Anderson (P37371) to whom dismissal notice was given on the 3rd of May be sent for- Mr. Anderson (P37371) appeared and said that he could not give an excuse for all his absences.- He was kept away three days by sickness and occasionally by bad weather.- Has made no effort to improve.-

Mr. Anderson (P37371) applied with the consent of his guardian to with- draw from the University (CB0001) - On motion - resolved that his appli- cation be not granted.-

The following resolution was then proposed, seconded and passed -

without Uniform in Charlottesville (PL4204) several times during the term of the Superior Court - and that he is frequently absent from lectures in Modern Languages, and particularly from Dr. Togno's (P44278) lectures on French -

On motion - Resolved, that Mr. Carr (P26997) be sent for - He appeared and said, that his object in joining the [EVENT: Course Reference:Modern Languages  ] School of Modern Languages, was to learn German - and not to attend French - the hour of lecture is very inconvenient for him, having to come from home which is at a considerable distance from the University (CB0001)- from this cause in had weather he has often been prevented form attending lectures.-

He attended Court without Uniform: - Has no Uniform and has had none since Christmas.-

The Chairman called, the attention of the Faculty to certain violations of the law regarding early rising reported by the Proctor - On motion - Resolved, that the students so reported and named by the Chairman, be reprimanded, and that their parents be written to.

The Chairman proposed, the following resolutions, which were seconded and adopted.-

[EVENT: Student Conduct:Honor  ] It being obvious that every. successful attempt to secure the honors of the University (CB0001) by frauds in the examinations, not only goes to impair the character of the University and lower its standard of merit, and so to inflict upon it the most serious injury: but also is a fragrant wrong to those who seek for honor by fair and honorable means, by reducing the value of the distinc- tion which they obtain.-

Resolved, that the Faculty will refuse to confer a degree, or to allow distinction in every case in which they shall be satisfied, that the student has, at any examination for such degree or distinction attempted to commit a fraud upon the Committee in any way or to any extent whatever.-

Resolved, further, that the above rule shall be understood to apply equally to the case of the person who gives, and that or him who obtains aid in the examination room.-

[EVENT: Student Status:Dropping a Class Action:denied ] [EVENT: Course Reference:Ancient Languages:Greek  ] Mr. John G. Crouch (P29306) appied thro' the Chairman for Permission to quit the Class of Jun: Greek - On motion - Resolved that his application be not granted -

[EVENT: Student Misconduct:Uniform Violation  ] [EVENT: University Administration:Student Restrictions  ] The Chairman stated that Mr. Edwin W. Henry (P23250) was reported by the Patron for having violated the law in purchasing a Panama hat at the cost of $9. the bill for which when presented be refused to pay. Whereupon the Chairman offered the following resolution which was seconded and passed -

Resolved, that the students who have purchased Panama hats as substitutes for the Uniform hat, have violated the law in so doing - and that the Proctor be instructed to give notice that such hats will not be allowed to be worn as Uniform.-

Neblitt (P27346) had purchased of Mr. Cochran () a summer coat, the price of the material & making of which amounted to $21. On motion. Resolved, that Mr. Neblett (P27346) be sent for - He attended and stated, that he had purchased the coat in ignorance of the requirements of the law. On motion

Mr. Lewis E. Mason (P24727) applied thro' the Chairman for a separate examination for graduation in Latin, on the ground of sickness Previous to the second examination - On motion - Resolved, that he be allowed a separate examination on the 22nd of June.-

Morris (P27153) made application thro' the Chairman for permission to withdraw from the University on account of ill health. Dr. Howard (P43670) stated that his health had been bad for some time past; and that recently he has had a hemorrage from the lungs.-

It appearing to the Faculty that Mr. Geo W. Carr (P26997) violated the law regarding Uniform several times during the term of the Circuit Superior Court of Law and Chancery.-

Resolved, that he be suspended for one week, and required to spend the time at home.

The following students having graduated in the Schools of Ancient Language, Modern Languages, Mathematics, Natural Philosophy, Chemistry and Moral Philosophy. On motion

Resolved, that they be admitted to the Degree of "Master of Arts" of this University.

The Chairman laid before the Faculty a resolution of the Board of Visitors (CB0042) now in Session, authorizing it is confer the degree of Master of Arts on John S. Caskie (P22691) and Joseph A. Shanklin (P31268) whereupon. on motion.

