The Faculty met June 27th 1855

The Chairman brought before the Faculty the request of Mr. T. S. Bolling (P43459) to have an appeal to the Faculty from the adverse report in his case, of the Committee on Graduation in the School of Chemistry - Upon careful consideration of all the facts of his case the Faculty were of opinion decidedly that the report of the Committee ought to be con- firmed, being entirely satisfied that he did not come up to the standard at the examination for degrees, to say nothing

of his having barely reached the third division at the intermediate examination.

It appearing that Mr. John E. Jones (P39948), a candidate for the degree of Master of Arts had passed his "review" examina- tions before the whole Faculty, upon Ancient & Modern Languages, Natural Philosophy & Moral Philosophy in a manner acceptable to the Faculty, but had failed of suc- cess in his recent examinations for graduation in the Schools of Mathematics & Chemistry.- And it appearing further by the reports of the Professors of these Schools that he had exhibited in his examinations an amount of knowledge of the subjects taught in each equivalent at least to what would be sufficient bo secure distinctions at the inter- mediate & final examinations - in the same, which upon the principle of substitution, regulating the practice of the Faculty in former cases, would entitle him to the degree of Bachelor of Arts - therefore, Resolved, that authority be asked of the Board of Visitors to confer the degree of Bachelor of Arts upon Mr. Jones - (P39948)

Jemison (P34839) from the adverse decision of the Committee of Examination for gradu- ation in the School of Mathematics was brought before the Faculty - Upon a careful consideration of the facts of the case the Faculty being of opinion that justice had been done Mr. Jemison (P34839) in the valuation of his answers, it was -

The Faculty would respectfully represent to the Board of Visitors, that it would be both just & expedient, in their opinion to allow Mr. Dinwiddie (P43741), should he accept the place of Assistant in the School of Ancient Languages, the same compensation to which under their resolution Messrs. Joynes (P43732) & Becker (P43733) will be entitled to, Viz. $800 Mr. Dinwiddie (P43741) has been already two years in the service of the University; his duties as Assistant in Greek demand such an amount of labor, and such ability, fidelity & dignity of demeanor as make it a place difficult to fill; and the successful discharge of his duties hereto- fore, & the knowledge which the Professor has of his practical skill & ability as a teacher, constitute not only a ground of preference above all others in making the appointment, but also a reason why he should receive the same compensation with the other assistants who have had the same time of service - that the mere fact of his ser-

There having been grave complaints made against the Boarding House kept by Mr. Williamson (P44460) in respect to the fare, and also in respect to certain gross disorders committed there -

I. Resolved, that whilst the Faculty are willing to believe that so far as the disorders alledged are concerned,

they were unknown to Mr. (P44460) & Mrs. Williamson (P44461), yet they have occurred, and that unless the house shall be hereafter kept in a satisfactory manner, it will be necessary to revoke the license therefor.

II. Resolved, that the licensed boarding housekeepers will be required hereafter, to prevent the use of firearms, and all other disorders, on their premises.

III. Resolved, that the attention of the licensed board- ing house Keepers be directed to the duty prescribed to them by the foregoing resolution and by the laws of the University (page 50 Enactments) requiring them " them to prevent all gaming & drinking by students boarding thereat, on their premises" and that the Chairman be requested to cause a copy of the two last resolutions to be communicated to each of them -

It having been represented to the Faculty that Mr. Wertenbaker (P43631), long the efficient Librarian of the institu- tion and Secretary of the Faculty wished to enter one of his sons as a student of the University next Session, and it appearing that though in his capacity of Librarian he has the privilege under the authority of the Board of Visitors of attending any of the lectures in the institution, free of charge, a privilege which from the circumstances of his situation he has not for many years availed himself of - and it appearing moreover that his compensation as Secre- tary in the present state of the institution is very insuf- ficient for his services rendered - therefore

The Chairman laid before the Faculty letters from J. Peery (P44411) and two other citizens of Tazewell County, complaining of the appointment of Samuel M. Witten (P31410) a State Student for District No, 6 on the ground that his father is in a situa- tion to incur the expenses of his education

And thereupon the Faculty proceeding to investigate the circumstances, find that according to the statements of Judge Hopkins, Hon. Fayette McMullen (P44412), Ex-Gov. J. B. Floyd (P34695) and a number of other persons, the father of Mr. Saml. M. Witten (P31410) has a large family and an estate inadequate to their maintenance and the education of his son, and according to the Certificate of the Clerk of Tazewell () County, exclusive of slaves over 12, his estate is valued at $12340 whilst it appears from the declaration of Mr. J. M.

