The Faculty met in the Library - room at 5 o'clock P. M.

After the monthly circulars were filled, the Chairman informed the Faculty that,

[EVENT: Student Status:Dropping a Class Action:granted ] [EVENT: Course Reference:Moral Philosophy  ] ExcepFrancis S. Sampson (P35802) wished to leave the School of Mor. Philosphy, which was granted.

[EVENT: Student Status:Dropping a Class Action:granted ] [EVENT: Course Reference:Chemistry  ] Jno. A. Meredith (P43578) applied for leave to quit the school of Chemistry, which was granted.

[EVENT: Student Misconduct:Uniform Violation  ] The Chairman said a very great number of the students had violated the uniform law this spring and requested the Faculty to take the proper notice of such violations. After some conversation among members of the Faculty, Mr. Davis (P33195) offered the following resolution.

"Resolved, that in the opinion of the Faculty, the uniform law should be strictly enforced against those students who have purchased clothes in violation of the enactments, since the public

notice given to them by the Chairman."

The above resolution was carried.

Mr. Bonnycastle (P43623) offered the following motion which was carried.

In consequence of a request from the Chairman that the Faculty would assist him with their advice respecting the mode of carrying into execution the law respecting uniforms - moved that the Chairman be requested to write to the parents or guardians of those students who have violated the law respecting the summer uniform; omitting those cases which he thinks may admit of exten- uation.

Mr. Davis (P33195) voted in the negative because he thinks the punishment Proposed is not sufficient to induce obedience to the law.

[EVENT: Student Misconduct:Academic Lassitude  ] Walter Henderson (P43577) was reported as idle in several of the classes which he attends - The Chairman was requested to give his Guard- ian the usual notice in such cases.

[EVENT: Student Status:Dropping a Class Action:granted ] [EVENT: Course Reference:Mathematics  ] Augustine A. Magill (P30211), on Motion of the Prof. of Mathematics, was permitted to quit this class.

[EVENT: Student Misconduct:Academic Lassitude  ] Thomas McLaughlin (P44033) was reported as inattentive in several classes; & the Chairman was requested to notify his father of that fact.

[EVENT: Student Misconduct:Academic Lassitude  ] James A. Chapman (P31050) was report(ed) as idle in one of his classes -

The Chairman was requested to inform his father of it.

Mr. Meredith's () reasons for this application having been considered as satisfactory, his request was granted.

[EVENT: Student Misconduct:Uniform Violation  ] Mr. Robt. J. Michie (P36086) was reported by the Chairman as an incorrigible violator of the uniform law. Nothing was done in this case.

[EVENT: Student Misconduct:Drinking  ] The Chairman said he had been informed that Jno. R. Jones (P23566), a stu- dent, was intoxicated on the night of Saturday last. He was sent for, but was not to be found by the Janitor.

The Secretary of the Faculty was instructed to notify J. R. Jones (P23566), T. L. Preston (P43698), D. H. Tucker (P43591) & J. F. Curtis (P43591) to hold themselves in

readiness to receive a notice to appear before the Faculty tomorrow at 5 ½ o'clock P. M. tomorrow.

The Faculty then adjourned, to meet tomorrow at 5 ½ o'clock P. M.

Tuesday July 2nd, 1833.

The adjourned meeting of the Faculty met in the Library - Room at half past five o'clock P. M.

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Dismissal  ] Thomas L. Preston (P43698) was sent for, and said, he was not active in bringing about the drinking on Saturday evening last, for he did not know that he was to muster with the Company until he came from his boarding-house to the University, and consequently, it was without his knowledge. There were about 30 students present, but he

does not know how much was drunk. The spiritous liquor was dilu- ted, he thinks, but he did not drink any of it himself nor did he suggest the idea of getting it, to the company. Being asked, who is to pay for it, he replied a number of individuals. He did not suppose that merely drinking was a violation of the enactments.

He did not expect any excess to take place, for the students were not drinking more than twenty minutes.

John R. Jones (P23566) having been sent for, appeared before the Faculty, and said, he did drink to excess on Saturday evening last, but thinks he was not very much intoxicated. He drank four or five small glasses of brandy julap. He says there were two pitchers of julep and one of sangaree when the Military Corps began to drink and that the vessels were replenished once more. He acknowledges that this was not the first time he had been guilty of drinking too much this session, for he did the same thing on the 13th of April when the Company dined at Ward's (PL8541) Tavern in Charlottesville (PL4204); tho' on that oc- casion the was altogether wine.

David H. Tucker (P43591) was sent for. He says he drank some last Saturday evening, and was in high spirits, but was not intoxicated. He took two glasses of julep and several of sangaree, not being aware at the time, that it would affect him. He has a perfect recollect-

ion of every thing which passed that evening. He would not have drunk if he had thought it would have intoxicated him. Being ask- ed if he had taken too much to drink before, during the session, he said his flow of spirits was a little high about the 13th of April.

John F. Curtis (P43591) being sent for, says, he believed he did drink too much on Saturday evening, but he certainly was not intoxicated, for he merely drank five or six very small glasses of sangaree, though he was deceived as to its strength. He did not drink on the 13th of April, nor has he been at all in the habit of drinking. He said he made no noise at Mrs. Gray's (P43865) table, but believes he made some in front of her hotel. He is not a subscriber for a dinner on the 4th inst. nor was he a subscriber to the sangaree frolic of Saturday last. He does not intend to go with the Com- pany to town on the 4th.

Robert H. Gilliam (P43504) was sent for and denied that he was at all in- toxicated on the evening of Saturday last, for he only took two or three glasses of sangaree; which produced no excitement. He says he made no noise after his return to the University.

Mr. Davis (P33195) offered the following resolution, which was carried.

"Mr. Jno. R. Jones (P23566) having been intoxicated Saturday even- ing last within the precincts, and having admitted that he has been

intoxicated before since he became a student, and it appearing that he is irregular in his attendance upon, and making no profi- ciency in, his classes, therefore resolved that he be dismissed from the University."

Mr. Davis (P33195) offered the following resolution, which was agreed to.

"It appearing that Mr. David H. Tucker (P43591) was excited by liquor Saturday evening last within the precincts, as well as on the 13th of April last, therefore resolved that he be reprimanded therefor by the Chairman, and his father written to on the subject.

Mr. Davis (P33195) offered the following resolution which was carried.

"Resolved, that the Chairman be requested to admonish the officers of the volunteer corps of the impropriety of their con- duct in furnishing intoxicating liquors to the corps Saturday last, and to inform them that if the act be repeated, the Faculty will consider it their duty to dissolve their corps."

Mr. Davis (P33195) offered the following resolution, which was also carried.

"It appearing that John F. Curtis (P43591) was excited by liquor Saturday evening last within the precincts, therefore resolved that he be reprimanded therefor by the Chairman."

[EVENT: Student Status:Dropping a Class Action:granted ] [EVENT: Course Reference:Natural Philosophy  ] James T. Gray (P44037) applied for permission to leave the school of Natural Philosophy, which was granted.

[EVENT: Student Misconduct:Academic Lassitude  ] [EVENT: Exception:Postponed  ] Walter Henderson (P43577) & Thomas McLaughlin (P44033) having been reported as still too remiss in several of the classes which they attend, it was a- greed to suspend the sentence passed against them on the 3rd of June until after the examinations are over.

An order was passed for the Secretary of the Faculty to notify Robert J. Michie (P36086) to appear before them tomorrow at 6 o'clock P. M. which notice was immediately given to the Janitor to execute.

The Faculty then adjourned to meet again tomorrow at 6 o'clock P. M.

Wednesday July 3rd, 1833.

The Faculty met pursuant to adjournment, at the Library - room at 6 o'clock P. M.

[EVENT: Student Status:Suspension  ] Robert J. Michie (P36086) was sent for, and appeared before the Faculty.

He admits he had been very frequently without an uniform this sess-

ion. His was too old to wear in company, and the reason why he did not purchase a new one, was, because he did not expect to re- turn to the University next session. He was in the habit of bor- rowing uniform coats when he went to parties. His uniform was made about the 1st. of Oct. He purchased a citizen's cloth coat about the first of the spring.

Dr. Johnson (P36086) offered the following resolution which was carried.

""Robert J. Michie (P36086) having been a frequent violator of the Uniform Law, therefore, resolved, that he be suspended for one week from the University."

The Chairman read a letter from Mr. Reynolds Chapman (P44034) requesting the Faculty to investigate the evidence relative to a charge which had been made against his son James Alfred Chapman (P31050) by Alfred Street of the firm of Street and Sanxy (?). The Faculty unanimously resolved to comply with the request of Mr. Chapman (P44034), and fixed upon Monday evening next, as the time to do so.

[EVENT: Exception:Denied  ] A petition was read by the Chairman, signed by a number of the stu- dents, praying the Faculty to remit that part of the sentence against D. H. Tucker (P43591) requesting the Chairman to write to his father. The petition was rejected.

[EVENT: Student Status:Withdrawal from University  ] [EVENT: Exception:Denied  ] Benj. F. Minor (P37942) applied for leave to quit the University, which was

not granted.

[EVENT: Student Status:Dropping a Class Action:granted ] [EVENT: Course Reference:Moral Philosophy  ] Charles Randolph (P43581) applied for leave to quit the school of Mor. Phi- losophy, which was granted.

The Faculty then adjourned, to meet again Monday evening at 6 o'clock.

[EVENT: Student Misconduct:Theft  ] The Chairman read a letter from Mr. Reynolds Chapman (P44034) of Orange County (PL4264) requesting him to ask the Faculty to investigate the evidence upon which a suspicion was founded that his son James Alfred Chap- man (P31050), a student of this Institution, had stolen an octave flute and a spy glass from the store of Street and Sanxay near the University. After reading the evidence (See certificates A, B, C, D, E, F, G, H, I, J, K, L, M, N.) there appeared to be some obscurity about a portion of the statement of Mr. Jno. W. Stevenson (P43600), therefore, he was sent for and appeared before the Faculty. He said he was under

an impression, or rather, he had an indistinct recollection that he saw the horn - bound flute, referred to in Mr. Street's (P44055) letter to R. Chapman (P44034), in the store of Street and Sanxay, the first time he went to it, after seeing the unbound flute spoken of in his statement, in Mr. Jas. A. Chapman's (P31050) room.

Mr. Davis (P33195) offered the following resolutions, which were carried.

"Resolved, unanimously, that the Faculty having carefully investigated the charge which has recently been made against Mr. James Alfred Chapman (P31050), a student of this institution, of having stolen a flute & a spy - glass from the store of Street & Sanxay, are entirely satisfied from the evidence, not only that Mr. Chap- man (P31050) is wholly innocent of the charge, but that no act of his has authorised the suspicion, which was at one time entertained of his guilt."

"Resolved, that the evidence exhibited to the Faculty, consisting of letters and statements of Messrs. Street (), Stevenson (), etc. be preserved by the Secretary of the Faculty, and a copy thereof, and of the foregoing resolution, be furnished Mr. Chapman (P31050)."

Mr. Thomas Withers (P30398) Jr. was permitted to absent himself from all the examinations in the Classes which he attends. This privilege was granted Mr. Withers (P30398) on account of his having been sick for

some time past.

The Faculty, then, on motion, adjourned.

Monday July 15th, 1833.

The Faculty met in the Library - room at 6 o'clock P. M.

[EVENT: Student Misconduct:Verbal Assault  ] The Chairman said that Edmund Ruffin (P34480), a student, had used disre- spectful language towards the Proctor. Whilst the Chairman was stating the evidence relative to Mr. Ruffin's (P34480) disrespectful con- duct to the Proctor, Mr. Pendleton (P43653) came before the Faculty, and said, Gen. Cocke (P30984) informed him that he (Gen. Cocke (P30984)) had conversed

with Mr. Ruffin (P34480) upon the subject, and he (Ruffin (P34480)) stated to him (Gen. Cocke (P30984)) that he did not intend to be disrespectful to the Proctor, nor did he intend (at the time he spoke) the Proctor to hear him, for the Proctor was the distance of five or six dormitor- ies from him when the observation was made. The Proctor requested the Faculty not to act with rigor against Mr. Ruffin (P34480).

Mr. Edmund Ruffin (P34480) having been sent for, said, he was sitting opposite Mr. David H. Tucker's (P43591) room when the Proctor went into Mr. Dudley's (P43586) room to assess damages - Mr. Dudley (P43586) informed him that the Proc- tor had charged him two dollars for the damage done to his lock, altho' it was then in a better condition than when he took poss- ession of the room - He (Ruffin (P34480)) replied to Mr. Dudley (P43586) that it was a "Rascally imposition"; however, he did not intend the ob- servation to be heard by the Proctor. When the Proctor left Mr. Dudley's (P43586) room, he came where he and other students were sitting, and enquired who had used the offensive language which he had just heard - Mr. Ruffin (P34480) replied, he was the person - The Proc- tor observed, he (Ruffin (P34480)) was the only gentleman in the University he would have suspected of saying so - He immediately asked the Proctor if he meant to insult him; to which, the Proctor replied, no; but said he had supposed the language came from him, because

he had long ago perceived his (Ruffin's (P34480)) hostility towards him. He says if Mr. Pendleton (P43653) had asked him if he intended to insult him, he certainly should have answered in the negative.

Dr. Patterson (P43634) offered the following preamble & resolution, which was carried.

"Mr. Edmund Ruffin (P34480) having been heard by the Proctor to use insulting language with regard to one of his official acts, but it appearing by the declaration of Mr. Ruffin (P34480), and the circum- stances in which he and the Proctor were placed, the Proctor being in a room, at the time, and some distance off, that this language was not intended for the ear of the Proctor, and that Mr. Ruffin (P34480) did not suppose it could be over heard, and the Proctor having expressed his wish to the Faculty that they should not exercise rigor in the case, therefore, resolved that Mr. Ruffin (P34480) be repri- manded by the Chairman."

[EVENT: Boarding  ] [EVENT: Exception:Denied  ] The Chairman read a letter from Gen. Brodnax (P44056) requesting that his son, David W. Brodnax (P24792), a student, might be permitted to board, dur- ing the next session, at Mr. Ch. Meriwether's (P43863), with his uncle Mr. Th. Withers (P30398), Jr. The Faculty decided that the Chairman should be requested to inform Gen. Brodnax (P44056) that they had no power in the case.

[EVENT: Student Misconduct:Academic Lassitude  ] [EVENT: Student Misconduct:Failure to Appear When Summoned  ] It was stated by the Chairman, that Robert J. Michie (P36086), a student, instead of standing his examination in the School of Law, handed in a playing card with his name written upon it. He also said, Mr. Michie (P36086) did not behave properly when he afterwards conversed with him upon the subject. The Faculty were of opinion they could not summons Mr. Michie (P36086) to appear before them, as he had obtained leave to quit the University, and had actually quitted it.

Mr. Bonnycastle (P43623) offered the following resolution, which was agreed to.

"Resolved that Robert J. Michie (P36086) receive notice from the Chairman, at the end of the session, that he will be refused per- mission to enter the University next session, as a student, if he applied for such permission."

Dr. Dunglison (P43624) voted in the negative.

[EVENT: Course Reference:Law  ] Mr. Davis (P33195) from the Committee appointed to conduct the Final Ex- aminations, of this session, in the School of Law, made the fol- lowing report, which was adopted by the Faculty.

[EVENT: Student Misconduct:Theft  ] The Chairman read a note from Mr. Reynolds Chapman (P44034) of Orange (PL4264) stating that he thought the resolution of the Faculty of the 8th inst. might be misconstrued, for he never understood that any one made a charge against his son James Alfred Chapman (P31050) of having been guilty of stealing, but it was a suspicion, without, as he hoped, a shadow of proof to support it. Had a direct charge been made, his son would have met it in a different way.

Mr. Davis (P33195) suggested to the Faculty, that the resolution adopted at the meeting of the Faculty, on the 8th of July, relative to Mr. James A. Chapman (P31050), erroniously refers to as a charge against Mr. Chapman (P31050) what had only been injurious suspicion. He moved that that resolution be rescinded to enable him to offer a substi- tute for it; which motion having been adopted, he offered in lieu of the former resolution the following preamble and resolution which were unanimously adopted.

The Faculty pursuant to the resolution of the 8 day of

this month, proceeded to investigate the circumstances which have given rise to a suspicion injurious to the character of James Alfred Chapman (P31050), a student of this University, & carefully consid- ered the written evidence offered, and the oral testimony of Jno. W. Stevenson (P43600), a student, given in presence of the Board."

