of the Faculty, that Mr. Benjamin R. Rice(P25453) visited a public tavern on saturday evening last, and drank at the bar thereof.

Resolved, that he be suspended for two weeks, and that he be required to spend the time at Mr. Bowcock's tavern(PL8596).-

Mr. C. M. Towles(P34053) appeared and said that he had no Uniform - Ordered his Uniform soon after he matriculated, it has not been made yet-

[EVENT: Student Misconduct:Uniform Violation  ] Mr. William L. Early(P42190) appeared and said that he wore a summer coat, which he thought it was lawful for him to do - it was altogether a mistake, and he has no intention of violating the law.

Mr. Samuel Oldham(P41838) appeared and said - that he did dine at the tavern - was in town - had been sick and was too weak to return conveniently to his boarding house to dine - paid for his dinner.

[EVENT: Student Misconduct:Uniform Violation  1839-10-16] Mr. Thomas B. Jordan(P24670) appeared and said that he had no other Uniform - thought that his pants were Uniform - were them to Charlottesville(PL4204) a dozen times last session - Has reed no money from home this session, and has therefor been unable to buy a vest.

Mr. Samuel G. [EVENT: Student Misconduct:Drinking  1839-10-26] The Chairman(P33195) mentioned, that yesterday afternoon about 4 OClock being informed that there was a drinking party at Mr. C. M. Towles'(P34053) room, he visited it, and found Mr. Phinizy(P27603) just recovering from the stupor of intoxication, Mr. Blackmon(P43285) who was under the influence of liquor, and Mr. C. M. Towles(P34053) who altho' not intoxicated had apparently been drinking, the room had all the appearances of having been the scene of a drinking party.

Mr. Phinizy(P27603) having been summoned, appeared before the Faculty, and stated, that yesterday morning meeting Mr. Blackmon(P43285) at the Post Office, he was asked by him to go into Mr. Towles(P34053) Room, and when, there, and when there, upon his invitation drank one, and afterwards another glass of whiskey which was taken unmixed in a mug from a bottle. The Whiskey he supposes was bought by Mr. Blackmon(P43285) - He was a member of the same School with Mr. Blackmon(P43285) in Georgia. He was going away. This was the first time he had drunk a glass since he entered the University, and he is not in the habit of drinking any where.-

Mr. Towles(P34053) having been summoned appeared before the Faculty and admitted, that he had had some liquor in his room which was brought there by a friend, and several drank there during the day - Mr.

Blackmon(P43285) who brought the liquor was a particular friend. with whom he had been intimate since the vacation. He stated that he did not know how much had been drunk, but thinks more than a pint, that the drinking began sometime in the morning, and that he made no objection to the introduction of the liquor in his room, and that he partook of it himself - that he was at his room the chief part of the day - He did not give the invitations to persons to come to his room to drink, except in one case the day before and when he was not certain that there would be any drinking at his room.-

[EVENT: Student Status:Dismissal  1839-10-26] Mr. Bonnycastle(P43623) offered the following resolution which was a seconded and passed -

It appearing to the satisfaction of the Faculty that a dr drinking party was held at an early period of the day on the 25 October at the room of Mr. C. M. Towles,(P34053) that raw spirit was drunk there to an extent which produced intoxication and moreover that Mr. Towles(P34053) gave his consent to this meeting and participated therein.- Therefore Resolved, that he be dismissed from the University, and interdicted from the precincts

[EVENT: Student Misconduct:Drinking  ] The Chairman informed the Faculty that on the evening of the 3rd instant between 9 & 10 oClock he received information of a drinking party at the dormitory of Messrs. Chambers(P24015) and Ervin(P37889).- that he and the proctor visited the room and found Mr. Chambers(P24015), Mr. Pope(P39857) and a young man not a student of the University - the last two being intoxicated - Mr. Erwin(P37889) one of the occupants of the room, was not present, having left the room as soon as the liquor was introduced.-

The Chairman also stated to the Faculty, that Mr. William B. Mathews(P36243) was one of the party at the room of Messrs. Chambers(P24015) and Ervin(P37889) - and that Mr. F. H. Reese(P30297) had been seen in Charlottesville(PL4204) intoxicated.