Resolved, that the degree of Master of Arts be conferred on

and that on endorsement in the following form be made on each of their Diplomas -

"Mr. having obtained but one of the two degrees "in the School of Modern Languages required to constitute him "a graduate in that School, the Faculty have resolved to confer "on him the Degree of Master of Arts in consideration of the "fact that his failure to obtain a second degree in Modern "Languages was owing to the peculiar condition of that School "at the commencement of the present Session, and that in lion "of such degree he obtained a certificate of proficiency in the "Class of Political Economy."

Mr. Tucker (P43619) submitted the following resolution which was seconded and passed -

Resolved, that when a candidate for a diploma or certificate in any School finally fails to obtain it, or is induced to with- draw, and he has shown in his previous examinations a satis- factory degree of proficiency which would have entitled him to distinction at the general examinations, the Faculty may award him Certificates of distinction, if on a view of all the Circum- stances of the case, they consider him entitled to it.

[EVENT: Student Conduct:Course Distinction  ] Mr. Rogers (P43658) from the Committee appointed to examine on the English Language - reported that of 14 students examined the following passed, namely. C. W. Carr, (P26997) Th. J. Cooke, (P26274) Charles Eversfield, (P31525) Richard T. Hundley, (P36201) William S. Jenkins, (P39362) Elisha M. Leake, (P24825) Henry C. Logan (P35876) and W. W. Stubbs (P29793).-

The Committee further report, that the following gentlemen did not come up to the standard required in order to pass, but from the peculiar circumstances of their cases, they recommend that the Faculty allow them to pass.- namely. Augustus H. Ashford, (P33369) R. B. Somervill, (P28543) David W. Martin (P40883) and John W. Compton (P40781). They have

passed their examinations for graduation, the two first with great credit - and all are students of excellent moral character -

On motion- Resolved, that they be allowed to pass on English-

[EVENT: Student Conduct:Self-governance:Petition Faculty Exception:denied ] Mr. Thomas W. Michie (P33574) a candidate for graduation on Greek and who was rejected by the Committee appeared before the Faculty and made the following statement.- He remembers his answers given at the third examination in Greek and thinks that he deserves a higher valuation than that assigned to him by the Professor.- He further states that he made a diligent preparation on notes on Etymology furnished by the Professor, but that he received mostly questions on subjects not treated in these notes.-

On motion of Dr. Howard (P43670) - Resolved that Mr. Michies (P33574) appli- cation for a degree in Greek be rejected.-

The Chairman laid before the Faculty a letter from Mr. William L. Harris (P28548) requesting to be furnished with a Diploma in Mathematics which was awarded him in July 1839 and which he has never received - Whereupon the following resolution was proposed & seconded & passed -

[EVENT: Student Misconduct:Academic Lassitude Exception:granted ] Mr. William L. Harris (P28548) having been declared by the Faculty at the Session 1838 - 39 - entitled to a diploma in the [EVENT: Course Reference:Mathematics  ] School of Mathematics under an order of the Board of Visitors (CB0042) - which diploma has not yet been received - therefor - Resolved, that the Faculty being satisfied from the statement of Professor Bonnycastle (P43623) made to the Faculty at the meeting to which the above resolution was referred - that Mr. Harris (P28548) was justly entitled to a diploma in the School of Mathematics - confer upon him that degree and that on endorsement to this effect be made on the diploma -

[EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Suspension  ] [EVENT: Student Status:Dismissal  ] [EVENT: Student Misconduct:Destruction of Property  ] The Chairman informed the Faculty, that on monday night last there was a very disorderly party of students at Terrell's tavern (PL8597) in Charlottesville (PL4204) - Dr. Howard (P43670) then stated, that he had obtained from Mr. Summerson (P44297) the Constable, the following facts.-In consequence of the disorderly conduct of the students, this officer was sent for by Mr. Terrall (P44298) - on arriving at the tavern - he found seven or 8 students who were very disorderly - were very noisy and some of them used abusive and obscene languages- the following are the names of the students C. C. May (P25317), C. A. Lamar (P27087).