Witten (P31410) himself whose statements are vouched for by some of the most respectable citizens of his County, that he is burdened with a considerable amount of debt. Having been referred to several gentlemen for further information, they caused application to be made, through the Chairman to one of them, with a request that he would communicate with the others named - to which no answer has been received - In view of all the facts in the case the Faculty see no suf- ficient reason to rescind the appointment of Mr. Witten (P31410) and the Chairman is requested to inform type="pname"key="P31410"> Mr. Witten () accordingly.

biscuits are either very much burnt, or are not cooked at all - the rolls are both sour and badly cooked - the same may be said of the corn bread - the coffee is not fit to drink one day in the week, and the tea is but little better - the milk is perceptibly watered - As for the meats - the beef is very tough, moreover, the piece we have for dinner one day frequently makes its appearance next morning in the form of steak or hash - the quality of the ham is to be especially to be complained of - the butter is insupportable - the vege- tables are deficient both in quantity and quality - the dessert is wanting in variety and proper preparation - The servants are utterly regardless of the wants of the students at meals, and the food is decidedly unclean"

The Faculty having heard the statement of six of Mr. McCoy's (P43757) boarders, the Chairman & Proctor, and also having heard Mr. McCoy (P43757) in his defense, adopted the following pre- amble & resolution

"The Faculty having received intelligence of the death of Joseph C. Cabell (P43614), late Rector of the University of Virginia (PL4214), desire to place on record their estimate of his worth, as a man and their appreciation of his services in the important public employments to which at various times he was called."

"Endowed with a vigorous understanding, enlarged by cul- ture, & by foreign travel, he was long prominent in the Councils of Virginia (PL4507), as the unwavering and at length successful advocate of an enlightened policy as respects Education & Internal Improvement -

The intimate friend of several of our illustrous Revolu- tionary Statesmen, he had caught not a little of their Spirit, moderation and wisdom, and enjoyed, as he deserved, much of their Confidence -

The Co-labourer of Jefferson (P43611), Madison (P43612) & Monroe (P43632) in rearing this University, he sustained in its behalf, many a strenuous legislative conflict, & having been from the beginning, one of its most efficient Visitors, for twelve years past, was its faithful & revered Rector - In this relation he was best known to us, nor shall we cease to cherish pleasing memories of the amenity, justice, integrity & zeal with which he dis- charged his duties -

His long and useful career is closed, and we rejoice to know, that honorable as was the tenor of his life, nothing in it became him more than its end - for he died a Christian -

Sensible that we ourselves have individually sustained a great loss in the decease of this eminent benefactor of the University, our hearts the more readily sympathize with those whom this afflictive dispensation bereaves -

Be it therefore,

Resolved, that in testimony of our respect for his memory, we will wear crape on the left arm for thirty days -

The Chairman stated that on tuesday the 29th ult Mr. N. B. Noland (P29839) who boards at Miss Terrell's (P43999) being provoked by impertinent language from a servant girl (P47051) about 10 or 11 years of age in Miss Terrell's (P43999) service, went to Miss Terrell (P43999) and informed her of it, and announced at the same time his purpose to chastise the girl (P47051) for it - Miss Terrell (P43999) earnestly requested him not to do so, and assured him that she would have the girl (P47051) corrected herself - and as an additional reason informed him that the girl's mistress (P43999) was then in the house sick, and that great injury might result from the agitation which would be occasioned by any act of violence by Mr. Noland (P29839) - That he withdrew persisting in declaring his intention not to be satisfied with the infliction of chastisement by Miss T. (P43999) but to punish the girl (P47051) himself - that soon afterwards whilst the family was at dinner, he went to the back door of Miss Terrell's (P43999) residence & called the girl, (P47051) who went to the door, and being seised by him was knocked down & kicked & beaten so severely as to be for a time insensible, and to require the attendance of a Physician afterwards; and that the screams of the girl (P47051) and the confusion which followed greatly disturbed the peace and tranquility of Miss T's (P43999)s family, altho' she herself declined to make any complaint -

The girl (P47051)was going to a dormitory in pursuit of a pigeon when Mr. Noland (P29839) asked her who sent her there - she said "I sent myself" he then threatened to whip her, she replied "No you wont"

On Motion - Resolved, that Mr. Noland (P29839) be summoned to appear before the Faculty -

Mr. Noland (P29839) appeared, and admitted the facts to be true, ex- cept that the girls first reply to him was "What?" He did not advert to the fact that Mrs. Woodson (P44436) was in the house sick, had he have done so, he should not have acted as he did - regrets that he acted so hastily, & that he punished the negro (P47051) as much as he did - Does not regret having punished the servant, and assets, that whenever a servant is insolent to him, he will take upon himself the right of punishing him with- out the consent of his master - admits that he has not the legal right to do so, but would nevertheless take the liberty- Upon being questioned replied that if provoked by a servant he would not trouble himself to go in search of the master to punish him, but would punish him himself. He had made ample apology to the ladies for having caused the disturbance & for the discourtesy to them - and he sincerely regrets having dis- turbed them.