On motion made and seconded - resolved, that Messrs. Chambers(P24015), Pope(P39857), Mathews(P36243) and Reese(P30297) be summoned before the Faculty.-

Mr. Chambers(P24015) appeared and said, that spirits were introduced into his room, on the occasion of a visit of a friend from a distance - He was not present when the liquor was introduced, nor perhaps for an hour afterwards - He was aware that an arrangement would be made to receive his friend with drinking. - The liquor used was brandy drunk in the form of toddy. Mr. chambers(P24015) being asked the cause of his frequent absences from the school of ancient Languages, replied that he had been frequently unwell.- The party in general in his room were considered the purchases of the brandy which was apid for by one of them.- the drinking commenced about two hours after supper - Mr. Mathews(P36243) was present accidentally and left the room as soon as a noise was made.-

Mr. Pope(P39857) said that he was invited by Mr. Chambers(P24015) to visit his room, and that about half an hour afterwards spirits were offered to the party, of which he took two glasses which affected him a little.- The spirits be believed were introduced before he arrived.-

He heard after entering the room that the stranger paid for the liquor, but the party were to be indebted to him for the amount of the expenses.

Mr. Mathews(P36243) stated that he entered Mr. Chambers(P24015) room about 7 oClock not knowing that there would be drinking.- took a glass of toddy and left the room as soon as a noise was made.-

Mr. Reese(P30297) stated that being in the store of Mr. Flannagan(P44130) and

being invited to take a glass of wine, drank from a tumbler glass and was perhaps a little excited by it, but does not think that he was intoxicated - He did not purchase the wine.-

[EVENT: Student Misconduct:Drinking  1840-01-04] The Chairman stated, that he had received information that Mr. William N. Ragland(P32763) dined at Fitch's Tavern(PL8536) last monday, and drank there to intoxication.

Mr. Ragland(P32763) was sent for, and appeared before the Faculty. He a admitted that he visited Fitch's tavern(PL8536) on monday and dined and drank there, and became somewhat intoxicated - said he first went to the tavern on business, and afterwards drank toddy with a friend.- does not recollect how much, but he thinks not much, and was not so much intoxicated but that he could walk about, and remembers what occurred.- He stated, that he some days before obtained leave of absence from his Professors, that he returned but the day before, and that his leave had not expired; and that he therefore supposed he had a right to visit a tavern.- He admitted he had not obtained any leave of absence from the Chairman. On retiring he handed to the Faculty a written testimonial signed by the Students boarding at Miss Terrell's(P43999), where he boards, of his general good character, offering to become securities for his future good conduct, and to report him in case of misbehavior.

Ragland(P32763) visited a tavern on the instant where he dined and drank to intoxication; but it appearing that his general deportment has been good, and that several highly respectable students, at the same time that they testify to his general good conduct offer to become sureties for the future good behavior, and to report him if he violate any pledge which he may give to the Faculty.

Resolved, that he be suspended for a fortnight, and required to spend the time at such place as shall be appointed by the Chairman.

Jones(P37532) applied for leave to withdraw; both having the written consent of their Professors, and the former as he stated, the express and particular authority of his guardian for so doing, the latter was of age. The Chairman stated that among other enquiries which he made of these students, he particularly asked them if their intended withdrawal was for the purpose of being engaged in a duel, or had any connection of any design of that nature. and that each assured him that he had no such intention, and further stated his reasons for withdrawing. Mr. Jones(P37532) alledging bad health, and Mr. Armistead(P41021) the severity of the climate and his dissatisfaction with the manner of living here, as the motives of their application- whereupon the desired leave to withdraw was granted to them -

Chambers(P24015) to fight a duel, which challenge was borne by Mr. Jones(P37532), and accepted by Mr. Chambers(P24015), and his acceptance borne by Mr. J. W. Pope.(P39857)

The Chairman also stated, that after recieving this information, he issued several warrants for the arrest of the parties; but that Messrs. Armistead(P41021) & Jones(P37532) succeeded in getting off; and that only Chambers(P24015) had been arrested, who had entered into a recognizance.-

On motion made and seconded.