R. D. Gayle (P41857) - Thomas Croxton (P41968) - A. G. Wicks (P27811) - J. W. Gordon (P40708) - W. S. Wade (P24691) - about an hour after Mr. Summerson's (P44297) arrival at the tavern, a very large reinforcement from the University (CB0001) same down - from 70 to 100- and a great deal of noise and disorder ensued with some damage to private property - some doors &c were broken by throwing of stones - May (P25317) and Gayle (P41857) were though to be the ring- leaders -

Dr. Howard (P43670) was informed by Mr. Bailey () that some students went to town intoxicated - he saw May (P25317) and Gayle (P41857) in an ox cart which they had taken from a negro, go into town about sunset - May (P25317) was driving the cart -

The Chairman further informed the Faculty, that the gentlemen who had become Mr. May's (P25317) Sureties, had come forward on being informed that he had violated his pledge and surrendered him- stating that they could no longer be sureties for him.-

The Chairman had sent for all the foregoing students - and Messrs. Weeks (P27811) and Gordon (P40708) informed him that they were passing and saw that one of their fellow students(Mr. Gayle (P41857)) was in a situation which required their aid.- that they went to the tavern for no other purpose than to take care of him - they drank nothing while there, nor did they participate in any of the disorders.-

On motion - Resolved, that Messrs. May (P25317) - Lamar (P27087) - Gayle (P41857)- Croxton (P41968), and Wade (P24691) be sent for -

Mr. May (P25317) appeared and said, that it was true that he went in an ox cart - He was disorderly and used profane language - took a drink at the tavern but was not intoxicated - drank sugar and water several times - Mr. Terrell (P44298) ordered him from his house, and he thinks that he was justifiable in using the language toward him which he did use - was making an apology to Mr.

Terrell (P44298) when he was ordered out - and Terrell (P44298) took up a chair to knock him out - has a sister living at the tavern whom he went to visit - Found the ox cart standing in the street - no one was with it - Mr. May (P25317) drove it - Drank before he left the University, and again before he got into the cart. The Tavern Door was pushed open not broken open - He did not participate in subsequent disturbances - aided in preventing the throwing of stones - the quantity he drank did not at all influence his conduct - Cant say how much he drank - Whiskey was the liquor

Mr. Gayle (P41857) appeared and said that he started from the University with two others about half past 4 O Clock and went to the tavern to see a bear - but did not then go into the tavern - from there they went towards the Presbyterian Church (PL8598) and met an ox cart with students in it - appearances indicated that these students might get into a difficulty with the Mechanics - this induced them to return with the ox cart towards the tavern - they did so - these in the cart got out - and all went into the tavern where drinking was proposed - He drank spirits and water, and as he very soon became intoxicated, remembers nothing that took place afterwards.- does not remember how much he drank - liquor has a peculiar effect upon him - Believes he took some liquor that afternoon immediately after dinner - it was four hours after, before he again drank - is informed that he walked up to College - is not in the habit of keeping spirits in his room -

Mr. Wade (P24691) appeared and said that he drank once at the Tavern and some before he went there, but not at his room - drank enough to excite him some what, but remembers all he did - he helped to carry Mr. Gayle (P41857) up stairs, and talked more loudly than usual, but does not remember to have used any profane language - when he called for any drink at the Tavern, it was never refused him-

drank once brandy and water and twice sugar and water - what he drank at the tavern would not have intoxicated him - Did not know that at any time he was offering resistance to a Civil Officer - whilst he was up stairs in Mr. Gayle's (P41857) room - some one rang a bell which brought Mr. Terrell (P44298) up stairs.-visited the Tavern twice - the first time when he got out of an ox cart- the second time, he went to take care of Mr. Gayle (P41857) - Mr. May (P25317) found the ox cart standing in the street near town and got in- he followed him - Heard throwing of stones, but does not know who did it - Stones were thrown by some party (not students) at Morvell's ().-

Mr. Lamar (P27087) appeared and said that he was at the Tavern during the row. Saw one or two students go into the tavern under such circumstances as induced him to go in and try and get them out again.- they refused to come out until he should drink something with them.- He did drink with them, but they called so often for liquor, that he requested Mr. Terrell (P44298) to give them no more -

He was returning to the University when he heard a noise and went back - He endeavored to keep the students in order - three stationed themselves at the head of the stairs to keep back the crowd - was not aware the Constable was coming up stairs - tho' he knew he was in the tavern - was not at all intoxicated -

Mr. Croxton (P41968) appeared and said that he was engaged from the time of the arrival at the tavern of the ox cart - Returned with Mr. Gayle (P41857) to the tavern after having started for the University- was with him most of the time, - and was not with the crowd during the disturbance - Gayle (P41857) was invited to drink by those in the ox cart - Messrs. Croxton (P41968), Lamar (P27087) and Gayle (P41857) left the University wiht the intention of going to Church - does not think that Mr. Gayle (P41857) drank in the tavern sufficient to intoxicate him - Saw

nothing of the confusion down stairs - had no apprehension that those in the ox cart would be attacked.- Mr. Gayle (P41857) returned home that night - he walked up - Mr. Croxton (P41968) drank once at the tavern- was not at all affected - knows nothing of the Attacks on private houses.-