"It satisfactorily appears to the Faculty, that about the month of June, 1832, James Alfred Chapman (P31050), a student, of unblem- ished reputation, was in possession of a pocket spy - glass which he had purchased at the shop of Richd. Mathews (P44058), a jeweller in Charlottesville (PL4204) and of an octave flute which he said he had pur- chased at the store of Street and Sanxay, near the University; that Alfred Street one of the firm of Street & Sanxay, then resi- dent near the University, thinking that he had lost from the store a flute and a spy - glass of the same description, and hearing that the flute was in the possession of James Alfred Chapman (P31050), whose character was unknown to him, indulged an unfounded suspicion, that his lost flute was in the possession of James Alfred Chapman (P31050); that Mr. Street (P44055) from prudential considerations abstained from com- municating his suspicions to Mr. Chapman (P31050) and dissuaded others from making the communication, so that although Mr. Chapman (P31050) remain- ed a student till the end of last session, returned at the com-

mencement of the present, and has ever since continued a student of the University, and although the suspicion had been extensive- ly circulated, he had never till the month of June, in the pre- sent year, known that he was the object of this unworthy suspi- cion; that when the suspicion was communicated to him by some friendly students, he promptly adopted the most efficient means in his power to explain the circumstances, and repel the imputa- tion on his character and has satisfactorily proven that the spy - glass was, in fact, purchased by him from Mathews (P44058), and that the flute of which he was in possession, is not that which Mr. Street (P44055) supposed he had lost, but is another, which doubtless Mr. Street (P44055) himself had sold. The Faculty remark with satisfaction that the testimony of Mr. Street (P44055), voluntarily and cheerfully given, and that of Mr. Stevenson (P43600), from whom, Mr. Street (P44055) supposed he had re- ceived information of the identity of the flute in Mr. Chapman's (P31050) possession with that which he supposed he had lost, is the strong- est evidence to disprove that identity and to show that an unfor- tunate misapprehension which at first might have been easily cor- rected has been the cause of an injust suspicion which has pro- duced great and unmerited suffering."

"Therefore, resolved, unanimously, that in the opinion

of the Faculty, the conduct of James Alfred Chapman (P31050), in relation to this subject, has been entirely blameless; that his character is liable to no just imprecation from it; and that he is entitled to the undiminished confidence and respect of the Faculty and the public."

"Resolved, that the evidence exhibited to the Faculty consisting of letters and statements of Messrs. Pallen (P33805) applied to him for readmission into the University, but he thought it proper to re- fer the matter to the Faculty, for his conduct, last session, had been such as to attract the attention of the Proctor and other individuals. He said Mr. Pallen (P33805) acknowledged his error and made promises of future good conduct, and felt willing to give the Faculty any pledge they might require. Dr. Johnson (P33805) made the following motion which was agreed to.

"Moved that Mr. Moses M. Pallen (P33805) be permitted to matricu- late as a students of this University, provided he gives the Chair- man such assurances of future good conduct as he may require. Mr. Carusi (P44060) applied for a room to teach dancing in. The Faculty determined to leave the matter to the Chairman to arrange. brough (), requesting the Faculty to permit her house to be licensed as a boarding house for students. This application became neces- sary in consequence of her having last session evaded the law re- lative to those students who board without the precincts, by in- directly taking more than the sum prescribed by the enactments for boarding etc, etc.

Dr. Patterson (P43634) offered the following resolution which was carried.

"Resolved that the house of Mrs. Brockenbrough (P44061) be approved by the Faculty as a boarding house for students, provided a dis- tinct pledge be reviewed by her that the expense to the student for boarding, lodging, washing, fire, candles, attendance, and all other charges, made by her, directly or indirectly shall not exceed $150 for the session."

The Chairman said, Mr. Thomas McLaughlin (P44033) had applied to matricu- late as a student, and he now laid the subject before the Faculty, for their consideration, because Mr. McLaughlin (P44033) not only sustained a bad character as a student, neglecting his studies and not com- plying with the regulation requiring him to deposit his money with the Patron, but he had very recently been engaged actively as a member of a riotous party in making disturbing noises within the precincts.

Mr. McLaughlin (P44033) was sent for, and appeared before the Faculty. He says the reason why he did not make the usual deposits with the Patron, was, because he received but little money before the end of the session, and that he was compelled last session, to borrow a part of the money which he deposited from a fellow student, though he admits he received some money about two months before the end of the session, which he applied to the payment of his debts. thinks he spent about $700 last session! He denies that he had any thing to do with the fires which were built upon the Lawn last session, and moreover, says, that those persons who supose they heard him encouraging other students by loud shouts, were mistaken. He does not think he was connected with any of the dis- turbing noises which were made last session. The vote upon his readmission being taken, it stood as follows,

He did not speak dis- respectfully to Mr. Mitchell (P44064) (a professor) until he conceived him- self insulted - [EVENT: Student Status:Dismissal  ] After he was dismissed by the Faculty of the Uni- versity of North Carolina (CB0014) he says the Trustees expelled him at their next meeting.

[EVENT: Boarding  ] [EVENT: Exception:Granted  ] Mr. William Martin (P38484) requested permission to board out of the Uni- versity - He will be twenty years of age in December next. His application was granted, Mr. Tucker (P43619) and Dr. Johnson (P43633) voting against it.

Messrs. W. Henderson (P43577) and R. W. Tomlin (P31563) also applied for leave to reside out of the Precincts, stating that they would be of the age required by the Enactments to board out, in a few days. They were permitted to board out of the University, Mr. Tucker (P43619) and Dr. Johnson (P43633) voting in the negative.

Mr. George W. Trueheart (P27886) was permitted to board with his relation, Mr. Isaac White (P44035).

The Chairman stated that Mr. John M. Gardner (P39806), who is not yet six- teen years of age, had matriculated as a student, owing to an in- advertency of the Proctor.

Mr. Richard J. Harrison's (P37425) case was similar to that of Mr. Gard- ner (P39806), & the decision of the Faculty was the same.

[EVENT: Curriculum:Modern Languages  ] [EVENT: Curriculum:Ancient Languages  ] Mr. Tucker (P43619) offered the following preamble and resolution, which was unanimously agreed to.

"Whereas it is found that by the late arrangement of the lecture hours there is a spare half hour between the last morning lecture and the dinner hour and it is particularly desirable that this half hour should be added to the time assigned to the schools of languages, by which change, those schools would have sufficient time for two classes, which they have not at present; and whereas there is found to be great difficulty in providing lecture hours for all the extra classes so as for those classes not to interfere with each other under the present increase of students."

"Resolved therefore that application be immediately made to the Executive Committee for their sanction to an appointment of the morning lecture hours as will afford to the schools of lang- uages two hours instead of an hour and a half as at present, leav- ing all the other schools the same time, and the same order of suc- cession as at present, & to afford the students time to go to din- ner, that the dinner bell be not rung till five minutes after two o'clock.

The monthly circulars having been filled, the Chairman informed the Faculty that application had been made by some of the stu- dents for the reorganisation of the Military Corps (CB0015).

Dr. Emmet (P43625) made the following motion which was lost.

"Moved that it is inexpedient to reorganise the Military Corps of the students."

"Resolved that as a condition to the reorganisation of the Military Corps the officers & company be required to enter into express engagements not to violate any laws of the Univer- sity whilst embodied, particularly those in regard to dress, ex- penses and firing within the Precincts, and that they be inform- ed that the Company will be suppressed on the occurrence of any such violation, by them of the laws of the Institution."

[EVENT: Student Status:Admission  ] [EVENT: Exception:Granted  ] Mr. David P. Bibb (P21756), who was formerly a student of the University of Alabama (CB0013) and who was dismissed from that Institution, applied for leave to matriculate as a student of this University. The Faculty sent for

[EVENT: Student Misconduct:Physical Assault  ] [EVENT: Student Misconduct:Drinking  ] [EVENT: Student Misconduct:Verbal Assault  ] Peter E. Mathews (P43455) who was a student of the University of Alabama (CB0013) at the time Mr. Bibb (P21756) was dismissed. Mr. Mathews (P43455) said Mr. Bibb (P21756) had always sustained a good character at college before he struck the President; for which offence, he was dismissed. He thinks Mr. Bibb (P21756) was intoxicated on that occasion, and was exceedingly provoked before he struck the President. He thinks Mr. Bibb (P21756) was very sorry for the act afterwards.

The Chairman read letters from Professors Tutwiler (P23853) & Wallace (P44066) of the University of Alabama (CB0013) and from Mr. Peyton Tutwiler (P24148), who was Mr. Bibb's (P21756) instructor after he left the University of Alabama (CB0013) all speaking in terms of praise of Mr. Bibb (P21756) as a student and as a gentleman.

David P. Bibb (P21756) having been sent for, appeared before the Faculty, and said, he was dismissed from the University of Alabama (CB0013) for having struck President Woods (P44067), and for having used improper lang-

uage towards him. He thinks the President behaved very impro- perly by looking into his room, and that he afterwards persecuted him, for he wrote unfavorable letters concerning him to Mr. Linds- ley (P44068), President of the College at Nashville (CB0016) which caused him to be excluded when he applied for leave to join that Seminary. He thinks the President has always had hostile feelings towards him. Dr. Harrison (P25515) offered the following resolution, which was agreed to.

"Mr. Bibb (P21756), dismissed from Alabama University (CB0013) having made application for admission into this Institution, and having produced a letter of recommendation from Mr. Wallace (P44066), professor in that University, containing expressions of approbation of his general conduct & declaring that his offence was not of such a nature as should obstruct his admission elsewhere;" and other re- commendations from most respectable individuals, including another professor, sustaining his good character both before and after his dismission."

"Therefore resolved, that his application be granted." [EVENT: Course Reference:Modern Languages:French  ] [EVENT: Student Status:Dropping a Class Action:granted ] Mr. Fayette Robinson (P25397) applied for permission to leave the French Class in the School of Modern Languages, which was granted.

Monday Oct. 21st, 1833.

The Faculty met in the Library room at 4 ½ o'c. P. M.

[EVENT: Student Misconduct:Physical Assault  ] [EVENT: Student Misconduct:Guns  ] [EVENT: Student Misconduct:Verbal Assault  ] The Chairman said he had received information that Nedham H. Washington (P40016) had been guilty of misbehavior and the grossest inde- cency of language in the hearing of ladies, at the party given by Mr. Carusi (P44060) at Mr. Meredith Jones' (P43896). He was informed that Mr. Wash- ington (P40016) was intoxicated on that occasion and that he attempted to force by Mr. Carusi (P44060) to get ardent spirits. Mr. Washington's (P40016) lang- uage was such as to elicit severe comments from several persons

and amongst the rest a Mr. Buckner (P23590). The next day, when Mr. Washington (P40016) was informed of the character of Mr. Buckner's (P23590) remark, which was, that no gentleman would use such language; he, in com- pany with Mr. Jno. R. Jones (P23566), a student, and several other persons, called upon Mr. Buckner (P23590), at Mr. Ward's (PL8541) tavern, in Charlottesville (PL4204) for an explanation, which was promptly given. After the explana- tion which had been made, Mr. Buckner (P23590) thought from the noise which he heard below of an improper kind, he overheard Messrs. Washington (P40016) & Jones (P23566) speaking disrespectfully of him and saying he had recanted what he had said in the most unqualified manner and that they should cut his acquaintance. Mr. Buckner (P23590) upon hearing this went to the door of the room with a cow hide in his hand and said he now retracted his apology and said, gentleman, come on with your dirks and firearms. Messrs. Buckner (P23590) & Washington (P40016) soon engaged, Mr. Buckner (P23590) striking him severely with the cowhide and Mr. Washington (P40016) attempting to discharge a pistol at him. The next day Mr. Buckner (P23590) challenged Mr. Jno. R. Jones (P23566) as one of the party who had insulted him, but the challenge was declined by Mr. Jones (P23566). The Chairman informed the Faculty that he had heard of Mr. Washington's (P40016) misconduct on other occasions, and mentioned his having broken open the door of a livery stable, in Charlottesville (PL4204).

Mr. Nedham H. Washington (P40016) was sent for and appeared before the

Faculty. He says he was not drunk at Mr. Carusi's (P44060) party, and that he conducted himself with propriety. He admits he struck Mr. Carusi (P44060) when he (Carusi (P44060)) tried to prevent his getting to the re- freshments. He was not conscious of having used indecent lang- uage at the party or when he could possibly be heard by ladies.

The next day he demanded an apology from Mr. Buckner (P23590) "in the most gentlemanly manner". Mr. Buckner (P23590) took him by surprise when he attempted to chastise him. He did not carry a pistol with him, but one was handed him, which he snapped twice at Mr. Buckner (P23590) dur- ing the rencounter. He has never been in the habit of carrying arms. He denies he ever broke open Mr. Stockton's (P35563) stable or struck his driver.

Mr. Ch. S. Gilmer (P44069) being sent for, said he did not hear Mr. Washing - ton (P40016) make use of indecent language at the party. He was up stairs when Mr. Washington (P40016) was at the carriage, near which the indecent language was said to have been uttered. He saw nothing of the affair between Messrs. Washington (P40016) & Carusi (P44060).

Mr. Archibald Cary (P41338) says he knows nothing of the affair except what he has heard from others. He does not think Mr. Washington (P40016) was intoxicated at the party. He did not hear Mr. Washington (P40016) utter indecent language. He was a considerable distance from him at the time.

Mr. Tucker (P43619) offered the following resolution, which was carried.

"It appearing by satisfactory evidence, that Mr. Ned- ham H. Washington (P40016) was at a practising ball given by Mr. Carusi (P44060), repeatedly guilty of rude conduct and that he afterwards made use of highly indecent language in the hearing of ladies, and finally, armed himself with a pistol for the purpose of intimi- dation,

Resolved therefore, that Mr. Nedham H. Washington (P40016) be dismissed from the University."

The Chairman said he understood Mr. Jno. R. Jones (P23566) had been active- ly concerned in the affair of Messrs. Washington (P40016) & Buckner (P23590), so much so, that Mr. Buckner (P23590) had sent him a challenge the next day, which, however, he did not accept. He told Buckner that he had acted in a cowardly manner by striking Mr. Washington (P40016), who was too small to contend with him. He (Mr. Jones (P23566)) was seen, during the time of the quarrel, drawing a sword from a cane and returning it again. Mr. Jones (P23566) has been seen to wear a dirk.

Mr. Jno. R. Jones (P23566) was sent for, and said that he did not call Mr. Buckner (P23590) a coward. The sword cane which he had was a broken one and he had never intended using it. He went with Mr. Washington (P40016) with a view to making up the difference between him & Mr. Buckner (P23590), and told Mr. Washington (P40016), as he was going with him, if the affair

terminated in a duel he would have nothing to do with it. Mr. Tucker (P43619) moved that Mr. Jno. R. Jones (P23566) be reprimanded by the Chairman and his father be written to, which motion was carried.

[EVENT: Boarding  ] The Chairman informed the Faculty that Mr. M. W. D. Jones (P43896), who keeps a boarding house for students, had refused, as yet, to sign the written agreement which other persons similarly situated have signed.

[EVENT: Student Status:Readmission Action:denied ] The Chairman read a petition from a number of students praying the Faculty to reinstate Mr. Nedham H. Washington (P40016), who was dismissed at the last meeting of the Faculty, and pledging themselves to lodge information with the Chairman, against Mr. Washington (P40016), the first time they knew of his violating any of the Enactments.

The Chairman said the evidence which he had heard since the last meeting was still stronger against Mr. Washington (P40016), for he had act- ually accepted a challenge from Mr. Buckner (P23590); and that he had, at Mr. Carusi's (P44060) party, sent for brandy when he found he could obtain none at the party.

Dr. Patterson (P43634) offered the following resolution, which passed.

"Resolved that the Faculty feel it their painful duty to decline acceeding to the petition of the students in behalf of Mr. Needham H. Washington (P40016)."

The Faculty then, on motion, adjourned.

The Faculty met in the Library room at 4 ½ o'clock P. M.

[EVENT: Student Misconduct:Uniform Violation  ] [EVENT: Student Misconduct:Drinking  ] [EVENT: Student Misconduct:Verbal Assault  ] The monthly circulars having been filled, the Chairman stated that Mr. Robert E. Love (P30753) had been before him for several violations of the Enactments, particularly for having been at a tavern and for having violated the uniform law - The offences were not of an agravated character, but Mr. Love's (P30753) conduct was disrespectful to the Chairman whilst he was before him for those offenses, for he demanded the proof for every charge, in rather a disrespectful manner & was guilty of the impropriety of leaving the Chairman's office before he was dismissed and laughed aloud before he left the room.

Robert E. Love (P30753) was sent for and said that it was entirely acci- dental that he laughed in the Chairman's presence, and that he did so, because, he at the moment, saw another student laughing upon the Lawn, and that he did not intend to be disrespectful.

He thought he had some reason to complain of the Chairman for he

thought he (the Chairman) was cold and sarcastic in his manner. Dr. Patterson (P43634) moved that Mr. R. E. Love (P30753) be reprimanded by the Chairman for the impropriety of his conduct & that his guardian be written to, which was agreed to.