Resolved, that Messr. William H. Armistead(P41021), and Josiah N. Jones(P37532) having obtained leave from the Chairman to withdraw from the University on the assurance given by each of them that he had no design to engage in a duel, and on the allegations of other reasons for their withdrawal, when as it now appears that they, the day before had engaged in a duel, the former by sending and the latter by bearing a challenge, and applied to withdraw only in consequence thereof; and that they might prosecute the said duel; therefore it is considered, that the said leave, so obtained, was null & void; and that the said Armistead(P41021) and Jones(P37532) remain amenable to the laws of the University.

[EVENT: Student Misconduct:Physical Assault  1840-01-10] On motion made and seconded - Resolved, that the case of Messrs. Armistead(P41021) and Jones(P37532) be continued for future action Mr. Chambers(P24015) was sent for and appeared before the Faculty. He stated that he received the challenge from Mr. Armistead(P41021) on monday at 2 OClock, by the hands of Mr. Jones(P37532); that he accepted it, and appointed to fight with sticks; that the other party positively refused to fight in this mode; that at lenght he was influenced by others, greatly against his will, to consent to fight with rifles; and that he would net have accepted the challenge, whilst a student,

if he had supposed that he was thereby binding himself to fight with murderous weapons. He stated that Mr. Pope(P39857) would not have consented to bear his acceptance or act as his friend had it not been for the mode of combat(with sticks)adopted by him; and that he like himself, was afterwards reluctantly constrained to consent to change the character of the fight. He stated that Mr. Pope(P39857) did not wish to appear before the Faculty.-

The Chairman stated, that Messrs. Jules G. Olivier(P38282) and C. C. Rogers(P38422)had returned from Washington City(PL4211) wither they had gone on an affair of honor in which Messrs. Olivier(P38282) & John A. Strother(P37901) were principals and Messrs. C. C. Rogers(P38422) and Benj. F. Peterswere(P36193) seconds- Mr. Strother(P37901) had previously withdrawn from the University and Mr. Peters(P36193) had not matriculated.

Mr. Olivier(P38282) having been sent for, appeared before the Faculty and stated that he forebore to make any defence as he was aware, that the Faculty had no discretion towards mitigating the penalty attached to the Offence which he admitted -

[EVENT: Student Misconduct:Uniform Violation  1840-02-08] The Chairman stated, that Mr. J. T. Phinizy(P30331) has recently purchased three pair of pantaloons of Messrs. Timberlake(P36085), Flannagan() & Co. but gave an order on the Patron for one pair only.- That he therefore, has either violated the anti-Credit law by purchasing two pair on credit, or the law requiring him to deposit his funds with the Patron, if he paid for them.-

Mr. Phinizy(P30331) was sent for and appeared before the Faculty. He admitted that he has purchased of Timberlake() , Flannagan & Co() . one pair of Uniform pantaloons for which he gave an order on the Patron, and agreed for two other pair not Uniform, which he says were to have been paid for by another person; but that on the difficulty being made, they were taken back by the merchants, and that he does not intend to take them at all - He declined to say whether the person in whose name they were purchased is a student. He denied that he won them by gaming or any other wager.

On motion made and seconded - resolved, that the Chairman be requested to write to the father of Mr. Phinizy(P30331), and inform him of the attempt of his son to violate the laws, and the serious consequences which such violation would have involved.

Messrs. Oliver(P38282) and Rogers(P38422) had only obtained leave of absence for a short time.

Mr. Bonnycastle(P43623) offered the following resolution which was seconded and passed.

It appearing to the Faculty that Mr. Benjamin F. Peters(P36193) applied for, and attained permission to attend the Lectures of the Professor of law(P33195), on the understanding that he should complete his connection with the University by matriculating on receiving his funds on the 1st of Feby. And the Faculty having reason to suspect, that Mr. Peters(P36193) after having so attended, became a second in a duel-

Therefore - Resolved, that in case it should appear that he did so act, that the Faculty regard him as coming within the spirit of the law respecting refusal to readmit.