Question - Do you mean to assert the right to exercise your own will and the suggestions of your own passions in the infliction of punishment on a servant of another person - upon provocation?

Answer - I do not assert it as a right to violate the laws of the land or the University -

Question - Is the sense in which you declared you would not make a promise to not to repeat the act - only that you had reference to your passion - or that you would not repeat the act itself?

Answer - I will not make such a promise, as I might be led into the same act again by my passion -

Question - Would you try to restrain your inclination to repeat?

Answer - I would restrain myself so far as not to whip a servant so severely as I did in this case - but no further. -

Question - With your present understanding of what the laws of the University in this respect, mean, would you sign the law again?

Answer - I was not aware that that was a law of the Univer- sity -

Question - Knowing it now, and that the laws of the Univer- sity most emphatically, in various places, declare, a violation of the laws of the land, a violation of those of the University - would you sign them now?

Answer - Probably I would -

After due consideration the following preamble & resolution were unanimously adopted -

Mr. N. B. Noland (P29839) having from his own confession chastised with extreme severity a young servant girl (P47051) in the employment of his boarding housekeeper Miss. Terrell (P43999), & having thus violated the laws of the land and those of the University , and having refused to give such assurances to the Faculty as would give a guaranty against a repetition of a similar offense, or to express his regret for the action above men- tioned, except in respect to the extent of the punishment - In view of the danger to the peace of Society & the good order of the University, resulting from such conduct

"In this I acknowledge that I have done wrong & am will- ing to express my most profound regret.

1. In treating the ladies of Miss Terrell's (P43999) household with discourtesy. - This arose from my violence of passion at the time and has been fully apologized for to the ladies. In so far as this involved a distrubance of the peace of the Uni- versity, I express my regret for it & apologize to the College Authorities. -

2. I did wrong in yielding to my temper & while under its influence inflicting so severe a punishment upon the young (P47051) servant girl - This I very much regret -

3. In as much as it is a violation of the laws of the land to inflict punishment upon a servant belonging to another person I admit that it was wrong to undertake to do this with such apparent determination of purpose as was exhibited by me in the recent affair. I think that the correction of a servant

for impertinence, when done on the spot & under the spur of the provocation, is not only tolerated by society, but with proper qualifications may be defended on the ground of the necessity of maintaining due subordination in this class of persons - The criminality of an act of this sort, ought, I think, to be judged rather by the attendant circumstances than by the abstract question - This is all that I would claim. - I am aware that it is an unsafe & dangerous precedent to allow any man to be the judge of the amount of punishment due to an offence committed against himself, but I submit that this objection has its force diminished, as respects cases of this sort, by my free admission that the punishment should never exceed that of a moderate flogging. - When the offense is such as to deserve more severe punishment, it should be referred to the magistrate, if the owner failed to take the proper measures - and even with respect to cases of lesser magnitude, I am willing to confess that as a general rule, it is the duty of the offended person to report the offender to his owner - I hope to be able to bear this in mind with reference to my own conduct, but I cannot promise that I will never chastise a servant for impertinence any more than I can promise never to resent by a blow an indignity offered to me by an equal. - It is not my wish or intention to violate the laws of the University, nor do I wish to oppose the Faculty in the proper discharge of their duty in inforcing them. - In view of the foregoing statement I respectfully solicit at the hands of the Faculty a reconsideration of my

case, intending to comply with what they may deem to be a just decision in the case. -

That the Chairman be requested to inform the Committee that while the Faculty of this institution take a lively interest in the objects for the promotion of which it is pro- posed to call a convention & would be individually disposed to cooperate with the other friends of Education in the move- ment set on foot by the Faculty of William & Mary College, (CB0008) they yet conceive that it would be departing from the the

Dr. Cabell (P39304) from the Committee appointed to draw up a memorial to be laid before the Board of Visitors in regard to the com- pensation of Professors, submitted the following report, which on motion was unanimously adopted -