[EVENT: Student Misconduct:Uniform Violation  ] Mr. William A. Baynham (P26410) was sent for and said his suit of uniform was an old one which he had sent to the tailor to be repaired. He has been without a uniform coat for eight or ten days, because he had been compelled to return it to the tailor.

Mr. Rufus K. Polk (P27280) was sent for and said he had been out of uni- form once or twice this session, but has never been at a party without it. The Chairman says Mr. Polk (P27280) has been several times reported for violations of the uniform law, and another member of the Faculty said he had seen him riding without any of the uni- form dress on.

Mr. Harrison B. Tomlin (P26410) was sent for and said he had been without the uniform several times. When reminded that he had sent the tailor word "not to be in a hurry about his uniform", he said he did not think, at the time, the servant would have delivered such a message, or that the tailor would have paid any attention to it even if he had. He has twice, in person, called upon the tailor for his coat.

Mr. Benj. F. Minor (P37942) was sent for, and says, he has been out of uni-

form several times, and has no excuse to offer for it.

Mr. David G. Winfree (P43492) was sent for and says he has never been entirely without his uniform. He went out a few evenings since without his uniform coat, having forgotten to change the old dress coat which he then had on. He expects a uniform waistcoat from home in a few days.

Mr. Charles F. Couch (P31895) was sent for, and said, he had never been without the uniform, if the coat which he now has on, can be con- sidered as such.

Mr. Davis (P33195) offered the following resolution which was agreed to.

[EVENT: Student Status:Suspension  ] "Messrs. Rufus K. Polk (P27280) and Benj. F. Minor (P37942) having on sev- eral occasions violated the uniform law for which violations they have offered no satisfactory excuse, therefore resolved that they be suspended from the University for two weeks."

"Mr. Davis (P33195) moved that Wm. A. Baynham (P26410), Harrison B. Tomlin (P26410) and David C. Winfree (P43492) be reprimanded by the Chairman and that their parents and guardians be written to." This motion was carried.

Mr. James W. Greenhow (P32869) was sent for. He admits he has been out of uniform once or twice within the precincts, but has never been out of the University without his uniform. He has paid $1. 50 cents since he has been here for hack hire. He says Mr. N. H. Washington (P40016) has been in his room once, for a short time since his dismissal, but not by his in-

vitation. He had not told Mr. Washington (P40016) that he could not come into his room nor would he ever consent to order any gen- tleman out of it. Mr. Washington (P40016) went to his room to borrow a coat - He has not encouraged Mr. Washington (P40016) to come to the In- stitution, since he was dismissed; indeed, he has tried to dis- suade him from so doing.

"Mr. Davis (P33195) moved that Mr. Jas. W. Greenhow (P32869) be reprimanded by the Chairman, and that his father be written to, informing him of his son's misconduct."

This motion was agreed to.

The Faculty met in the Library room at half past 4 o'c. P. M.

[EVENT: Student Misconduct  ] The Chairman stated that he had during the day seen notices, which had been posted up in several parts of the University, calling upon the students to meet at Hotel C. to enter into resolutions "to resist the late tyrannical movements of the Faculty". (This expression alluded to resistance of the Uniform law.) The Chair- man said that in the afternoon there was another notice, inviting the students to hold an orderly meeting, to take into consider- ation the propriety of resisting a law passed by the Visitors, at their late meeting, requiring the students to retire to their rooms after a signal was given, in case of riot, or other serious disturbance, at night. The Chairman said he had published this law today, for the first time, because, until the present time, the students had been remarkably quiet. The matter was discussed by the Faculty, but no steps were taken, the Faculty wishing to learn, before they acted, what resolutions the students have a- dopted. A petition from the students, praying the Faculty to re- store Mr. Rufus K. Polk (P27280), was read, "and on motion of Dr. Magill (P43655), the sentence of suspension against Mr. Polk (P27280), was removed."

The Chairman said that on Sunday last Mr. Jas. A. Chapman (P31050) had left the University without leave from any of the Professors, and

[EVENT: Student Misconduct:Destruction of Property  ] [EVENT: Exception:Postponed  ] The Chairman said he had received information of a meeting held by the students, in number about 60 or 70, at Hotel C. pursuant to the last notice which was given by the students on yesterday. He has been informed, the object of the meeting was to take into consideration the propriety of resisting the law passed by the Visitors at their last session concerning riots. This law, he said, was promulgated, for the first time, on yesterday. The Proctor has ascertained the names of the following students who were present, last evening, at the meeting, to wit: Messrs. A Committee from the students meeting, consisting of Messrs. T. L. Preston (P43698), J. W. Stevenson (P43600), W. Frazier (P25975), J. O. Yates (P30698) & W. B. Archer (P36919), asked leave to appear before the Faculty, which was granted. The Committee handed the Faculty the following resolution, passed by the students at their meeting, this evening.

"Resolved that a committee be appointed to wait on the Faculty to confer with them on the part of the meeting - and that this committee be instructed to inform the Faculty that neither of the gentlemen summoned to appear before the Faculty this evening - to wit - Mr. Love (P30753), Mr. Winfree (P43492) or Mr. Greenhow (P32869), were engaged in breaking open the door - And that the Committee be further instruct- ed to say, that it is the wish of the meeting that the Faculty should distinctly understand that we do not intend this as a con- session - and that we are resolved to answer no further questions in regard to the meeting - and that we are determined to abide by what we have done, let the consequences be what they may."

The Committee are of opinion that there was no kind of connection between the first and second notice of yesterday, calling a meeting of the students at Hotel C. They are ignorant of the individual who gave the first notice. Those students who composed the meeting consider themselves bound to obey the published laws, only, and con- sider the law of the Visitors, which was published yesterday, an ex post facto one: They said the object of the meeting would be consid- ered as having failed if they did not succeed in getting the signa- tures of 150 students. The Committee say the students would have resisted the same law if it had been enacted by the Faculty as a By- law. The Committee think the students suppose they have a right to meet in Hotel C. whenever they deem it proper to do so, in as much

as this room has been assigned for students meeting generally.

The Committee were instructed to say, the students did not know the Chairman's consent to hold a meeting this evening was asked for, and that the application to the Chairman did not meet their approbation. The Committee then retired. Mr. J. L. Preston (P43498) reappeared, and said he forgot to mention, that he was instructed by the meeting to say distinctly every member of the meeting considered himself bound to abide by any punishment the Faculty may inflict upon any member on account of the meeting.

The Revd. Mr. Hammet (P44070) requested leave to appear before the Faculty, which was granted. He said there was very great excitement among the students, but he thought most of them were desirous to retreat from the position which they had assumed if they could do so with honor. He said the whole meeting would go with the three students it was generally understood the Faculty intended dismissing. Mr. Hammet (P44070) implored the Faculty, if it was consistent with their sense of duty, not to act against Messrs. Greenhow (P32869), Love (P30753) & Winfree (P43492), at least not to do so before the present excitement somewhat subsided.

The students have informed him, that the three students already named, were not as conspicuous members of the meeting as many others.

The Chairman thanked Mr. Hammet (P44070) for the interest he had taken in the welfare of the Institution and assured him the Faculty would act according to what their duty prescribed.

Dr. Magill (P43655) submitted the following resolution, which was carried.

"It appearing from the testimony of the students engaged at a meeting in Hotel C., whereat the door was broken open, that Messrs. Greenhow (P32869), Love (P30753) & Winfree (P43492) had no agency in the act of break- ing open the door, Be it therefore resolved, that the Faculty will take no special action against them."

Mr. Tucker (P43619) then offered the following preamble and resolution which was carried.

The Faculty having received a communication this evening from a deputation of the students, and taken the same into consideration,

Resolved, that while the Faculty regard the language of that communication as highly objectionable, yet conceiving that they should not allow themselves to be diverted by that circumstance from the course which their duty prescribes, & perceiving that the meet- ing of the students have mistaken the motives of the Chairman in dir- ecting the room in Hotel C. to be closed against the students. They do hereby explicitly declare that they do not mean to deny to the students of the University the right of meeting and deliberating in a regular and orderly manner, but they do as explicitly declare that they have no right to meet in any particular room without permission from the authorities of the Institution, and that the breaking ipen of a door for that purpose was a direct violation of the Enactments.

which the students appear to have acted, forbear, at present, to take any order on the communication received this evening, until the students, after having been informed of this explanation, shall have an opportunity of modifying the said communication.

And whereas, a deputation from a meeting of the students communicated to the Faculty resolu- tions couched in highly objectionable language with regard to the said meeting - but which communication removed the special impu- tation from the students above named & had in view to support a right not denied to the students. And whereas, in a second com- munication from the same deputation the right of the students to commit such violence was disavowed, but a determination asserted to support the party who broke open the door on the occasion al- luded to,

Be it therefore resolved, that in forcing open the door alluded to, an offence was committed which would have rendered the individual, if known, liable to dismissal; that such students not being known, it becomes the duty of the Faculty to direct the Chairman to censure all who were present on the occasion whereon

the violence was committed, and to give notice of the same to the parents and guardians of the students aforesaid.

Then, on motion, the Faculty adjourned.

Thursday, Novbr. 21st, 1833.

The Faculty met in the library at 5 o'clock P. M.

[EVENT: Student Status:Admission Action:denied ] [EVENT: Student Misconduct:Physical Assault  ] The Chairman said Mr. Campbell (P33999), who was formerly a student of Columbia College, S. Ca. (CB0017) had applied for leave to matriculate as a student of this Institution, but he had not permitted him to do so - Mr. Campbell (P33999) was second in a duel which was fought last May and which resulted in the death of one of the parties. Mr. Camp- bell (P33999) says he was a member of the college when the duel took place

but that the principals had taken a dismissal; and he moreover says, he can produce satisfactory evidence of a good character at that institution previous to last May, and from the College at Emmetsburg (CB0018) where he was formerly a student.

Mr. Campbell (P33999) was sent for, and says, he had not gotten a dismissal from College when the duel took place, but says Dr. Cooper (P44071) has since written a letter, in which, he speaks of the duel, favorable to his character as a student. He says the Trustees of that In- stitution, alone, expell students, and his father thinks they will act against him at their next meeting, for duelling is contrary to the laws of the College.

Dr. Johnson (P43633) made the following motion which was agreed to.

"Moved that the Laws of the University do not permit the Faculty to allow Mr. Campbell (P33999) to matriculate as a student."

[EVENT: Boarding  ] The Chairman said there had been some complaint about the bedding furnished the students by the Hotel Keepers. The Chairman promised to have the subject investigated.

[EVENT: Curriculum  ] Mr. Tucker (P43619) as Chairman of the Committee appointed to prepare an uniform system of graduation and examination in the several schools of the University, made the following report, which was adopted by the Faculty.

"The Committee appointed by the Faculty to prepare an uniform system of graduation and examinations in the several schools

of the University, have given to the subject their deliberate consideration, and thereupon report the following regulations:

1. The Committees for graduation shall be appointed by the Chair- man of the Faculty, and each committee shall consist of the pro- fessor of the school & two other professors.

2. The preparatory English examination of the candidates for grad- uation, by a committee of three professors, to be appointed by the Chairman, shall be held on the first week in December, on such day as shall be determined on by the Committee.

3. Students intending to present themselves for graduation in any of the schools shall make known such intention to the professor of the school before the time appointed for the English examination, and any student failing to make this communication shall not be received as a candidate without the express permission of the Fa- culty; and in such case, it shall be optional with the committee appointed for the school in which such student offers to serve on his examination or not.

4. There shall be but one set of graduates in each school, except for good reasons, to be judged of by the Faculty, on special appli- cation.

5. The time, number, length and mode of examinations for graduation, & at the public examinations in the several schools shall be determined by the respective committees prior to such examination, subject however, to subsequent alteration by a

majority of the committee. And the time of meeting for the exam- ination of candidates for graduation shall be appointed either by personal conference of the committee or on failure thereof, by an invitation in writing from the Chairman of the committee on the day before the examination. In appointing the hour, the committee should avoid, as far as practicable, interfering with the hours as- signed to such classes as any of the candidates may attend.

6. Students who have regularly declared themselves candidates for graduation in any school, may be excused from the intermediate or final examination in such school by the examining committee- And in case they stand such examination, and shall thereafter be de- clared graduates, their standing at the examination shall not be published at the end of the session.

7. No person shall be admitted into the examination room, at any examination, unless with the special assent of the examining com- mittee.

8. In determining the standing of the students at the intermediate and final examinations, there shall be four degrees of merit to be thus determined; if the numerical value of the answers furnished by any student shall amount to three fourths of the whole value attached to the questions, by the Committee of Examination, the student shall be in the first division; if to less than three fourths, but as much as one half, he shall be in the second division;

if to less than one half, but as much as one fourth, he shall be in the third division; and if to less than one fourth, he shall be in the fourth division; and any student who may hand in a paper, on which, he has not attempted the solution of any question, or who may be found to have copied any part of his answers, shall be placed in the fourth division.

[EVENT: Curriculum:Literature  ] The Committee further recommend that the Faculty give public notice to the students that the English Examinations will be more strict than they have heretofore been.

The Faculty then adjourned.

as having been intoxicated at a party at Hotel D. on Friday even- ing last; and moreover, he had been guilty of using indecorous language within the hearing of ladies on that occasion.

Mr. Thomas M. Mathews (P39425) was sent for, and admits he was intoxicated on Friday evening last, but says he does not remember having used any improper expressions and was told by a number of the students that he did not. He says he was not at Keller's Confectionary Friday evening, and thinks he did not drink more than six glasses of wine - He never was drunk whilst he was a student of the Uni- versity of Alabama (CB0013).

Dr. Patterson (P43634) submitted the following motion.

"Mr. T. M. Mathews (P39425) having been intoxicated at a Ball and having used improper language on that occasion, Moved that he be suspended for one week, and that his parent be informed of the circumstances of his offence."

Mr. Bonnycastle (P43623) moved to insert in lieu of the words one week, two weeks, which was carried by the casting vote of the Chairman. The vote upon the amendment stood thus,

After the monthly circulars were filled, the Chairman omission, a petition of the students praying the Faculty to reinstate Mr. T. M. Mathews (P39425) who was suspended for two weeks on the 26th of Novbr. The petition was rejected.

[EVENT: Student Misconduct:Noise Disturbance  ] The Chairman said the Proctor had reported Messrs. Alex. T. Baylor (P39513), & D. H. Tucker (P43591) for having sung a corn song on Sunday evening last. Mr. Alex T. Baylor (P39513) was sent for, and says, the song was not of an indecent character, and that they ceased singing so soon as they were within the precincts. He says neither Mr. D. H. Tucker (P43591) or himself tried to avoid the Proctor, for they were not conscious that they had violated the laws - He does not remember ever having sung with- in the precincts before - They were returning from church and com- menced singing just below the house occupied by Mr. Wertenbaker (P43631).

Mr. David H. Tucker (P43591) was sent for and makes, in substance, the same statement as the preceding.

Mr. Davis (P33195) proposed the following resolution which was carried.

"Mr. A. T. Baylor (P39513) & Mr. D. H. Tucker (P43591) having been guilty of disorderly conduct, by singing a corn song within & without the precincts, on Sunday evening last, resolved that they be reprimand- ed by the Chairman and the guardian of the former & the father of the latter be written to on the subject."

[EVENT: Student Misconduct:Uniform Violation  ] The Chairman said Mr. Ch. J. Hanson (P29091) had been out of uniform without having informed him that his (Mr. Hanson's (P29091)) pantaloons were at the tailor's.

Mr. Ch. J. Hanson (P29091) was sent for and says he was not aware when he sent his pantaloons to the tailor, that it was his duty to inform the Chairman of that fact.

"Dr. Johnson (P43633) moved that Mr. C. J. Hanson (P29091) be reprimanded by the Chair- man for having been out of uniform," which was agreed to.

[EVENT: Course Reference:Law  ] [EVENT: Student Status:Dropping a Class Action:granted ] Mr. Benj. F. Minor (P37942) applied for leave to quit the school of Law, which was granted.

[EVENT: Boarding  ] The Chairman said he had visited a number of the dormitories and found about six beds which required attention to make them comfort- able. About one half of the dormitories have been washed since the last meeting of the Faculty.

[EVENT: Student Misconduct:Academic Lassitude  ] [EVENT: Course Reference:Ancient Languages  ] Mr. Francis G. Ruffin (P32687) was reported as having been frequently absent

[EVENT: Student Misconduct:Academic Lassitude  ] Mr. John A. Meredith (P43578) was reported as having been frequently absent from lectures during the last month. The Chairman was instructed to inform the guardian of Mr. Meredith (P43578) of his in attention.