Mr. Rogers (P43658) proposed the following resolution which was seconded and passed

It appearing to the satisfaction of the Faculty that Mr. Coleman C. May (P25317) on sunday the 12th instant in violation of the law and of his pledge entered a tavern in Charlottesville (PL4204), and drank of intoxicating liquors and was guilty of riotous and disorderly conduct while there -

Resolved, that he be dismissed from the University and interdicted from the precincts.-

Judge Tucker (P43676) submitted the following resolution.-

It appearing to the satisfaction of the Faculty that on the evening of sunday the 12th instant Mr. Ross D. Gayle (P41857) was guilty of a violation of the laws of the University in drinking spiritous liquours to the extent of intoxication in a public house in Charlottesville (PL4204), but it appearing also that the present is the first offence - therefore

Resolved, that he be reprimanded by the Chairman, and that it be announced to him, that a repetition of the Offence will be followed by dismission; and further that he be required to give three sureties who shall be approved by the Chairman, and who shall solemnly pledge themselves, that if they shall know or have good reason to believe that the said Ross D. Gayle (P41857) has committed any similar offence, or any other serious violation of the laws of the University, they will forthwith give infor-

mation of the same to the Chairman.-

Dr. Cabell (P43619) moved to amend said Resolution by striking out all after the word "Resolved" and inserting the following -"That he be suspended for months"

The Faculty deem his offence such as of itself, ought to subject him to the punishment of suspension for at least a month, but the Faculty being satisfied of Mr. Gayle's (P41857) previous general good conduct and studious habits, and further confiding in his promises of future compliance with the laws - Resolved, that upon furnishing such Sureties as the Chairman may deem sufficient- which sureties shall engage for his abstinence from intoxicating liquors and in case of any violation of this pledge on his part report it to the Chairman, the sentence which they would adem appro- priate to the offence shall be omitted.-

Judge Tucker (P43676) then withdrew the resolution submitted by him yesterday - and Dr. Cabell's (P43619) resolution passed -

The Chairman offered the following resolution in the case of Mr. W. B. Wade (P24691) which was seconded and passed -

It appearing to the satisfaction of the Faculty, that Mr. W. B. Wade (P24691) on sunday evening last committed the gross inde- corum and misconduct of taking possession of a passing ox cart and riding into Charlottesville (PL4204), and further that he entered a tavern and drank to intoxication.- The Faculty are of opinion that he has justly incurred a major punishment; but this being his first offence which has come to the knowledge of the Faculty, and with the hope that his promises of futuer good conduct may

be fulfilled, they have agreed that if he shall enter into a solemn engagement with the Faculty, that he will for the future entirely abstain from intoxicating drinks, and give diligent attention to his studies, and further, give three securities approved by the Chairman who shall engage for his good conduct and compliance with the laws generally and especially with those forbidding the use of intoxicating drinks, and that in case of his violating his pledge, they will give information to the Chairman, the sentence which they judge appropriate to his Offence shall be remitted.-

He fired a pistol in the upper room - attempted to use a bowie knife on one of the servants () - and broke Mrs. Gray's (P43865) table furni- ture - In company with a party among whom was Mr. May (P25317) a dismissed student - he insulted persons passing, and threw stones after Professors - He also committed violence on the door of the Chair- man.- and afterwards left the University without leave.-

Mr. George Tucker (P43619) offered, the following resolution which was unaniously adopted -

It appearing to the satisfaction of the Faculty, that Mr. Frederic Hall (P26494) on the evening of friday the 20th instant was intoxicated at Mrs. Gray's (P43865) Hotel (PL8436), was then and there armed with pistol & bowie knife which he attempted to use, and was guilty of various sots of disorderly conduct, and more especially of destroying articles of household furniture belonging to Mrs. Gray (P43865) -

Mr. Upshaw (P38957) noticed this item in his account only on the 18th of December, and objected to it - that he had never given such an order; and did not know anyone who had a right to take such a liberty with him - Upon enquiry it was found that Mr. George T. Wright (P40911) had given an order to Mr. Roberts (P44294) and had signed Mr. Upshaw's (P38957) name - That Mr. Wright (P40911) had satisfied Mr. Upshaw (P38957) on the subject, and urged by way of excuse that Mr. Upshaw (P38957) was a very intimate friend, that he called at his room to ask him to let him have the money, and not finding him thought he might use his name - That he afterwards forgot the matter entirely.-