To the Board of Visitors of the University of Virginia The Memorial of the Professors of the University respectfully represents:

That at the annual meeting of the Board of Visitors in June 1850 the attention of the members present on that occasion was directed to the influence of the increasing numerical propriety of the University on the incomes of the several Professors, and after a free interchange of opinions between the latter and the members of the Board, the following preamble & resolutions were adopted with the cordial acquiescence of your Memorialists:

"The prosperous condition of the University suggesting the prosperity of "fixing a maximum limit to the compensation of Professors,

"Resolved, that that limit be placed at such a sum as will afford to the several Professors, in a series of years, such an average compensation as will command proper abilities, & will adequately compensate the labors bestowed, and that this maximum be placed at $3,000."

"Resolved, that if in any of the Schools there should be a surplus over the maximum limit of $3000, such surplus shall remain in the hands of the Patron subject to be appropriated for the enlargement of the Library and of the Philosophical & Chemical apparatus, for the gradual formation of cabinets of Natural History & for supplying additional means of instruction in the several Schools, unless otherwise ordered by the Board"

Your Memorialists consider it not irelevent to remark here that the foregoing preamble & resolutions, with the exception of the six concluding words in the second resolu- tion, were drafted by a member of the Faculty and were unanimously adopted in a full meeting of that body, before they were reported to the Board. This course was pursued in conformity with a wish expressed by the members of the Board at the interview already referred to, and the fact is now cited as going to show that your memorialists cooperated in good faith with your predecessors in the original suggestions of measures which were a part of what then appeared to be a reasonable scheme of economical reform.

The enormous rise in the cost of all the necessaries of life, beginning shortly after the date in question & continu- ing down to the present time, makes the sum which it is admitted was then considered a fair compensation for the labors bestowed, utterly inadequate now, to the maintenance of a family of the average size. Some of your memorialists have kept accurate memoranda of their expenditures, and are prepared to show that

on a scale of rigid economy they have not been able to cover their necessary expenses with their incomes as dreived from the College, and that this has fallen short by from $500 to $700 -

It is known to the members of the Board that one of the Colleagues of your memorialists, in the prime of life & in the zenith of his usefulness, has felt himself constrained, in view of the inadequacy of his income to support his family, to resign his Professorship & to imbark in an enterprise in which he hopes to reap a moderate but substantial reward for the laborious services which in the post he now occupies has been far less profitable to himself than they have been useful to the commonwealth & creditable to the University.

It deserves to be considered in this connexion that the very circumstance which has mainly contributed to the prosperous condition of the University, namely the largely enhanced value of the products of agricultural labor, is precisely that which by increasing the cost of the necessaries of life has borne so heavily upon the Professors in common with all persons who have a fixed salary. - nor can it reasonably be expected that this condition of things will ever be altered for the better, it being generally admitted that the value of money has largely depreciated of late years. In view of these unquestionable facts your memorialists respectfully but earnestly ask for relief - Adverting again to the fact that the circumstances which have been mainly instrumental in causing the distress from which they seek to be relieved,

have at the same time contributed largely to the prosper- ous condition of the institution. Your memorialists have the satisfaction of knowing that the measure of relief which they conceive to be reasonable may be afforded to them without detriment to the general interests of the University- your attention is respectfully invited to the terms of the second resolution quoted on the preceding page, from which it appears that it never was contemplated to have recourse to the surplus fund as a means of raising the revenue of the insti- tution for ordinary purposes, but that on the contrary, the whole of this fund was in express terms consecrated for cer- tain special objects. With the exception of the appointment of Tutors in three of the Schools this pledge has not been fulfilled - the necessities of the institution growing out of the heavy expenses incurred in the erection of the new public building rendering unavoidable a temporary diversion of this fund from its destination as originally intended.

During the first two years after the adoption of this system the surplus of fees amounted to between five & six thousand dollars each year, but it has now increased to the very large sum of more than $15000. Your memorialists think it not unreasonable to ask that adequate relief be afforded to them before the tuition fees are appropriated for any other object. They consider that a maximum of $4000 would not now be a larger sum in proportion to the present cost of living than that of $3000, was six years ago; and they accordingly do re- spectfully but earnestly petition your honorable body to amend

the enactments on this subject so as to place the maximum at the former sum. It should be observed that in as much as several of the Schools have not during the present session attained such a size as would produce the proposed maximum, the surplus fund of the current fiscal year would not have been diminished, had the higher maximum been allowed by the full amount of $10,000, but by that of about $7,500.