Mr. George P. Holeman (P40216), who is over twenty three years of age, applied for leave to dispense with the uniform, which was granted.

party of Keller's Confectionary a few evenings since, which in- duced him to set up later than usual, to see if he could ascertain any of the students concerned in it. About 1 o'clock a party of students came into the University singing an indecent corn song - He saw some one open Mr. Ruffus K. Mills' (P29780) door and go in; he im- mediately followed the person into the room and asked Mr. R. K. Mills (P29780) if he was not one of the party - He (Mr. Mills (P29780)) confessed it.

Rufus K. Mills (P29780) was sent for, and said he had nothing more to say relative to the matter than he had stated to the Chairman.

Dr. Patterson (P43634) offered the following resolution which was agreed to.

"Mr. Rufus K. Mills (P29780) having been engaged in a festive party at Keller's Confectionary, and having joined, in returning thence to the University, in a noisy and indecent corn song, therefore,

Resolved that he be suspended for one month, and that his guardian be informed of the circumstances of his offence."

[EVENT: Student Misconduct:Uniform Violation  ] [EVENT: Student Status:Suspension  ] The Chairman informed the Faculty that Mr. Thomas P. Lewis (P33049) was a few evenings since at party without the uniform dress.

Mr. Thomas P. Lewis (P33049) was sent for and said he had no excuse, except his uniform was not fit to wear at a party.

Dr. Patterson (P43634) offered the following resolution, which was carried.

"Mr. Thomas P. Lewis (P33049) having been out of uniform, as to his coat and pantaloons, at a party, Resolved that he be suspended

[EVENT: Student Status:Admission Action:granted ] [EVENT: Student Misconduct:Drinking  ] Mr. John J. Scott (P31347) applied for leave to matriculate as a student of this Institution. He says he has been recently dismissed from the University of Alabama (CB0013). He says the charge against him was, having been intoxicated once and having sworn twice; but he asserts that he was made drunk by cider which had been mixed with spirits with-

out his knowledge. The President of the University of Alabama (CB0013) has written a letter to his father stating his (the President's) willingness to receive him again into that institution. Mr. Scott (P31347) was allowed to matriculate.

[EVENT: Boarding Action:granted ] Mr. Ramsay McHenry (P24666), who is nearly twenty years of age, was permit- ted to board out of the University.

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Suspension  ] The Chairman said he had seen Mr. Peter E. Mathews (P43455) in a state of intoxication on the evening of Sunday last at Keller's Confection- ary.

Mr. Peter E. Mathews (P43455) having been sent for, said, he had no defence to make. Being asked where he got drunk at, he replied, at the ice- pond. He did not carry the brandy, of which he drank, to the pond, nor does he know who did. He says it is the first time he has been drunk since he entered the University and it is the second time he has been to Keller's Confectionary. He did not drink with the in- tention of becoming intoxicated, and was very much surprised when he found himself so, which was not until after he went to the fire.

The brandy was mixed with honey.

Dr. Patterson (P43634) moved that Mr. Mathews (P43455) be suspended for two weeks.

Mr. Tucker (P43619) offered the following resolution as an amendment to Dr. Patterson's (P43634) motion, which was carried.

"It appearing that Peter E. Mathews (P43455) was intoxicated on Sunday the 5th inst. and was at the same time guilty of profane

swearing, and also of visiting Keller's Confectionary, Resolved that under the circumstances of the case he be suspended for four weeks."

The vote upon the above resolution stood thus:

The Chairman then informed the Faculty that Messrs. James G. Car- son (P34533) and Erasmus A. Powe (P38872) were seen yesterday evening at Keller's confectionary, by a professor. On Motion, they were sent for.

Mr. Erasmus A. Powe (P38872) says he only drank a single glass of wine at Keller's, and that he never drinks ardent spirits. He has never been to Keller's before since he matriculated as a student. His object in going into the Confectionary yesterday, was to buy ci- gars. He drank the wine by the invitation of another student. Mr. Davis (P33195) offered the following resolution which was agreed to.

"Mr. Erasmus A. Powe (P38872) having gone to Keller's Confection- ary yesterday evening, and whilst there having drunk a glass of wine, but he affirming that if he has been at Keller's before since his matriculation, he did not drink there; therefore resol-

ved, that he be suspended for ten days."

He confessed yesterday was not the first time he has been at Keller's Confectionary this session. He did not invite Mr. Powe (P38872) to drink with him. He supposes they were not there more than ten or fifteen minutes.

Mr. Davis (P33195) offered the following resolution, which was agreed to.

"Mr. James G. Carson (P34533) having gone to Keller's Confectionary yesterday evening, and whilst there having drunk a glass of brandy or whisky; and he having admitted that he has been at Keller's be - for; therefore resolved that he be suspended for a fortnight."

Friday, Jan. 10th, 1834.

The Faculty met in the Library - room at ½ past 4 o'cl. P. M.

[EVENT: Student Misconduct:Noise Disturbance  ] [EVENT: Student Misconduct:Drinking  ] The Chairman said, that on the night of the 7th inst. Dr. Johnson (P43633) called upon him about ½ past 9 o'clock and informed him, that he (Dr. Johnson (P43633)) whilst he was at the Anatomical Hall, a few minutes before, heard a noise on the W. Range, as if some one was intoxi- cated and was endeavouring to force open a door. He immediately went to the W. Range, and saw a student who appeared to be intoxi- cated at Mr. Venable's (P36372) room. He laid hold of the student and de- manded his name, which he refused to give up, and immediately left the room. The Chairman asked Mr. Venable (P36372) to request the student he had just seen to call at his office the next morning and give up his name, for, by so doing, the punishment would probably be slight. He at the same time told Mr. Venable (P36372) to inform the student that he had seen his face could easily recognise it. After the Chairman returned to his office, and remained some time, he determined to go to Mr. Hill's (P24285) room, accompanied by Dr. Johnson (P43633), and see if he was

not the individual seen in Mr. Venable's (P36372) room. As he passed by Mr. Venable's (P36372) room, he saw several students in it, & among them, the person who had before escaped him. On seeing the Chairman, he immediately ran out of the room accompanied by several other stu- dents. The next day, the Chairman had a number of students before him, and when Mr. Robert E. Dejarnette (P34188) appeared, he accused him directly as the person he had seen the evening before, in Mr. Venable's (P36372) room, and he did not deny it, but said the Chairman must prove it.

Mr. Robert E. Dejarnette (P34188) having been sent for, said he can prove that he was not drunk on the night of the 7th inst. but admits he was the person laid hold of by the Chairman. He did not choose to give up his name after the Chairman laid hold of him. He did not know that the Chairman was in the room until he felt him holding to his coat collar. He drank of spirits and water that evening, in a dormitory, but he did not take enough to intoxicate him. The noise was made by scuffling with one of the students. He was aware, the next day, he had refused to give up his name when demanded by the Chairman, but he did not know, at that time, it was contrary to the laws to refuse his name to an officer of the Institution. He says he has never read the Enactments or the Caption of the Matriculation Book. He admits he bought a costly black coat this session, but he was not aware he was out of uniform on the night of the 7th inst.

Mr. Jno. M. Forbes (P43516) was sent for, and says, Mr. Dejarnette () was in

his room at 11 o'clock P. M. on the 7th and was not then intoxi- cated though he might have been somewhat excited by liquour. He did not see Mr. Dejarnette (P34188) on the Western Range. Mr. Dejarnette (P34188) told him, he did not give up his name, when demanded, because the Chairman asked the question in an improper manner. The Chairman remarked to Mr. Dejarnette (P34188), when before the Faculty, that on the night of the 7th he was particularly guarded not to say any thing which could be deemed offensive. The following resolution was pass- ed." It appearing to the satisfaction of the Faculty that Mr. R. E. Dejarnette (P34188) was, on the night of the 7th inst. intoxicated; and that he made a disturbing noise, and was guilty of contumacy in refusing to give up his name when demanded by the Chairman; and Mr. Dejarnette's (P34188) habits having been otherwise irregular, therefore Resolved, that he be dismissed from the University."

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Misconduct:Noise Disturbance  ] [EVENT: Student Status:Suspension  ] The Chairman stated that whilst he was at a party at the house of one of the professor's, he received information from Dr. Harrison (P25515), that there was a disturbing noise going on upon the Lawn, and it was supposed to be made by a party of drunken students. When he went out, there was no noise upon the Lawn, but he inferred from Dr. Harrison's (P25515) having heard the drunken party go down one of the alleys, that the intoxicated person had been carried to Keller's Confectionary, He went to the Confectionary, accompanied by Dr. Harrison (P25515), but was unable to identify the students who were there owing to his entrance being obstructed by a young man who waits at the Confectionary having locked the door. The Proctor, he says, informed him, that on the same night, he heard a considerable noise in the dormitory oc- cupied by Messrs. Cabaniss (P35218) & Bibb (P21756). He sent for them the next day, and was satisfied both by the assertions and manner of Mr. Caba- niss (P35218), that he had had no connection with the party who made the noise in his room the evening before; but when he sent for Mr.

Bibb (P21756), he became satisfied that he was an active member of the party, and probably the person who was carried, the evening before, off of the Lawn towards Keller's. Mr. Bibb (P21756) was sent for.

Mr. David P. Bibb (P21756) says Mr. Cabaniss (P35218) was in the room on the evening of the 15th inst., but refuses to say whether he remained during the whole time. He says he was not the student taken off the Lawn, but refuses to say whether he was at Keller's that evening. He re- fuses to answer any further questions.

Dr. Magill (P43655) offered the following resolution which was adopted.

"It appearing from evidence satisfactory to the Faculty that David P. Bibb (P21756) on the evening of the 15th was one of a party who had been drinking & one of whom was intoxicated, and Mr. Bibb (P21756) having failed to clear himself from this accusation, therefore resolved that Mr. Bibb (P21756) be suspended for a month."

[EVENT: Boarding  ] [EVENT: Exception:Denied  ] The Chairman stated that Mr. Jno. R. Jones (P23566) who had some time since obtained permission to visit his father, had returned and wished to remain the precincts, without being considered a student, until he could arrange his affairs and return home. The Faculty decided that he must be considered a student until he was regularly discharged from the University.

[EVENT: Course Reference:Ancient Languages  ] [EVENT: Exception:Granted  ] Mr. Washington Van Hamm (P43580) applied for a temporary suspension of attend- ance on the lectures of the School of Antient Languages, which was granted.

The Faculty met in the Library room at 3 o'clock P. M.

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Dismissal  ] .The Chairman said he had many reasons for believing that Mr. Jno. R. Jones (P23566), since his return to the University, has been in the daily

habit of violating the enactments, especially, as it regards temperance. He was informed by the Proctor, yesterday, that he saw Mr. Jones (P23566) in a state of intoxication whilst he was on his way to dinner. Soon after he arrived at home, Mrs. Gray (P43865) sent for him to go to her Hotel as speedily as he could. When he (the Proctor) went into the dining room he found Mr. Jones (P23566) sitting at the table very much intoxicated and making a good deal of noise. The Chair- man says he has since learned that Mr. Jones (P23566) used insulting lang- uage on that occasion, to the Proctor and to Mrs. Gray (P43865). The Proc- tor immediately reported the case to the Chairman & thought Mr. Jones (P23566) ought to quit the University immediately, which induced the Chairman to send for him, to appear at his office the same evening at 5 o'clock. Mr. Jones (P23566) went to the Chairman's office at the ap- pointed hour and rapped very loudly at the door. When he entered, the Chairman requested him to take a seat, and told him, he (the Chairman) was very sorry to learn that he had violated the pledge which he had made since his return, and added, that he had been informed, he (Mr. Jones (P23566)) had been intoxicated almost every day since his return, and that he had been reported for being drunk and misbehaving at Mrs. Gray's (PL8542) Hotel, at dinner. Mr. Jones (P23566) replied in a very loud voice, which the Chairman thinks was intended for students listening at his office door, "it's a lie". The Chairman asked Mr. Jones (P23566) if he intended to say he had lied, or did he only

mean that the report was false. Although this question was repeated by the Chairman, Mr. Jones (P23566) remained silent until after the Chair- man had several times ordered him to leave his office, when he said in a low tone of voice, "I did not say you lied". The Chairman told him, "Well, then, we will proceed to business again". When the Chairman mentioned the report of the Proctor again, Mr. Jones (P23566) again repeated that it was a lie; in the same loud tone he had used at first. The Chairman now ordered him peremptorily to leave his office, which he refused to do. The Chairman still insisted that Mr. Jones (P23566) should quit his office, which he obstinately refused to do. Mr. Jones (P23566) then said the Chairman "need not look black at him", and shaking his fist, he repeated several times, "if you dare assert - if you dare assert" - The Chairman here stated that after he lost possession of himself, he tried every means which the confusion of the moment suggested to make Mr. Jones (P23566) leave his office, but with- out effect; he then drew a pocket pistol from a table drawer, and said, "Mr. Jones (P23566), if you do not leave this room immediately, I will shoot you." Mr. Jones (P23566) immediately retired. The Chairman farther states, that when he told Mr. Jones (P23566), in the course of conversation, that he (Mr. Jones (P23566)) must, of course, expect to be dismissed, and that his father would be written to informing him of his (Mr. Jones' (P23566)) conduct; he replied, he did not care a damn what the Faculty did.

The Chairman says he has since been informed that Mr. Jones (P23566) was

probably drunk when he went to his office; but if he was so, the Chairman says he could not perceive it. The Chairman expressed to the Faculty great regret that he had drawn a pistol upon a stu- dent, but still thinks it was probably the only course, under the circumstances, left him to pursue.

[EVENT: Boarding  ] Mr. John R. Jones (P23566) was sent for and says he was intoxicated when he went to the Chairman's office, but also says, he does not recognise the authority of the Faculty, for he has settled with the Proctor, and withdrawn from the University. He produced a letter from his father to one of the professors, desiring him to aid his son in settling his affairs and return home; but the letter showed clearly that his father considered Mr. Jones (P23566) a student. He says he has attended no lectures since his return to the University, which has been about six or seven days. He has remained longer than he, at first, intended doing, in consequence of having received some in- telligence concerning a watch, which he lost some time since. He promised, he says, when he returned, to obey the laws as well as he could. Being asked why he remained at the University, if he no longer considered himself a student, he replied, because he saved himself, by so doing, a bill in town. He says he did not go to the Chairman's office to insult him.

The Chairman now withdrew, and Mr. Tucker (P43619) was appointed Chairman pro tempore.

Dr. Patterson (P43634) proposed the following resolution, which was adopted.

"Mr. Jno. Richd. Jones (P23566) having been yesterday guilty of intoxication, and having while in this state behaved with great im- propriety at Mrs. Gray's (PL8542) Hotel, and having subsequently, when sum- moned before the Chairman, used insulting language, and been guilty of outrageous conduct, therefore resolved that he be expelled from the University."

Dr. Blaettermann (P43621) proposed as an amendment to the above resolution, that the word dismissed should be substituted for the "word Expelled".

This motion was lost.

Mr. J. Melville Gillis (P31080) applied to be excused from the intermediate examinations, having been prevented from preparing himself by sore eyes.

[EVENT: Course Reference:Moral Philosophy  ] [EVENT: Course Reference:Political Economy  ] Mr. Ch. M. Irvin (P31900) was permitted to leave the School of Moral Philoso- phy with the understanding that he is to study Pol. Economy.

Monday, Jan. 27th, 1834.

The Faculty met in the Chairman's office, at 6 o'clock P. M.

[EVENT: Student Misconduct:Physical Assault  ] [EVENT: Student Status:Suspension  ] The Chairman informed the Faculty that a complaint had been lodged by Mr. Rose (P43866) against Wm. P. Braxton (P41509) and John M. Forbes (P43516), Mr. Rose (P43866), he said, had stated, that yesterday morning Messrs. Forbes (P43516), Braxton (P41509) & Tomlin (P31563) had sent for their breakfast to be carried to their re- spective rooms, and that he had refused to do so; but subsequently, being told that Mr. Tomlin (P31563) was indisposed, he sent his breakfast to hi. Mr. Rose (P43866) said one of his servants had been kicked by Mr. Forbes (P43516), yesterday morning, when he went to make his bed up. After breakfast, whilst he was standing before the door of his Hotel, Messrs. Forbes (P43516) & Braxton (P41509) came to him and complained of the inatten- tion of his servants, to which, he replied, "he would see about it". Mr. Forbes (P43516) told him if his servants, did not do their duty better, he would report him and whip his damned servants. They then went on, and Mr. Rose (P43866) saw them go into Keller's Confectionary. Messrs. Jno. M. Forbes (P43516) & Wm. P. Braxton (P41509) were sent for. Mr. Forbes (P43516) admits that he kicked Mr. Rose's (P43866) servant. Being asked if he hurt him, he said, he did not know, but he tried to do so, for he kicked him as

hard as he could. They both say they went to Keller's to get their breakfast, but refuse to say whether they have been there before, dur- ing the present session. They complain of great negligence on the part of Mr. Rose's (P43866) dormitory-servants, and assert that their rooms are never cleaned by 8 o'c. A. M.