The Chairman stated, that Mr. Joseph H. Kent(P38788) on the instant left the University without leave, went to the City of Washington(PL4211) and was absent about two weeks.- He at the same time laid before the Faculty two letters from Mr. Kent(P38788), in the first of which he (Mr. Kent(P38788)) stated that he had permission from his father to spend a week or two in Washington(PL4211) with two uncles members of Congress, and explained the circumstances which induced him to go without asking leave from his Professors and the Chairman. In the second letter Mr. Kent(P38788) acknowledged his fault; said it was his first infraction of college laws, either here or elsewhere-and expressed himself sincerely penitent for what he had done - and he beged that the Faculty would pardon his Offence - The Chairman also stated, that[EVENT: Student Misconduct:Uniform Violation  ]  Mr. Kent(P38788) had on a suit of clothes not uniform, which he said had been purchased for him by his uncle, the Hon: Felix Grundy.(P44270)

A motion was made seconded and passed, that in consequence of

the sincere penitence expressed in Mr. Kent's(P38788) second letter, he be only reprimanded by the Chairman and his father written to.-

The Chairman informed the Faculty that a few evenings ago, he saw Messrs. P. B. Stark(P23370), John A. Linton(P42661) and John N. Taylor(P30080) at Hill and Terrell's tavern(PL8597) .- Mr. Linton(P42661) was without Uniform.- Messrs. Linton(P42661) & Taylor(P30080) stated to the Chairman the next day, that they left the tavern in 10 minutes - Mr. Linton(P42661) went to get his Uniform Coat altered for the ball.- Mr. Stark(P23370) remained at the tavern and supped.-

Gooch(P32133) and Vincent M. Butler(P43171) had been reported as having attended the ball on the 24th instant at Fitch's tavern(PL8536) in Charlottesville(PL4204) , without Uniform.-

A motion was made seconded and passed, that Messrs. Stark(P23370), Jordan(P32559), Thomas(36950), Gooch(P32133) and Butler(P43171) be sent for.-

Mr. Stark(P23370) appeared and said, that he called at the tavern to see Mr. N. B. Davis(P44271) and old student, and that he remained and drank tea with him - drank no liquor - did not go to town expressly to see Mr. Davis(P44271) - he returned to the University before bedtime.-

Mr. M. M. Jordan(P32559) appeared and said, that he had no excuse to offer; the coat he were he gave an old cloak for, that he brought from home.- He believes the student brought the coat withbhim from home.-

Mr. Thomas(P36950) appeared and stated, that he had not a decent Uniform - had promised a lady to attend her to the ball- and was compelled in consequence of that promise to go.

Mr. Gooch(P32133) appeared and said that he had fully intended to go to the ball with Uniform - but got his Uniform Coat torn the day before.-

Mr. McDowell(P29987) having been sent for appeared before the Faculty

The Chairman laid before the Faculty the Bank report for March.

The Chairman stated to the Faculty on the information of Dr. Cabell(P43614), that on the instant Messrs. F. E. Morancy(P27216), Thomas Towles(P24008) and Thomas Y. Henry(P35089) returned from Charlottesville(PL4204) without Uniform. Mr. Morancy(P27216) informed the Chairman that the night before, they went to Charlottesville(PL4204) to take leave of their friend Mr. Oliver(P38282), who was about to return home - As he did not leave till after two Oclock they staid all night - Mr. Morancy(P27216) did not drink.- A motion was made seconded and passed that these gentlemen be sent for.

Mr. Towles(P24008) appeared and stated, that his uniform was torn - he went down about 10 OClock, and took leave of Mr. Olivier(P38282) about half past 2. He then went to bed - and took breakfast there in the morning - had told the servant to wake him early - this he failed to do - paid for his lodging and breakfast - there was no drinking or frollicking.- He did not think he was violating the law in going down to take leave of a friend.-

[EVENT: Student Misconduct:Drinking  1840-04-07] Mr. Henry(P35089) appeared and said, that he knew he was violating the law, but did not think the Offence a serious one - drank one glass of wine on the invitation of Mr. Olivier(P38282) - paid for his breakfast.