Mr. Wright (P40911) appeared and said that near the end of September he engaged with Mr. Roberts (P44294) for Boxing lessons.- He wrote an order in the name of Mr. Upshaw (P38957) in the presence of several persons in Mr. Upshaw's (P38957) room - and in presenting it to Mr. Roberts (P44294) in the presence of Mr. Compton (P40781) said it was drawn without Mr. Upshaw's (P38957) knowledge. He did not mention the circumstance to Mr. Upshaw (P38957) until

about the 18th of this month, having forgotten it in the mean while - He had always been on very intimate terms with Mr. Upshaw (P38957), and knowing that he would not regard the matter - he did not think of it again - No attempt was made to imitate Mr. Upshaw's (P38957) hand writing - He proposed putting his own name on the back of the order.-

At the request of Mr. Wright (P40911), Mr. Compton (P40781) and Mr. Upshaw (P38957) were permitted to give evidence in regard to the transaction.

Mr. Compton (P40781) - said that he heard Mr. Wright (P40911) tell Mr. Roberts (P44294) that he had given him an order in Mr. Upshaw's (P38957) name - He under- stood that the paper was signed by Mr. Upshaw (P38957) or to be so signed -

Mr. Upshaw (P38957) said, that he was a particular friend of Mr. Wright (P40911)- they came from the same neighborhood and were old school mates.- Mr. Wright (P40911) had informed him by letter of what he had done after the meeting of Mr. Robert's (P44294) Class to investigate the matter.-

He has always allowed Mr. Wright (P40911) to pay for his letters out of his deposit in the Post Master's hands.- and is on such terms with Mr. Wright (P40911), that he would not think it strange at any time that he should make use of his name.- Mr. Wright (P40911) called at his room to procure means to pay Mr. Robaerts (P44294) - which Mr. Upshaw (P38957) would gladly have given, had he been present. Mr. W. (P40911) then wrote the order.

Mr. George Tucker (P43619) offered the following resolution which was seconded and passed -

It appearing to the satisfaction of the Faculty, that Mr. George Y. Wright (P40911) has violated the Anti-Credit law in a transaction with Mr. James Roberts (P44294) the teacher of boxing, and has not made due proficiency in his studies -

The Chairman stated that Mr. William B. Wade (P24691) who was dismissed at the last meeting of the Faculty, is entirely destitute of funds; that he resides in Mississippi (PL4259), and it must be some weeks before funds can reach him from home; and that he has given strong assurances to his friends, that if he shall be permitted to continue at the University he will conduct himself properly and pay strict attention to his studies.- whereupon

Mr. Rogers (P43658) offered, the following resolution which was seconded and passed

It appearing that Mr. William B. Wade (P24691) who was recently dismissed, is unable to leave the University for want of funds, and that he is not likely to recieve the necessary remittance from his friends for some time, and the Faculty being unwilling to subject him to the dangerous exposure of taking a residence at one of the public houses of the neighborhood; and it having further appeared, that Mr. Wade (P24691) has given strong assurances to his friends, that he will conduct himself in an orderly and studious manner if permitted to continue at the University until able to return home.-

Resolved, that his sentence of dismission be suspended until he shall receive the funds necessary for his return to Mississippi (PL4259), upon his engaging during this suspension of his sentence to conform himself to all the laws and regulations of the University as other students, and this indulgence be regarded as at any time revocable by the Faculty should they see cause to discontinue it.-

[EVENT: Student Status:Admission Action:granted ] [EVENT: Student Misconduct:Drinking  ] Mr. Francis Patterson (P32954) who was recently dismissed from William & Mary College (CB0008) applied through the Chairman for permission to matriculate.-

The Chairman laid before the Faculty a letter from Professor Millington (P44334) stating that Mr. Patterson (P32954) had been a student of William & Mary (CB0008) during the past and present Session; that he unfortunately got into a drinking frolic with some other young gentlemen, which was discovered, and that it had been deemed expedient by the Faculty to dismiss him and one or two others, with the view of checking the practice - He further stated that Mr. Patterson (P32954) is a young man of quiet and gentlemanly manners, and that he had never been guilty of any riotous or disorderly conduct.- that the Faculty would have willingly restored him to his former position but for the consideration, that he was sent away as an example to others - and that this was his first offence -