Mr. Davis (P33195) proposed the following resolution.

"Mr. Wm. P. Braxton (P41509) and Mr. Jno. M. Forbes (P43516) having in vio- lation of the laws of the University gone to Keller's yesterday morning, and there, taken their breakfast, because the Hotel - Keeper would not send their breakfasts to their rooms, therefore resolved that they be suspended for a fortnight."

"Dr. Magill (P43655) amended this resolution by proposing that the Chairman reprimand Messrs. Forbes (P43516) & Braxton (P41509) and write to their parents that they would have been suspended if it were not for the circumstance that they would, during their suspension, miss the intermediate examinations in several of the classes which they attend.

This amendment was carried.

The Faculty then adjourned.

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Suspension  ] The Chairman said Mr. Charles F. Couch (P31895) had entered the Institution with the reputation of a bad student; but he had, he thought, re- strained him considerably by sending for him and telling him frank- ly that his character, as a student, was a suspicious one and he should try to get rid of him as soon as possible. He had been in- formed lately, that Mr. Couch (P31895) kept ardent spirits in his room for himself and other students. His information, however, was gotten in such a way that he did not feel authorised to give up his in- formant; though the testimony was of a very positive kind; but he did not know whether his informant was hostile to Mr. Couch (P31895), or if he was, whether he would take such a method to revenge himself.

Mr. Charles F. Couch (P31895) was sent for, and says, he has never kept ar- dent spirits in his room for the students to drink, previous to the

day the Chairman had had him before him (the Chrmn.). He admits he has had ardent spirits in his room, and that he has been to Keller's Confectionary, but refuses to answer any other questions. Mr. Davis (P33195) offered the following resolution, which was carried.

"Mr. Ch. F. Couch (P31895) having admitted that he has been in the habit of keeping ardent spirits in his room and of going to Keller's Confectionary, both of which are prohibited by the laws of the in- stitution, and he having been an irregular student in other respects - therefore resolved, that he be suspended from the University for the rest of the session."

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Suspension  ] The Chairman said Mr. John J. Scott (P31347) had been reported to him as a frequenter of the tavern in Charlottesville (PL4204) as dissipated and pro- fane.

Mr. Jno. J. Scott (P31347) says he has not been to the taverns often, though he has been to them several times. He recollects having taken a glass of wine at Vowles' tavern on one occasion and thinks it poss- ible he may have done the same thing at Ward's (PL8541) tavern. He has nev- er been to Keller's. He has been to town but once lately & that was to Church. He has not been in the habit of swearing much, and most positively denies that he has ever cursed any member of the Faculty.

Dr. Johnson (P43633) moved that Mr. J. J. Scott (P31347) be admonished by the Chair- man and that his guardian be written to."

Dr. Magill (P43655) moved that, as an amendment, to the above motion, to suspend Mr. Scott (P31347) for two weeks, which amendment prevailed.

The vote upon the amendment stood thus;

[EVENT: University Administration:Personnel Decision  ] The Faculty then were informed by the Chairman, that the Hotel - Keepers had been reported for habitually violating various duties, particularly in respect to the cleanliness of dormitories. The Fa- culty then adjourned to meet again at 4 o'clock P. M. Monday, at which time they are to take up the above subject.

Mr. Davis (P33195) offered the following resolution, which was carried.

"The Faculty having reason to believe that the Hotel Keepers have, during the session, habitually violated various duties, par- ticularly in respect to cleanliness of dormitories, and the sub- ject having been brought before the Faculty by the Chairman on Monday last, whereupon it was understood by the Faculty that they would at this meeting proceed to investigate the conduct of the Ho- tel Keepers, and whereas, the Hotel Keepers hearing of what was in- tended by the Faculty, have by subsequent attention, endeavored to prevent enquiry, therefore, resolved, that the Faculty will never-

theless proceed with the investigation and apply the proper remedy.

Monday, Feb. 3rd, 1834.

The Faculty met at 4 o'clock P, M.

[EVENT: University Administration:Personnel Decision  ] [EVENT: Boarding  ] The Faculty determined to send for a number of students from each of the Hotels and take their evidence relative to the fare, servants attendance etc. etc. Messrs. J. B. Young (P38846) & F. E. Robertson (P28234), T. Leigh (P43509), J. B. Lightfoot (P35715), & T. P. Huger (P33926), boarders at Mr. Conway's (P43888) Hotel, were accordingly sent for. Mr. J. B. Young (P38846) says he has heard but little complaint about the diet at Mr. Conway's (P43888) Hotel, though he thinks there is great "sameness" in the dinner, and has never seen more than two kinds of vegetables at the same meal, they generally being potatoes & rice, however, cabbages have been fur- nished every day, lately. The butter has been very good until late-

ly. He has known breakfast and supper to give out before the students had enough, but has never known such circumstance to happen at dinner. There is sufficient servants attendance at meals. The bread is very good, but the tea & coffee are indif- ferent, both being very weak & not well made. The bedlinen is not changed every fortnight, & his counterpane, which is a light one, has been washed but twice this session. His room has been washed once this session, and Mr. Conway (P43888) offered to have it washed again a short time since, but the weather being very cold he objected. His room is cleaned in the morning about half past 9 o'clock. His bed & bedclothing are very good. He says Mr. Conway (P43888) never inspects his room to ascertain if any thing is wanted. Mr. T. Leigh (P43509) says there is always enough at Mr. Conway's (P43888) table and as well prepared as he has generally seen in hotels. He has turkeys once a week & three or four each time, but the beef is always tough. The bread is good & the butter plentiful & tolerably good. A tablecloth is always upon the table at dinner. but none is used at breakfast & supper. The tea & coffee is weak. The servants attendance at ta- ble is abundant. The bed - linen is changed once in three weeks and not oftennner. The towels are washed twice a week. His coun- terpane has been washed twice this session, & his bedding is very good. His basin is kept clean. His room is cleaned out in the morning by breakfast time. Mr. Conway (P43888) never visits his room for

for the purpose of inspection. He never pays anything for clean- ing his shoes except what he thinks proper to give the servant.

He is one of the twenty two of Mr. Conway's (P43888) students who hire John (P43933) until May. They are to pay him forty five dollars for his services.

The 22 students who hire John, he says, do so. because, they had not before sufficient attendance. He does not consider Mr. Conway (P43888) as having anything to do with John (P43933), inasmuch as he is in the employ- ment of the 22 students, exclusively. Mr. Conway (P43888) said in his pre- sence, when the students first contracted for John (P43933), that it was con- trary to the enactments for the students to hire servants; but if they hired John (P43933), he (Mr. Conway (P43888)) would feed him. Messrs. Robert- son (P28234), Huger (P33926) & Lightfoot (P35715) say they have no complaints to make relative to bedding, diet or servants attendance at meals. The tea & coffee are tolerably good and the bread & butter is always good. There is sufficient variety at meals. Their bedlinen has been changed about once in two weeks, and their counterpanes have always been in good order. Their dormitories were washed once before Christmas, and Mr. Conway (P43888) had offered to have it done again not long sice, but they objected on account of the inclemency of the weather. The Hotel Keeper has never visited their rooms for the purpose of inspection. Mr. Robertson (P28234) says he is one of the 22 students who hire John (P43933). He considers John (P43933) under Mr. Conway's (P43888) controul, but he does not know whether Mr. Conway (P43888) pays him anything for his services. He says the

the blacking, for the use of the students, is furnished by the servants, who are paid a dollar for it, by the student at the ter- mination of the session.

Messrs. Cooke (P40184), Triplett (P41044), Irwin (P31900), Ch. H. Randolph (P43581), & Venable (P36372), board- ers at Mrs. Gray's (PL8542) Hotel were sent for and appeared before the Faculty. Mr. C. H. Randolph (P43581) says the diet at Mrs. Gray's (PL8542) is very good, and there is variety enough at dinner. The knives and forks are not well cleaned. The bread & meats are generally good & nev- er give out before the students have finished their meals, but the tea & coffee are too weak. The butter is good. The bedlinen is changed once a fortnight and his counterpane has always been in good order. He does not have his washing done at the Hotel, because he understood, when he first entered the University, it was not done well at the Hotel & that clothes were frequently lost. His dormitory was washed out last autumn. His room is generally cleaned out by nine o'clock in the morning. His fire is made at the proper time in the morning & water, to wash with, is furnished at the same time. His basin is kept clean. He furnished his own bedding. He says Mrs. Gray's (P43865) servant, William (P43934), is the most impertinent boy he ever saw. Mr. Irwin (P31900) says he has no objection to Mrs. Gray's (PL8542) hotel, & also, that the diet is good, abundant, & he supposes more variety than students ought to have. The bedding is not very good but he is willing to put up with it. The bedlinen is washed regularly

once a fortnight. His fire is made & water brought about 6 o'clock in the morning. He thinks the tea & coffee rather too weak at the Hotel. He says the servant, William (P43934), does not do very well though he has never been impertinent to him. His dormitory has been wash- ed once this session. His dormitory is generally cleaned in the morning about 9 o'clock. He says his clothes have been tolerably well washed, but he has lost several peices which were marked. Mr. Cooke (P40184) says the victuals are well done & that there are always at least two kinds of vegetables on the table. The tea & coffee are weak, but the butter & bread are very good. He says the boy Wil- liam (P43934) is very impertinent & does not attend well at his room, & sometimes does not make the fire until he is up, & today, not until after his return from lecture. His room is generally cleaned by 10 or 11 o'clock. He gets towels about once a week, which are carried out and washed one day and returned the next. He thinks Mr. Smith (P43951) has been once to inspect his room as Mrs. Gray's (P43865) agent. His room was scoured soon after he came here & about three weeks since, again. He has lost 4 shirts, & several pair of socks, all of which were marked. He sent Mrs. Gray (P43865) several messages about them, but received no satisfactory answers. Mr. Venable (P36372) gave the same evidence as Mr. Cooke (P40184), in substance except, he has lost no articles of clothing. Mr. Triplett (P41044) says the diet at Mrs. Gray's (P43865) is pretty good. There are generally two kinds of vegetables at

dinner, besides cabbages, every day. The coffee is very indifferent, but the tea is good. He thinks the plates, knives, forks etc. are not as clean as they ought to be. The servants attendance at dinner is not sufficient. The bedlinen is changed once a fortnight & the towels once a week. His counterpane, which is a dark one, has been washed once this sesion, & his room has also been washed once this session. His room is cleaned from 9 to 10 o'clock in the morning. This morning is the first time his fire was not made & water brought him to wash with, in time. He says Mr. Smith (P43951) has never visited his room as Mrs. Gray's (P43865) agent. He has lost some articles of clothing this session but they were not marked. The washing, he says, is not welldone at Mrs. Gray's (PL8542). The servant William (P43934), is the most im- pertinent one he has ever seen.

[EVENT: Student Status:Suspension  ] [EVENT: Exception:Granted  ] The Chairman presented a petition from Mr. C. F. Couch (P31895), who was

suspended the 1st, inst. for the remainder of the session, pray- ing the Faculty diminish the term of his suspension to two weeks or a month.

On motion of Dr. Magill (P43655), Mr. C. F. Couch (P31895) was allowed to return to the University at the expiration of one month from the time he was suspended, on account of the extenuating circumstances set forth in his petition.

[EVENT: University Administration:Personnel Decision  ] [EVENT: Boarding  ] The Chairman read a communication from Mrs. Gray (P43865) relative to the charges which had been made against her Hotel. The following is the substance of her answers. She says the washing is at all times well done, and that no articles of clothing have been lost which were marked. The student's clothes are regularly distri- buted in bundles, except those which are not marked, they being put into a separated basket that the students to whom they belong may get them when carried around by the servant. She will try to have the rooms, in future, cleaned before breakfast, but believes it impossible before 9 o'clock A. M. The counterpanes, in her district, have been washed whenever they required it, and clean towels have been regularly furnished twice a week. All the dor- mitories have been washed several times this session. She says William (P43934), a boy she has recently had attending to the dormitories, has faults, but she has withdrawn him from the dormitories. She employs two servants to attend the dormitories. She thinks the

tea and coffee at her Hotel good and refers to the Proctor on this subject.

Messrs. A. Duke (P27140), H. B. Tomlin (P43725), J. M. Forbes (P43516), J. T. Hendree (P31075), and A. Cary (P41338) boarders at Mr. Roses' (P43866) Hotel were sent for and appeared before the Faculty. Mr. H. B. Tomlin (P43725) says the diet at Mr. Roses' (P43866) Hotel is neither good nor sufficient in quantity, for when the bread gives out, the servants go out and return saying the bread is not done & finally do not bring it at all. He says they al- ways have wheat rolls for breakfast and supper, which are not fit for a gentleman to eat. The butter has been tolerably good hereto- fore, but at present it is "miserably bad". There is plenty to eat at dinner "such as it is", but is is not well cooked. He says the meats do not appear to be clean. They have tough beef cooked in every way; bacon always; and also, potatoes, rice stwed fruit, cabbages, & a dessert once a week. They have sufficient servant's attendance at meals. He says there is tea and coffee both morning and evening, but neither are good; and for his part, he can't tell what the tea is made of. The knives & forks are dirty. The Hotel Keeper frequently has turkeys & chickens, but he does not re- member how often. He does not Remember how often the bedlinen is changed, nor does he recollect whether the towels are washed more than once a week. The washing, he believes, is pretty well attended to. His dormitory was washed Saturday last. The servants are always tardy about cleaning his

dormitory in the morning, for he sometimes returns from lecture be- fore it is done; but his fire is always made and water brought him to wash with in the morning before he is up. The Hotel Keeper nev- er goes to his room to see to his comfort, or to see if the ser- vants do their duty. He has only lost one article of clothing with his name upon it, and that was a collar. His clothes always come from the wash in a separate bundle. Mr. Forbes (P43516) says the meats are badly cooked at dinner, but they are always sufficiently done. The knives & forks are not well cleaned. The tablecloth is always clean. The tea & coffee are indifferent, but the bread and butter are generally good. The bedlinen is changed once a fortnight & the towels once or twice a week. His dormitory has been washed once this session & he objected to having it washed a day or two since. He finds no fault with the washing. The servants are not attentive to his room. He does not believe the Hotel Keeper has visited his room this session, with the intention of seeing to his comfort or making the servants do their duty. His counterpane has been washed twice this session. Mr. Cary (P41338) says he has boarded at all the Hotels and that Mr. Rose (P43866) keeps the best house. He says the tablecloth is always clean and the servants attendance sufficient.

The bread is good - They generally have rolls, but sometimes, biscuits; and he has never known any delay about bringing the bread but once and that was whilst the weather was excessively cold.

The coffee is too weak but the tea is very excellent.

There is always sugar enough. The butter is generally very good.

The bedlinen is regularly changed once a fortnight & his counter- pane has always been kept clean. His dormitory has been washed three times this session. His room is always cleaned immediately after breakfast. His fire is made early in the morning and water brought at that time to wash with. Messrs. J. T. Hendree (P31075) & J. C. Burrus (P26328) gave in substance the same evidence as Mr. Cary (P41338). Mr. Alex. Duke (P27140) says the diet is pretty good and he has never seen it filthy.

The knives and forks, glasses, and tablecloth are always clean.

The coffee is sometimes too weak & not always clear, but the tea, he believes, is always strong enough. The servant's attendance at table is sufficient. He says Mr. Rose (P43866) always tries to keep order at his table, but he does not always succeed, for the students oc- casionally throw bread about the room & are sometimes very noisy.

The Hotel - Keeper has fowles once or twice a week. His counter- pane was washed about a week ago and has been washed before since he has been here. His room has been washed once & the Hotel- Keeper offered to have it done again a short time since. Mr. Rose (P43866) has frequently enquired of him if there was anything required to be attended to in his room. The washing at the Hotel is very well done, and he has never lost anything of consequence. Mr. Rose (P43866) has, he thinks, visited his room at least once a week. His basin

is kept clean & his room comfortable. He says the towels are tak- en from his room one day, washed, and returned the next day, freq- ently damp.

All the students concur in saying that the washing of the dormi- tories and other attentions of the Hotel - Keepers have been much more strictly attended to since the Chairman notified them that the Faculty would probably act upon them if there was not an improve- ment very soon.

Messrs. J. D. Dudley (P43586), F. S. Sampson (P35802) and A. L. Beard (P40414), boarders at Mr. Conway's (PL8543) Hotel, were again sent for. They say the washing at Mr. Conway's (PL8543) Hotel is tolerably well done, and that they have never lost any thing. Mr. Sampson (P35802) says the fare, particularly the butter, is better this session than it was last. Their rooms are cleaned out about 8 o'clock in the morning. Their rooms have been washed out once or twice this session, and their bedlinen has been changed about once a fortnight. They have towels twice a week.