Mr. Thompson G. Maupin(P24056) applied for a reconsideration of the s sentence passed upon him at the last Meeting of the Faculty.- It appearing from the statement of Dr. Cabell(P43614), that Mr. Maupin(P24056) has since his dismission given himself and the other Medical Professors satisfactory assurances in respect to his efforts to improve, which were unknowm to him at the time of the action of the Faculty, and that all his Professors, upon the facts now known to them recommend that the sentence against him be rescinded, and a farther trial be allowed him therefore, resolved, that the sentence of dismission against Mr. Maupin(P24056) be reconsidered -

[EVENT: Student Misconduct:Guns  ] The Chairman(P33195) stated to the Faculty, that the (P43659) Proctor had reported, the following students for firing pistols on saturday and sunday last - Messrs. John. W. Irby(P34232) and John R. Bowdoin(P42749) fired pistols on the Western Range on saturday, and on sunday in the woods within the precincts - and John W. Gibbs(P44280), J. H. Holland(P44281) and Fleming T. Grantland(P24806) on sunday in the woods - The Chairman(P33195) had sent for these gentlemen, who admitted the charges alledged against them, but said that they did not own the pistols which they fired.-

On motion - Resolved, that these gentlemen be sent for -

Mr. Irby(P34232) appeared and said, that he fired a pistol twice on the Western Range - Saturday - and once, sunday in the woods - Saturday two gentlemen passed, one of them having a pistol which he had bought - it was proposed to try the pistols and he fired it twice - Sunday he went out to walk with two companions not knowing that they intended to shoot when he started - On their observing that they were going out to shoot, he went bach and borrowed a pistol - does not own one - and thought it was not unlawful to shoot at a distance from the University.

Mr. Gibbs(P44280) appeared and stated, that he fired a pistol, on sunday in the woods.- He went to the Western Range with no

such intention,- the pistol was not his own, and he used one that was carried out by one of the party.- He supposed he was out of the precincts, where he thought it was not unlawful for him to shoot - After Col. Woodley(P44018) saw them, the went about a mile further towards Mr. Maury's() to shoot.

Mr. Bowdoin(P42749) appeared and said that he fired once on the Western Range and once in the woods on the same evening, did not fire on sunday - He went to the Western Range accidentally and not for the purpose of shooting - he went to the woods for the purpose of shooting - the pistol did not belong to him, and he does not own one - knew that he was violating the law when he fired on the Western Range.-

[EVENT: Library:Budget  ] They found, that a number of volumes of periodicals more especially of German periodicals which it was proper to retain on the shelves of the Library were unbound, and on this account both unseemly and inconvenient for reference.- Such volumes when they constituted a part of the series, some of the volumes of which were already bound.-or when the whole series as far as it extended, was unbound, but not very extensive or particularly valuable, they retained, hoping that the Board of Visitors(CB0042) would think it fit to cause them to be suitable bound.- Where the numbers or parts of a periodical for any year were not complete, they put them aside with a few exceptions.- Of the works not periodical , they thought it their duty to retain some which from their being unbound present an exterior hardly suited to the shelves of the Library - This applies more especially to the German books - The number of books periodical and other which to be retained would require binding is considerable - but a plain cheap binding would suffice for their preservation and for the external appearance - and the Committee thinks that the expense should be incurred rather than sacrafice the books-

They would further suggest whether it might not be proper to ask of the Board of Visitors(CB0042) a small appropriation to complete ask of the (CB0042)Board of Visitors a small appropriation to complete volumes of particularly valuable periodicals which went only one or more numbers - It was their wish and purpose to present a list of these - but they found the task of examining all the books and periodicals, and making the selection properly to consume so great an amount of time, that they were obliged to omit this part of the report -

The Faculty, having taken into consideration the case of flagrant outrage upon the person of Mr. Duke(P27140) committed by William P.(P24420) and John C. DuVal,(P36770) are of opinion, that, altho' the conduct of these students appears to merit at their hands most serious animadversion as a gross violation of the laws and of good order, yet it would probably be defeating on the one hand the ends of justice to award to it the punishment it deserved under the enactments, by lightening the legal penalty which a refence to the legal tribunal would otherwise procure. and on the other hand injure the discipline of the University to attach to it a slight censure; and that it is therefore better to leave it to the cognizance of the Civil tribunal -