Mr. Jno. Smith (P43949), the Janitor, was sent for and says he has never received instructions from Mrs. Gray (P43865) to act as her Agent, nor has she ever given him any compensation for acting as such. He, as the agent for the Proctor, visited most of Mrs. Gray's (P43865) dormitories on Friday last, and found all of them, except one, in very bad or- der; and at that time he heard several of the students complaining that their rooms had not been washed.

Mr. Conway (P43888) was sent for. He says, that although vegetables are scarce, he has never been without them, and that his table supplied with cabbages, potatoes, rice, beans, peas, & stewed fruit, and that he never has less than two kinds of vegetables at dinner. He ad- mits that the dormitories in his district have not been washed once a fortnight before the commencement of the present investigation, but he has always given the students to understand that their rooms could be washed whenever they required it to be done. He visits the rooms in his district at least once a week to attend to the comfort of the students, and see that his servants do their duty.

The bedlinen is changed about once a fortnight, sometimes overgoing the time a day or two, when the weather is very unfavorable, and the towels are changed twice a week, a clean one always being re- turned the same day that the dirty one is taken away. He does not know how often the counterpanes are washed, but believes they are washed whenever they require it. It is sometimes as late as 10 o'clock A. M. before his servants finish cleaning the dormitories.

The students have never complained of bad washing, or of having lost any clothing. He hires John Taylor (P43933), but twenty two of his boarders give him extra pay. John (P43933) waits only on those students who hire him. When the students first proposed to hire John (P43933), he (Mr. Conway (P43888)) told them it was not right to do so, and asked the Proctor, in the presence of several of them, if it was not contrary

to the enactments. He says, he believes the students on whom John (P43933) has heretofore waited, have given him more than they have other servants.

Mr. Rose (P43866) was sick, and consequently, not sent for.

Mr. Davis (P33195) offered the following resolution.

"Whereas by a law of this institution it is made the duty of the Hotel - Keepers to have the dormitories under their charge washed out at least once a fortnight (see p. 59 of the printed enactments) - and it has been proved that the Hotel - Keepers have, with a few exceptions, caused the dormitories in their respective districts to be washed out but once before the present inquiry com- menced, and then in consequence of an intimation from the Chairman that he would otherwise report their default to the Faculty; and by another law, it is made their duty "to visit the dormitories under their charge themselves, or to have them regularly inspected by some agent approved by the Chairman, not less frequently than once a week for the purpose of seeing that the servants do their duty & that the comforts of the students are properly attended to", (see page 59 of the printed enactments) - which duty also they have failed to perform; and by another law, it is made their duty to have the rooms of their boarders cleaned and set in order by sun- rise or breakfast, (see pa 42 of the printed enactments) - and it has been proved, that notwithstanding the refusal of the Board of

Visitors, when applied to by the Hotel - Keepers for that purpose, to extend the time for performing that duty, the Hotel - Keepers do not & have not during this session begun to clean out the rooms until after breakfast, generally not sooner than 8 o'clock, nor completed it until from ½ past 9 to 11 o'clock; for all which de- linquencies no reason has been offered which would justify the Faculty in passing them over without severe animadversion -

Therefore resolved, that Mr. Edwin Conway (P43888), Mr. Jno. W. Rose (P43866), & Mrs. Gray (P43865) be fined, for these violations of duty, each the sum of $15.

It was moved as a substitute that each Hotel - Keeper should be fined $5 instead of $15, which motion prevailed.

Mr. Davis (P33195) offered the following resolution, which was carried.

"It appearing to the Faculty from the evidence of Mr. Cooke (P40184), a boarder of Mrs. Gray's (P43865), that he has lost four shirts, which were given out to be washed, and on which his name was marked, and on applying through the servant to Mrs. Gray (P43865) for his clothes

he received no satisfactory answer, resolved that the Proctor be directed to deduct from the amount deposited by Mr. Cooke (P40184) for his board, the value of the clothing lost by Mr. Cooke (P40184), and pay the same to him; and that Mr. Cooke (P40184) be authorized to have his washing done in future by another than the Hotel - Keeper, and deduct the price thereof from his board."

Mr. Davis (P33195) then offered the following resolution which was also agreed to.

"Whereas twenty two of Mr. Conway's (P43888) boarders have, in violation of the enactments employed a servant to attend upon them, Resolved that the servant thus employed be compelled to leave the University, or discontinue his attendance upon the students who have employed him."

[EVENT: Course Reference:Modern Languages  ] [EVENT: Student Status:Dropping a Class  ] [EVENT: Student Misconduct:Drinking  ] The Chairman informed the Faculty that Mr. Jno. W. Eppes (P33480) had left the School of Modern Languages without leave; and he had, moreover, been informed that Mr. Eppes (P33480) had been guilty of drinking wine in a tavern on Monday last.

Mr. Jno. W. Eppes (P33480) was sent for, and said, he left the Class of Mod. Languages, because he could not attend it and do justice to his other studies; besides, he was his own guardian and thought he had obtained leave to do so from the Professor. He admits he was in a tavern on Monday last, and that he dined there; but says he did not drink ardent spirits. He went to the tavern to see a friend, and

drank several glasses of wine with him, in his room.

Dr. Johnson (P43633) "moved that Mr. Eppes (P33480) be reprimanded by the Chairman, and that his parent be written to, informing her of the nature of her son's offence."

This motion was carried.

Wednesday, Feb. 12th, 1834.

The Faculty met at 5 o'clock P. M.

The Chairman stated to the Faculty that the Proctor had seen Mr. Thomas P. Giles (P43539) in a tavern on Monday last, & that whilst at dinner

he drunk ardent spirits. He said Mr. Giles (P43539) seemed a good deal concerned about it, and had asked for leave to quit the University if the Chairman thought there was any probability he should be suspended or dismissed.

Mr. Thomas P. Giles (P43539) was sent for, and admits he drank whisky and water at the dinner table in a tavern on Monday last, but denies that he held the glass up before the Proctor with an intention of insulting him. Besides drinking the whisky and water at the din- ner table, he admits he took several glasses of wine with a friend in a private room in the tavern. He thinks he has been to a tav- ern once before, this session, but does not recollect whether he took anything to drink on that occasion. He considers it no harm to drink in a tavern. Being asked why he had never attended the French Class, he says he does not consider himself a member of that Class, (&) he finds that the School of Law occupies all his time.

"Dr. Magill (P43655) moved that the Chairman reprimand Mr. Giles (P43539)."

Dr. Emmet (P43625) proposed, as an amendment to this motion, that he be sus- pended for two weeks. The vote upon the amendment stood thus,

a riot of the students, and saw the riotous party standing between Pavilions No. 3 (PL8446) & 5 (PL8454). He saw a person who he supposed, at the time, was Mr. Tench C. Carson (P39819), leaning against one of the pillars.

He spoke the individual and laid hold of him, to ascertain, if possible, who he was, but he could not entirely satisfy himself as the person was disguised. He saw Mr. Edwin P. Jones (P33232) a short distance from the rioters, blowing a tin - horn. He went to Mr. Jones (P33232) and asked him to give his name up, which he refused to do - The Chairman insisted upon his doing so, and told him, if he did, the punishment which the Faculty would probably inflict would be light; but on the contrary, if he persisted in withholding his name, he would receive a major punishment. Mr. Jones (P33232) replied, he should not give his name up, and if the Chairman knew it he could set it down, and he immediately retired. The Chairman said the riotous party had thrown stones at himself and another professor the same night, but thinks they did not try to injure him. He thinks the number of the rioters did not exceed ten. The rioters succeeded in breaking open the bell - room door & rang the bell for an hour & a half.

Mr. Edwin P. Jones (P33232) was sent for, and admits he blew a horn on Sat- urday night last, but declares he had no connection with the riotous party. He says the horn which he blew was not his, and he had just taken it from the hand of another person, when the Chairman

stepped up to him. Being asked why he kept his name secret when demanded by the Chairman, he replied, he did not know that he had any motive for doing so. He says he retired to his room immediately after the Chairman saw him. Altho' he had nothing to do with getting up the riot, and positively declined having anything to do with it, he says he heard it spoken of, as a thing in contemplation, Saturday afternoon. He says when he left his room to cross the lawn, where the rioters then were, he had not the slightest intention of joining them.

Dr. Patterson (P43634) offered the following resolution, which was carried.

"Mr. Erwin P. Jones (P33232) having joined in a party engaged on Saturday night last in riotous conduct, and having been detected in the act of blowing a horn, and having, when asked by the Chair- man, refused to give up his name,

Therefore resolved that he be dismissed from the Univer- sity."

Mr. Davis (P33195) moved as an amendment to this resolution that Mr. Jones (P33232) be suspended for the rest of the session. The vote upon the amend- ment was as follows

The Chairman said he had some reason to believe that Daniel E. Johnson (P31923), Tench C. Carson (P39819), John J. Carson (P27880), and Harrison B. Tomlin (P43725) were members of the riotous party of Saturday night.

Mr. Daniel E. Johnson (P31923) was sent for, and says he will answer no questions relative to the riot of Saturday night last.

Mr. Tench C. Carson (P39819) was sent for. He says he had nothing to do with the riot, for he went to the Jefferson Society (CB0011) with Mr. H. Garland (P39496) and returned with him to his room. He refers, for con- firmation of what he says, toMr. Hamer (P35685) who was also in Mr. Gar- land's (P39496) room that night.

Mr. Jno. J. Carson (P27880) says he had no connection with the riot.

[EVENT: Exception:Postponed  ] Mr. Harrison B. Tomlin (P43725) says he should like to know who said he was one of the riotors. He can answer no questions at present, for he is fearful it would not be right to do so without considering the import of the questions, which have been asked him, longer.

He asked the Faculty to permit him to consider the matter a few days, which was granted.

It was agreed that the Professors should, at their next monthly meeting, hand in a list of such students as had given in blanks at the Intermediate Examination in the several schools and Classes.

The Faculty then, on motion, adjourned.

The Faculty met at ½ past 4 o'clock P. M.

The Chairman said that Mr. Harrison B. Tomlin (P43725), who, at the last meeting of the Faculty, had asked leave for a few days to consider the questions which had been asked him, had exculpated himself from the charge of having been engaged in the late riots.

The Chairman next read a petition from a number of the students setting forth reasons why the Faculty should reinstate Mr. Erwin P. Jones (P33232). Whereupon, it was moved that the Faculty cannot consist- ently with their sense of duty agree to the petition of the stu- dents in favor of Mr. Erwin P. Jones (P33232).

*Mr. Davis (P33195) offered the following resolution, which was lost.

"Whereas the Faculty have reason to believe that in con- sequence of the feeling prevailing among the students, those sum- moned to appear before the Grand Jury, will generally rather incur

the penalty of dismissal than give evidence against their fellow students, which will subject them not only to judicial prosecution, but to the action of the Faculty; and whereas the Faculty consider that it will better advance the purposes of discipline to subject all concerned to a judicial prosecution, than to dismiss for re- fusal to attend the Grand Jury, the few whom on imperfect evidence of participation in the late riots, they have given notice to appear before the Grand Jury; therefore resolved, that those students be informed, that the offences presented on their evidence, will be left to the cognizance of the civil magistrate."

Mr. Davis (P33195) then offered the following resolution, which was agreed to.

have knowledge of the individuals composing a riotous party, who, on Saturday night last, in disguise committed injury to the public property of the University by break- ing open one of the doors of the Rotunda, also an assault upon a professor, and other breaches of the peace,

Therefore resolved, that the Proctor be instructed to ob- tain process to enforce their attendance before the Grand Jury, at the next March term of Albemarle (PL5392) Court to give evidence against the persons concerned in the late riot and breaches of the peace; that he give due notice to those students that such process will be obtained;

Mr. Davis (P33195) offered the following resolution, which was carried.

"It appearing to the Faculty, by the report of the Proctor, that Mr. Conway (P43888) has without authority caused to be removed the fence running from the Anatomical Hall to his stable; resolved that Mr. Conway (P43888) be required immediately to put up a substantial post and rail fence in the place of that removed by him, and that if if he shall not have done so at the expiration of three weeks from this date that the Proctor cause a substantial post and rail fence to be erected and charge the cost of it to Mr. Conway (P43888)."

Eppes (P33480) were sent for, and confess that they were on Monday last, in a tavern in Charlottesville (PL4204) and whilst there, took several glasses of wine, Mr. Giles (P43539) confessing that he drank whisky & water also.

"Whereas the present state of the University is such as to permit the Faculty to proceed with the greater lenity than at the time when Mr. E. P. Jones (P33232) was dismissed - Moved that the Faculty do now take into consideration the mitigating circumstances that have come to their knowledge respecting the case aforesaid."

"The Faculty having taken into consideration the circum- stances which they have reason to believe true concerning Mr. Jones' (P33232) case, and tending to mitigate the offence for which he was dismissed, do not perceive in those circumstances any thing which render the action of the Faculty in Mr. Jones' (P33232) case unjust, or harsh; they at the same time do perceive a weight of evidence concerning the prev- ious good conduct of Mr. Jones (P33232) such as they believe would have in- duced the Faculty in a quiet and orderly time to punish Mr. Jones (P33232) with as much lenity as the laws permit. Under this view it is moved, that the Chairman be instructed to inform Mr. Jones' (P33232) father his son will be regarded as having been suspended until the present date, and that his future absence from the University will be viewed in the same light as the absence of a student who has been permitted to withdraw."

Dr. Harrison (P25515) offered the following resolution as a substitute for the above.

"The Faculty being persuaded that the sentence against Mr.

The Chairman next read the Commissioner's report relative to the Proctor's & Patrons' accounts.

The Faculty decided that if Mr. Barksdale (P28117) persisted in his refusal to attend the School of Natural Philosphy, he would render himself liable to dismission. The Faculty then adjourned to meet again on Saturday next at 4 o'clock P. M.

[EVENT: Student Misconduct:Destruction of Property  ] Mr. D. H. Tucker (P43619), the Chairman said, had been seen smoking one of the rooms upon the Lawn a few evenings since. The Faculty decided that he should be reprimanded by the Chairman for this offence.

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Dismissal  ] The Chairman said that a few evenings ago a drunken party came into the University and were seen to enter the room occupied by Messrs. Jas. G. Carson (P34533) and Robert L. Campbell (P33999). The party soon, however, left the dormitory and after passing across the Lawn dispersed.

Messrs. Jas. G. Carson (P34533) and Robt. L. Campbell (P33999) were sent for, but re- fused to answer any questions.

Mr. Tucker (P43619) offered the following resolution, which was carried.

"It appearing to the satisfaction of the Faculty that Mr. J. G. Carson (P34533) - from inattention and irregular habits - is not ful- filling the purposes for which he came to the University - There- fore resolved that Mr. Carson (P34533) be dismissed from the University."

Bibb (P21756) had, on the 4th of March, obtained leave of absence from the University, for a few days on the plea of bad health. Mr. Bibb (P21756) if absent at all, was absent but a few days, and the Chairman has been informed that he (Mr. Bibb (P21756)) has been for the last month within the precincts, without attending lec- tures or even reporting his return to the University, and very freq- uently engaged in fighting game - cocks and other irregularities.

Mr. David P. Bibb (P21756) was sent for, & declines answering questions.

Mr. Davis (P33195) proposed the following resolution, which was agreed to.

"It appearing to the Faculty that Mr. D. P. Bibb (P21756) on the 4th of March obtained leave of absence from the University for a few days, and that he has not since attended lectures or reported his re- turn tho' he has been in the University for several weeks since his return, and Mr. Bibb's (P21756) habits being so irregular that in the opinion of the Faculty he is not fulfilling the purposes for which he ought to have come to the institution, therefore resolved that he be dis- missed from the University."

They were sent for and say they went into the Confectionary merely for a glass of soda - water.

Hanson (P29091), he suspended for two weeks for having gone into a Confectionary, which motion was agreed to. The Chairman was instructed to notify Mr. Smith (P43951) that he must have the lecture room in the eastern part of the Rotunda washed out every Saturday evening. The Chairman requested the Professors never to employ the Janitor upon University business without giving him (the Janitor) a written order to do so, for the reason, that it could then be pretty well ascertained how much of his time was employed in the service of the University.

The Chairman again introduced the subject of the imperfect report of the Commissioner which was read at the Faculty meeting on the 3rd. instant and which appeared to be very unsatisfactory. After some conversation upon the subject by the members of the Faculty, Mr. Davis (P33195) offered the following preamble and resolutions, which were carried.

"Whereas under a resolution of the Board of Visitors passed at their last session, the Chairman appointed Martin Dawson (P44074) Esqr. Commissioner to settle the accounts of the Patron, and by his report communicated to the Faculty, nothing more is stated than that the debits of the Patron (with certain exceptions) are supported by suf- ficient vouchers, and that it appears from the accounts of the Bank of Va. (CB0012) that certain sums therein mentioned were on deposite by the Patron in the bank at the times specified; and whereas this settle- ment does not effect the purposes designed by the resolution of the Visitors nor any other valuable purpose;

Resolved that the Chairman be advised to cause the accounts

of the Patron to be settled so as to show the things required by the resolution to be set forth and stated.

Resolved, that the Faculty believe that the unsatisfactory settlement which has been made, is not to be ascribed to any dis- regard on the Part of the Patron or Commissioner of the require- ments of the resolution of the Visitors, but to the fact that an imperfect copy of that resolution was furnished to the Patron by the Secretary of the Board of Visitors, to which copy the Commissioner was directed for instruction by the Chairman, under the impression that the Patron's copy of the resolution conformed to his own."

The Faculty then, on motion, adjourned.

Tuesday, April 22nd, 1834.

The Faculty met at ½ past 4 o'clock P. M.

Chairman said Messrs. Edmund Ruffin (P34480), John A. Meredith (P43578) and Ramsay McHenry (P24666), students of this institution, were seen to enter Keller's confectionary.

Messrs. Ruffin (P34480), Meredith (P43578), & McHenry (P24666), were sent for & confess that they went to Keller's Confectionary, to get soda water.

It was moved & carried that Messrs. E. Ruffin (P34480), J. A. Meredith (P43578) & Ramsay McHenry (P24666) be suspended for two weeks for having visited a con- fectionary contrary to the enactments.

Mr. Jno. L. Keller (P44075) made a proposition, in writing, to the Faculty to discontinue the sale of spiritous liquors, provided he were allowed to sell soda - water, cakes, candies and other confectioneries to students, he promising to bind himself in a pecuniary penalty to pass all his accounts through the Proctor's hands to be paid out of the pocket money only.

After Mr. Keller's (P44075) letter was read, Dr. Patterson (P43634) offered the follow- ing resolution which was carried.

A proposition having been made to the Chairman by Mr. Jno. L. Keller (P44075), who keeps a confectionary near the University, to come under an obligation, with such security as shall be deemed satisfac- tory, that he will not permit any intoxicating liquors, either spi- rits or wine, to be drunk at his house, or sold at it, and that he

will not furnish dinner or supper parties, and that he will not permit any debts to be contracted with him by the students, except under orders upon the Proctor to be paid out of their pocket money, provided the students may be permitted to take Soda Water, Cakes, Icecreams, and such refreshments at his house - Resolved that the Faculty approved of an application being made by the Chairman to the Executive Committee, to give their licence to the trial of such an arrangement, for a limited period."

The vote upon the above resolution was as follows.

Mr. Davis (P33195), Dr. Harrison (P25515) & Dr. Johnson (P43633) asked permission to enter the following protest upon the minutes.

"Mr. Davis (P33195), Dr. Harrison (P25515) & Dr. Johnson (P43633) object to & protest against any proceedings having for their object to permit students to go at pleasure to Keller's Confectionary; first, because neither the Faculty nor the Executive Committee possess the power to re- peal or suspend the law of the institution which prohibits students

from visiting a confectionary; and secondly, because, if the power were possessed, it would in their opinion be highly inexpedient to exercise it, as such indulgence would lead to and authorise habits of expense and other irregularities."

"Mr. Penci (P43877) having applied to the Faculty to occupy the large room in the upper story of Hotel F. - which is now unoccu- piod and made no use of; and the Visitors by a resolution passed at their session of July last, having authorised the Faculty to grant to Mr. Penci (P43877) such accommodations in the use of the buildings of the University, as they shall deem expedient; Resolved, that the use of the said room be allowed to Mr. Penci (P43877) & his wife, during the re- mainder of the session, it appearing to the Faculty from the repre- sentations of Mr. Penci (P43877), that it is essential to enable him to teach gymnastics, during the warm weather, that he live within the

Dr. Blaettermann (P43621) asked for leave to enter the following protest upon the minutes.

"I object to permission being given to Mr. Penci (P43877) to have a lodging in the University with his family, for the reason that it is against the spirit of the enactments of the University, and because such applications have been refused before."

The Chairman then read a paper signed by twenty three students re- porting Mr. Conway (P43888) for bad fare at his Hotel, etc. The Chairman read a note he sent the Proctor and the Proctor's reply(See Letters No. 1 & 2 April 22nd., 1834, endorsed.)

It was then moved, that the Faculty do now adjourn to meet again on Friday next at ½ past 4 o'clock P. M.

C. Bonnycastle (P43623).

Friday, April 25th, 1834.

The Faculty met, pursuant to adjournment, at ½ past 4 o'c. P. M.

Mr. Davis (P33195), by request of Dr. Johnson (P43633), previous to the meeting of the Faculty, acted as Secretary pro tem.

The Chairman made the following communication to the Faculty, which was read.

"Finding a difficulty in executing the law which requires the Patron's accounts to be examined at stated periods, I request the advice of the Faculty thereon.

The law under which the Chairman is authorised to appoint a Commissioner to make the inspection in question contains direct- ions to the effect that the Commissioner shall report whether the monies deposited with the Patron are kept separate and apart from all other monies, and deposited in Bank pursuant to the Enactments.

The meaning of the words pursuant to the enactments can only be ob- tained by reference to the latter, where it is stated that the Patron shall open an account with the Bank of Virginia (CB0012) and without delay deposit to the credit of that account, all money and all other funds received by him as Patron, which are not to be immediately

disbursed.

Two methods present themselves of accomplishing the ob- jects here stated, either, the Commissioner may compare the depo- sits reported in the monthly statement furnished by the Cashier of the Bank, with the monies received by the Patron.

Or, secondly, the Commissioner may report the state of the accounts at the time, that is, from the face of the accounts, ob- serving whether the monies of the Patron and Proctor are then sepa- rate, and include in this report the longest period that has elapsed between the receipt & deposite of any sum exceeding a certain amount.

Either of these methods it appears from the statement of the Commissioner are practicable, but the Commissioner & Patron con- cur in stating that either will lead to an expense beyond what they conceived the Board contemplated.

The Commissioner, although looking to my directions as his guide, regards them as unduely expensive; and recommends a statement of the accounts at the period of examination, in other words, a statement from the face of the accounts.

This method not comprehending one of the objects stated in the law, I have thought it my duty to direct an inquiry more in ac- cordance with the latter; but unwilling to put the Institution to unnecessary charge, I am desirous of advising on the subject with the Faculty.

[EVENT: Student Misconduct:Physical Assault  ] [EVENT: Student Status:Dismissal  ] Whereupon, on motion of Mr. Davis (P33195), it was resolved, that the Chair- man be advised to have the settlement of the Patron's accounts so made as to effect the objects specified in the resolution of the Board of Visitors.

The Chairman stated, that on the night of the 23rd. inst. the Proctor called upon him, and informed him that there was reason to suspect that a challenge had passed and a duel was about to take place be- tween Mr. Thomas J. Pretlow (P27916), a student of this institution, and Mr. Dan. E. Johnson (P31923), lately a student; whereupon, he instructed the Proctor to apply immediately to the civil authority in order to pre- vent it. That the parties were accordingly arrested and bound in a recognizance to appear at Court. The proceedings of the Proctor in this matter are detailed in a letter read by the Chairman. (See it.)

The Faculty thereupon sent for Mr. Pretlow (P27916), and Mr. Love (P30753), said to have been the friend of Mr. Johnson (P31923), but they decline to answer any questions relative to the difference said to be existing between the former and Mr. D. E. Johnson (P31923), or the alleged contemplated duel.

There being no evidence that a challenge had passed or been accepted,

The Faculty could take no steps against the suspected students.

A communication was received from Dl. E. Johnson (P31923), which with the

accompanying papers was read. These papers consisted of a copy of Dr. Johnson's (P43633) certificate to Mr. Love (P30753), made by Dr. Johnson (P43633), copies of the certificates of Messrs. Robertson (P23061), Hendree (P31075), and Royall (P42950) im- peaching the character of Danl. E. Johnson (P31923), the originals of which were given to Dr. Johnson (P43633), and the certificates of Messrs. Benj. H. Johnson (P36492), Tench C. Carson (P39819), Wm. E. Mills (P43565), Nathl. A. Venable (P36372), Augustine S. Magill (P30211), Wm. B. Archer (P36919), Robt. E. Love (P30753), Thomas M. Mathews (P39425) and Rufus K. Polk (P27280), testifying that Mr. Daniel E. Johnson (P31923) is a gentleman.

These certificates were ordered to be preserved by the Secretary. Mr. Johnson's (P31923) communication was ordered to be entered on the record. It is as follows.

Mr. Johnson (P31923) requested to be permitted to appear before the Faculty.

His request being complied with, he appeared, and stated, that the certificates of Messrs. Robertson (P23061), Hondroe (P31075) and Royall (P42950), were deliv-

ered to him by Dr. Johnson (P43633) on his demand. That the conversation stated in his communication as having taken place with Dr. Johnson (P43633), occurred a day or two after his dismissal. That Dr. Johnson (P43633) may have qualified his remark in the manner he states, tho' he did not so understand him and does not believe he did. That he understood Dr. Johnson (P43633) at the time the conversation took place, as he now states that he did, and reported the conversation immediately after to his friends, according to his understanding of it.

[EVENT: Student Misconduct:Destruction of Property  ] [EVENT: Fee  ] The Chairman stated that the students residing in the rooms on the Lawn, had, sometime since, defaced the pillars by sticking candles against them to make an illumination. That the Proctor had caused the pillars to be whitewashed, and had charged the students occupy- ing the dormitories opposite the defaced pillars 75 cts. each, which sum, was something more than the charge made by the mechanic for re- pairing the damage done, though not twice that amount.

Mr. Bonnycastle (P43623) "moved that the Proctor's estimate (75 cts.) be al- lowed;" which motion prevailed.

Lewis (P29769) who intends matriculating as a student, and who is not yet twenty years of age, asked to be permitted to board at Mr. Meredith Jones' (P43896) with his relation Mr. Lucas (P36617); which was granted. Dr. Emmet (P43625) offered the following resolution, which was carried.

Pretlow (P27916) and some other students of this University have become most serious- ly involved in the misunderstanding which originated between a Pro- fessor at the Institution, and Daniel E. Johnson (P31923), late a student thereof, and that the said students have been, most unwarrantably, made parties to the same, under circumstances which prevent them from appealing to the Faculty: therefore, resolved, that, by per- mission of Profess. Johnson (P43633), a committee be appointed, by ballot,

to ascertain the facts in relation to the misunderstanding which lately subsisted between Professor Johnson (P43633) and Daniel E. Johnson (P31923), as well as the manner and extent to which other students of this Uni- versity have become involved in the dispute, and to report the same to the Faculty." Messrs. Tucker (P43619), Emmet (P43625) & Davis (P33195) were appointed a Committee.

Mr. Davis (P33195) then offered the following resolution, which was also carried.

"Resolved, that if the Committee just appointed ascertain in the investigations which they are authorised to make, that the controversy which has arisen between Dan. E. Johnson (P31923) of the one part and Thos. J. Pretlow (P27916) & other students on the other, has arisen from a misconception of the former as to the character & circumstances of the alleged interference of the latter gentleman to his injury in the misunderstanding between himself and the Professor, that they be authorised to make such just & proper explanations to the parties as may serve to settle the controversy between them."

[EVENT: Boarding  ] [EVENT: University Administration:Personnel Decision  ] [EVENT: Fee  ] The Faculty next went into an investigation of the condition of Mr. Conway's Hotel (PL8543), The Chairman having just read a report relative to the Hotels. (See it.)

Mr. Conway (P43888) was sent for, and admits, that, during Easter - week the attendance in the dormitories was not such as it ought to have been, one of his servants having been absent, and two boys having attended

in his place. He says he has now a very good servant to attend in the dormitories and there shall be no further cause of complaint upon this score. He has had the dormitories regularly washed once a fortnight when the students would permit it to be done. Many of the students prefered having their rooms dry - rubbed, which he has had done once a week. He has been since he was fined by the Faculty, daily in the rooms of his boarders to attend to their com- fort and see that his servants did their duty; & he has been told by students, if he reported them for refusing to rise early, they would report him to the Faculty whenever they could. He has never refused to have the dormitory of any student washed out when re- quested to do so. The bedsteads in his district are being scalded at present. His fare has always been plentiful, and he believes, well served - He has bacon always at dinner, beef, shoat, mutton, lamb, veal, and fowls; besides, lettuce, rice, potatoes, stewed fruit, and asparagus. He has had more difficulty lately in getting butter than he has ever experienced since he kept a hotel. The bedlinen has been regularly changed once a fortnight and towels fur- nished twice a week. The Proctor has been but once in the last three months to examine his fare.

Messrs. Sampson (P35802), Dudley (P43586), Young (P38846), Robertson (P23061), H. Smith (P25201), A. Smith (P29468) & Lowndes (P37047), boarders at Mr. Conway's (PL8543) Hotel, were sent for and agree in the following statement. That the servants who attend upon the

dormitories have been very negligent & have not washed the dormi- tories as often as required by the Enactments. That the Hotel Keeper has not been every day, as asserted by him, to attend to the comfort of the students. The bedlinen has been changed once a fortnight since Mr. Conway (P43888) was last fined by the Faculty, but the towels, which have been generally changed twice a week, are often returned damp, & frequently not returned at all until the day after they are taken away to be washed. The fare is neither sufficient in quantity nor neatly served - The tea & coffee, particularly, are very indifferent. They all concur in saying that the fare needs improvement at present.

The Proctor being sent for, says, Mr. B. H. Johnson (P36492) was one of the students who complained, that he could not get his room washed out.

The day he dined at Mr. Conway's (P43888) hotel, the fare was abundant and neatly served. Mr. Bonnycastle (P43623) then proposed the following motion which was carried.

"Moved that Mr. Conway (P43888) be fined 5 dollars for negligence in regard to the fare, & 3 dollars for negligence in respect to the cleaning out of the dormitories."

After the monthly circulars were filled the Committee appointed by the resolution of the Faculty of the 28th of April read their report and such evidence as had been taken by the Committee. (See that re- port & the evidence.) This report was received by the Faculty. Mr. Bonnycastle (P43623) offered the following resolution which was agreed to.

"Resolved, that the evidence obtained by the Committee be laid before the Visitors, and that power be given to the Committee to continue that part of their labours which has for its object to put an end to the fued existing between students & others in conse- quence of the misunderstanding alluded to in the report."

Dr. Harrison (P25515) presented the following resolution, which was carried.

"Resolved, that the report & evidence from the Committee

Mr. Davis (P33195) then offered the following resolution, which was passed.

Johnson (P31923) made to the Faculty on the 25 day of April containing his statement of the conversation which he alleges that he held with Dr. Johnson (P43633) on the occasion of his receiving his dismissal, he rescinded; and that that communica- tion be placed with the papers accompanying the report of the Com- mittee of investigation, and preserved by the Chairman."

The Faculty decided that each of them, except Mr. Robertson (P23061), who said he had not violated the law, should be reprimanded by the Chairman.

Messrs. J. W. Stevenson (P43600), J. R. Woods (P43808) & T. P. Lewis (P33049) were reported by the Chairman as having violated the uniform law; and were sent for, but the Janitor said he could find neither of them.

[EVENT: Student Misconduct:Verbal Assault  ] Mr. R. H. Weightman (P43597) was reported by the Chairman as an habitual swearer, and for frequently making disturbing noises. The Profes- sor's whom he attends also reported him as idle. The Faculty re-

quested the Chairman to give Mr. Weightman's (P43597) father notice, that, unless his son improved in his attention to his studies he would render himself liable to dismissal.

Mr. Wm. P. Braxton (P41509) was sent for, and admits that he was one of the party of noisy students who went into his room on the night of Fri- day last, but says he was not intoxicated, nor was anyone of the party. He admits that he sometimes swears but says he does not think he could be called an habitual swearer. He says he was one of the party who played at marbles, behind the dormitories, last Sunday, but he does not remember that they made much noise.

[EVENT: Boarding  ] [EVENT: Student Misconduct:Verbal Assault  ] The Chairman stated that he had had reason to believe that Mr. Wallace (P29853) was connected with the disorderly party on the Eastern Range, and was an habitual swearer. He had Mr. Wallace (P29853) before him, last thursday, but he (Mr. W. (P29853)) had cleared himself, and he (The Chairman) would not now have brought his case before the Faculty, had not Mr. Wallace (P29853) been reported by the Hotel - Keeper for misbe- having at the table.

Mr. Wm. Wallace (P29853) was sent for. He says he was justifiable in com- plaining of the bacon at the table, and sending his plate three times and asking another piece each time, for the bacon was dirty and fat, being an outside piece each time. After receiving the third piece of bacon, he laid it upon the table and went out. As he was going out the Hotel Keeper said to him, that the bacon was very good & he told him to eat it then, for he would not. He

thinks the Hotel Keeper has manifested hostile feelings towards him, and he had therefore determined to report him as often as he could, and try to act in such a way as to prevent the Hotel Keeper from reporting him. He does not admit that he is an habitual swearer, and he has determined to try to break himself of this habit.

The Faculty then adjourned to meet again on thursday at half past four o'clock P. M.

[EVENT: Boarding  ] [EVENT: University Administration:Personnel Decision  ] Capt. Rose (P43866), a Hotel Keeper, was sent for, and says, Mr. Wallace (P29853) has always been very rude at his table, particularly lately. Mr. Wallace (P29853) the day he was before the Chairman behaved rudely at table, objecting to the diet and asking the servant as often as three times clean & lean bacon, and finally, leaving the table in anger. As he was leaving, the dining room, Mr. Rose (P43866) observed to him that the bacon was very good, to which, he replied, "well then, eat it yourself". Mr. Rose (P43866) says the bacon sent to Mr. Wallace (P29853) was not an outside piece as stated by him (Mr. W. (P29853)). There were two shoulders of bacon the day on which Mr. Wallace (P29853) complained.

Mr. Rose (P43866) now being questioned relative to state of the dormitories & his hotel; he says, more than half of the students who board

with him sleep until the breakfast - bell rings, and consequently, those rooms cannot be cleaned out before breakfast, though he thinks all the dormitories in his district are generally cleaned by 8 o'clock A. M. He is of opinion he could have all the dormitories cleaned out by breakfast time from the 1st. of March until the last of the session, if the students would rise early. He says most of his boarders have refused to have their dormitories washed once a fortnight, and some of them will not suffer them to be dry - rubbed.

The state of the market is so bad that he finds it very difficult to get vegetables; however, he has, commonly, greens, rice, potatoes, & dried fruit. He says his meats are such as the market affords.

The counterpanes are changed, in the dormitories, once a month, the bedlinen once a fortnight, and the towels twice a week.

Mr. Fayette Jones (P36165), a boarder at Mr. Rose's (P43866) Hotel, was sent for, and says the fare at the Hotel is good enough at breakfast and supper, but it is not "very clean" or well cooked at dinner. The bacon a few days since did not appear to have been washed before it was boiled - "The variety at dinner not sufficient" - There is al- ways bacon, and the fresh meats are fowls, mutton, veal, & pigs, roasted. The knives and forks are sometimes dirty, but the table- cloth is always clean - The fare now is such as it has generally been this session, except that the butter is very scarce. The bread is not always sufficiently done and the tea and coffee is al-

ways indifferent. He generally rises at 5 or 6 o'clock, in the morning, but his room is never cleaned out before breakfast. His room was washed out two or three weeks ago & has been dry rubbed once or twice. He gets towels twice a week.

Messrs. G. Ranson (P43544) & F. W. Coleman (P22661), boarders at Mr. Rose's (P43866) Hotel, were sent for, and say that the fare at the Hotel is not very good, the cooking being bad, and but few vegetables on the table. The bread is tolerably good. The tablecloths are always clean, but the knives & forks are sometimes not well cleaned. The tea & coffee, they think, might be improved - The glasses & pitchers are always clean, so far as their observations have extended. The Hotel Keeper never furnishes milk to drink - Butter has been very scarce for the last month. They were of opinion that there had been a month in all, during the winter, that there had been no butter. The servants attendance at table is sufficient, there being three men & several boys to wait - The desserts are not good, but as good, they think, as at the other hotels - Counterpanes, sheets & towels are regularly furnished at the proper periods. Messrs. Land (P33264), Boyd (P26767), Pickett (P32135), & Harris (P43508) were sent for and made statements similar to the above.

Messrs. C. Randolph (P43581), R. J. Davis (P23020), J. G. Fulton (P43486), boarders at Mrs. Gray's Hotel (P43865) , were sent for & concur in the following statement; viz: that the fare has been very good, in every respect, this spring, & very abundant - The butter has been plentiful lately, but the tea & coffee is not strong enough, but it is of good quality -

The rooms have been washed out once a fortnight - The bedlinen has been changed often enough and towels have been furnished once a week - They say Mrs. Gray (P43865) has no agent to inspect their rooms. Mr. Bonnycastle (P43623) moved that the Faculty take no order in Mr. Wallace's (P29853) case, which was agreed to.

Messrs. G. W. Ranson (P43544), A. Duke (P27140), & E. W. Coleman (P22661) agreed to become se- curities for Mr. Braxton's (P41509) future good behavior, provided the Fa- culty would reinstate him, and further, that they would give infor- mation of any violations of the enactments committed by him.

Dr. Harrison (P25515) "moved that Mr. Braxton's (P41509) motion of suspension be laid upon the table," which was agreed to.

Mr. Davis (P33195) offered the following resolution, which was carried.

"It appearing to the Faculty that Capt. Rose (P43865) has not pro- perly attended to the furnishment of his table, nor had the rooms of the students cleaned up by breakfast, as required by the enactments, re- solved that he be fined for his default of duty four dollars."

Mr. Davis (P33195) also offered the following resolution, which was carried.

"Resolved, that the Hotel Keepers be informed that the objection of students to having their rooms cleaned up before break- fast, will not be admitted as an excuse for the failure on their part to comply with the requisitions of the enactments upon this subject unless they shall have specially & immediately reported to the Proctor those students who refuse to rise in time in the morn-

The Faculty met at 4 o'clock P. M.

[EVENT: Student Misconduct:Uniform Violation  ] [EVENT: Student Misconduct:Academic Lassitude  ] [EVENT: Student Status:Suspension  ] The Chairman said that Mr. R. H. Weightman (P43597), not withstanding the Faculty had recently directed him to be censured for not wearing the uniform & for negligence in attendance upon his classes, had been at a party lately out of uniform without any good excuse. He also said that Mr. Walter Henderson (P43577) was at the same party without his uniform & had assigned the reason that he had promised to accompany a lady, and was compelled to wear a dress coat as his uniform was

out of order.

Mr. R. H. Weightman (P43597) was sent for and said he had no uniform clothes fit to wear to a party. He says he did not know that the Faculty did not permit boots to be worn and that he did not wear his boots with a view to bidding defiance to the Faculty. He was not aware of the nature of the notice sent to his father, as he never received a copy of it.

Mr. W. Henderson (P43577) was sent for, and says he had not an uniform coat fit to wear to a party. He states that he had determined to go to the Ball, as he had promised to accompany a lady, altho' he might be seen there out of uniform.

Dr. Magill (P43655) "moved that W. Henderson (P43577) be suspended for two weeks for having been at a party out of uniform as to his coat", which was car- ried.

Dr. Harrison (P25515) proposed the following resolution, which was carried.

Mr. R. H. Weightman (P43597) having been at a party out of uniform notwithstanding he had recently been reprimanded by the Chn. of the Faculty for disobedience of the uniform law, and having since the party, been seen out out of uniform, and not having offered any ex- cuse for such violations of law, and moreover, being reported by the professors, whose several schools he attends, as very inattentive to his studies, therefore resolved, that he be suspended for the rest of the session."

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Misconduct:Verbal Assault  ] The Chairman stated that Mr. Lowndes (P37047) had been reported by a pro- fessor for swearing; and by the Proctor, for having sent for a bottle of brandy.

Mr. Wm. H. Lowndes (P37047) was sent for, and says he is not an habitual swearer. He says it is true he wrote a note for a bottle of brandy, but it was not for himself, nor did he send for it for his "room- mate."

[EVENT: Student Misconduct:Verbal Assault  ] The Chairman said Mr. Jno. J. Carson (P27880) had been reported for swearing habitually, and for using upon one occasion very obscene language.

Mr. Jno. J. Carson (P27880) was sent for, but offered no excuse for swearing, except he did not do so with any intention of insulting or wounding the feelings of any professor.

"It was moved that Messrs. Wm. H. Lowndes (P37047) & Jno. J. Carson (P27880) be reprimanded by the Chairman", which was carried.

[EVENT: Student Misconduct:Verbal Assault  ] [EVENT: Student Status:Suspension  ] The Chairman stated that Mr. Rufus K. Mills (P29780) had been reported for profane swearing and for having been guilty of contumacy towards a professor.

Mr. Rufus K. Mills (P29780) was sent for and says he does not believe he swears more than other students. He ran into a room to avoid a professor but does not think he swore after leaving the room. Dr. Harrison's (P25515) resolution is as follows.

"It appearing to the Faculty that Mr. R. K. Mills (P29780) is an habitual swearer & having repeated the offence under circumstances

of aggravation, after having been reprimanded by the Chairman, there- fore resolved that he be suspended for three week." The above re- solution was carried.

[EVENT: Student Misconduct:Noise Disturbance  ] The Proctor reported Mr. E. Ruffin (P34480) for having blown on a flute on Sunday last in a manner calculated to annoy him (the Proctor).

Mr. Edmund Ruffin (P34480) was sent for. He admits he blew upon a flute on Sunday morning last and that he did so to see if the Proctor would not report him for it and not report another student who had been playing when the Proctor was near them. He says, he knows he is disliked by the Proctor and that the Proctor seeks occasions to re- port him.

Dr. Patterson (P43634) "moved that Mr. E. Ruffin (P34480) having been guilty of making a disturbing noise on Sunday last be reprimanded by the Chairman, which motion prevailed.

After the monthly circulars were filled, the Chairman read a letter from Mr. Alex. Garrett (P43628) enclosing resolutions of the Protestant Epis- copal Convention concerning a minister of the Gospel to be sent to this Institution for the next session.

[EVENT: Student Misconduct:Destruction of Property  ] [EVENT: Student Misconduct:Physical Assault  ] [EVENT: Student Status:Suspension  ] The Chairman said he had received information that on the night of the 22nd. inst. a party of students, four or five in number, had visited several houses in the neighbourhood, where they had conducted themselves in a disorderly manner. They had thrown down several flower pots at Kitty Foster's (P44031), and then proceeded to the house of Mr. Vandergriff (P44032), where they threw stones at a dog tied in the yard. When Mr. Vandergriff (P44032) appeared and entreated them to desist, they threw stones at him, which compelled him to retreat behind a tree, where they forced him to remain some time. His wife becoming al- armed, made her appearance in the yard, but was soon obliged to re- tire behind the house to avoid being struck. Several stones struck the house with such force that the marks were very perceptible the next day, and a window light was broken. He informed the Proctor that he had seen Mr. T. L. Patterson (P32066) throw stones at his dog several

times, and that he was frequently engaged in fighting cocks be- hind the Univ. stables, with other students. The Chairman said he had sent for Mr. T. L. Patterson (P32066), who confessed he was one of the party who threw stones at Mr. Vandergriff's (P44032) dog, but he dis- claims having thrown at Mr. or Mrs. Vandergriff (P44032), or the house. Mr. Th. Leiper Patterson (P32066) was sent for, and says, he did not, on the night of the 22nd. inst. throw stones at any person, or at Mr. Vandergriff's (P44032) house, but confesses that he threw at the dog, which he then thought was not chained - He did not see Mr. Vandergriff (P44032) or his wife, though he afterwards heard a student of the party say he heard Mr. V. speak (P44032) to them. He says the party went from Kitty Foster's (where they had upset some boxes containing dirt, and they had knocked at her door) to Mr. Vandergriff's (P44032). He does not think the party made noise enough to be heard at the University, unless by some one who was listening, before arriving at Mr. Vandergriff's (P44032). He has thrown at the same dog several times before. He could not, he says, have thrown stones at Mr. Vandergriff (P44032), for he(Mr. V. (P44032)) knew him, and of course, would inform against him. He acknow- ledges he has once been present when the students were fighting game - cocks behind the University stables.

Mr. Davis (P33195) offered the following resolutions, it being understood by the Faculty, that the Chairman should cause the first or second to be executed if the other students of the party did not give up their

names, but if they did so, then the last resolution was to be en- forced against them as well as Mr. Patterson (P32066) - the Chairman to fill up the blank.

"1. Mr. Th. L. Patterson (P32066) having been one of a party of students who on the night of the 22nd. inst. made an attack on the house of Mr. Vandergriff (), by throwing stones at it & breaking his window, resol- ved that notice be given him by the Proctor that process will be ob- tained to compel his attendance before the Grand Jury of the county court to be holden Monday next, and that the Proctor be instructed to obtain the proper process, superintend its execution, and report the result to the Chairman."

"2. Resolved, that Mr. Patterson (P32066) be informed, at the time of the ser- vice of the notice, if he shall not evade the process of the court, and shall obey it, the Faculty do not propose to act against himself or those who were engaged with him, on the evidence he may give be- fore the Grand Jury, but to leave the matter to judicial cognizance."

3. Mr. Th. L. Patterson (P32066) - having been guilty of throwing stones against the house of Mr. Van- dergriff (P44032) & breaking his window, resolved that they be suspended for two weeks."

Mr. Wm. H. Lowndes (P37047) appeared before the Faculty and said he made no riotous noise within the precincts and altho' he sang, he used no in- decent words. He refuses to say whether he was at a tavern or whe- ther he drank ardent spirits there.

Mr. Jno. J. Carson (P27880) says he was at a tavern but drank nothing there, for he merely went in to see a friend. He admits he sung, whilst on the way from town, but did not sing this side of Mr. McKennie's (PL8519) Book - store.

Mr. Bonnycastle (P43623) proposed the following resolution which was agreed to.

"Mr. Lowndes (P37047) having been convicted of disorderly conduct and not having cleared himself from the imputation of having on that oc- casion visited and drank at a tavern, and it further appearing that Mr. Lowndes (P37047) is making little proficiency in his studies - there- fore resolved that he be suspended for three weeks."

Dr. Harrison (P25515) offered the following resolution, which was carried.

"Mr. J. J. Carson (P27880) having been convicted of disorderly con- duct, and of visiting a tavern; and being reported as inattentive to his studies after receiving notice that he would be dismissed for such inattention unless he manifested improvement, therefore, Re- solved, that he be suspended for three weeks."

the 31st. of May, concerning Mr. T. L. Patterson (P32066), to be enforced, he having received evidence since which implicated other students, and because those students who were with Mr. Patterson (P32066), did not, as was expected, give up their names & take two weeks suspension; and furthermore, Mr. Patterson's (P32066) father being absent, he thought it pru- dent, under the circumstances, to confer with the Faculty. Mr. Patterson (P32066) had, Sunday last, met Mr. Vandergriff (P44032) at a professor's office where an explanation of the affair of the night of the 22nd. of May took place.

He has received evidence that there was a drinking party at the spring near the Janitor's house, on the night of the 22nd. of May, and that Messrs. T. L. Patterson (P32066), R. M. Head (P34264), and J. S. Peebles (P28623) were of the party. The party made so much noise that he heard it whilst sitting in his office.

Mr. Th. L. Patterson (P32066) was sent for, and admits he drank mint - sling at the spring, by invitation, but was not at all intoxicated for he took very little of it, it being passed around not more than three times. He thinks the party made but little noise whilst he was at the spring. He does not know how long the party remained after he left them.

Mr. Richard M. Head (P34264) having been sent for, he says, he was passing by the spring with another gentleman after the party had assembled, and was asked to drink mint - sling, which he did, but he was not in-

toxicated nor did he hear any noise. He left the party soon & re- turned to the University with Mr. Peebles (P28623), and went into Mr. Peebles' (P28623) room, where he remained some time. He was not with the party at Mr. Vandergriff's (P44032). He did not remain long at the spring.

Mr. Jas. S. Peebles (P28623) was sent for, and gave, in substance, the same evidence as Mr. Head (P34264).

Mr. R. M. Head (P34264) applied for leave to withdraw from the University, which application, on motion of Dr. Johnson (P43633), was postponed.

Mr. Davis (P33195) submitted the following resolution.

"Resolved that the consideration of the case of Mr. Th. L. Patterson (P32066), Mr. R. M. Head (P34264), & Mr. Peebles (P28623), brought before the Faculty at this meeting be postponed for the present."

This resolution was carried by the following vote.

Mr. Davis (P33195) moved that Mr. Chapman (P31050) be reprimanded by the Chairman, which was carried.

The Proctor's monthly report concerning the Hotels etc. was read & received.

The Commissioner's report was read, and on motion of Dr. Johnson (P31050), received.

"It appearing to the Faculty that Tho. L. Patterson (P32066), Jas. S. Peebles (P28623), and Richd. M. Head (P34264), students of the University, were members of a party who, on the night of the 22nd. of last month, assembled at a spring within the precincts for the purpose of drink- ing spiritous liquors, and then and there so indulged in violation of the enactments, resolved that each of them be suspended for two weeks from the University."