Mr. Patterson (P32954) having been requested to appear before the Faculty - appeared and said that the offence for which he was dismissed was his first offence.- He is not in the habit of drinking - pledges himself to conform to all the laws of the University, and especially these in regard to intoxicating drinks.- The President of William & Mary College (CB0008) and Judge Tucker (P43676) informed him that he would have no difficulty in entering next Session

[EVENT: Student Misconduct:Verbal Assault  ] [EVENT: Student Status:Dismissal  ] The Chairman stated that Mr. Charles A. L. Lamar (P27087) came to his office about One O Clock to-day, and after referring to a letter recieved from his father concerning the resolution of the Faculty of the 1st instant, demanded of him a certificate that he had not given a pledge of good behaviour; and when the Chairman told him that he could not give him such a certificate, proceeded to ude the most insulting manner and language to the Chairman and Faculty, saying that it was a rascally business from the beginning, and that he wished the Chairman to say so to the Faculty. This he persisted in repeating in the most violent and menacing manner after the Chairman told him that such language could not be allowed in his presence, and that he must leave the room.

On motion - Resolved, that Mr. Lamar (P27087) be sent for- He appeared and said with a manner and tone far from being respectful that he was now willing to repeat the language used by him to the Chairman - and that was - that "It was a rascally business from beginning to end"-

Bolan (P30788) obtained leave of absence to visit Richmond (PL4711) to meet a brother & sister there - and for that purpose drew $17. from the Patron - Mr. Bolan (P30788) did not visit Richmond (PL4711), and has not returned to the Patron the $17. but has spent it- Not has he during the time attended lecture - but alledges as a reason why he has not, that he has sore eyes -

Judge Tucker (P43676) moved the following resolution, which was seconded and passed -

It appearing to the Faculty, that Mr. Stephen P. Bolan (P30788) applied for and obtained leave of absence for two weeks to visit his brother & sister in Richmond (PL4711), and afterwards abandoning that object remained the whole time at the University without attending lectures, or announcing his relinquishment of his leave of absence, and it further appearing that he draw from the Patron for his expenses $17. which he has not replaced but spent -

Resolved, that his father be informed of these facts, and that he is not making due proficiency in his studies; and that unless a speedy amendment takes place he will be dismissed from the University.

[EVENT: Student Misconduct:Verbal Assault  ] [EVENT: Student Status Action:postponed ] The Professor of Mathematics (P43671) made complain before the Faculty, of the conduct of Mr. William H. Ballard (P25644) in his lecture room on the 31st instant - and after reading the following notes of the case, and commenting upon & and explaining them - laid them Before the Faculty as the ground of his accusation.

"Notes of the case of Ballard

"He engaged (the all appearance) in reading some book, heid beneath "the desk during the lecture, at all events paying no attention "to the examination then going on -

"Answered to his own examination (but this I passedover) in a "very unbecoming way; contradicting and interrupting as if he "were disputing with me

"A general call to attention had the effect of causing him "for a few minute to redress his position;- but presently after, "he gave his exclusive attention to the book -(or whatever else it might "have been) that he continued to hold under the desk

"On being called up after the lecture and privately recommended "to pay more attention in future - he answered (still with increased "violence of demeanor and tone) that he understood the subject "could follow the lecture without looking at me and had not his "spectacles - On this as he was leaving it occurred to me to "recommend him to bring them with him in future.- Hereupon he "answered in a very violent tone, manner and language, but the "exact words I do not remember - It is proper to observe that "Mr. Ballard's (P25644) mode of addressing me has been almost uniformly "marked with insolence and defiance.

"I then felt right to state, that such conduct must not be "persisted in and that if Mr. Ballard (P25644) could not alter his conduct "he must cease to attend my lecture room.

"On this he answered with increased insolence and violence- "but I cannot recall the terms employed - I answered that I had "been in different parts of the word, but had never witnessed "similar conduct in persons brought up amongst gentlemen.-

"To this he relied that 'I was not to prate to him, to hold "my jaw, that I might go to hell - and other abusive terms which "I cannot recall.-

"I declined altercation with him and ordered him to leave the "room, which he declared he would not do.

"I here turned to such of the class as remained made some "remarks on the disgracefulness and discreditable character or "such conduct and language, and left the room.- Before my leaving "Mr. Ballard (P25644) was guilty of additional abusive language.-

"The above is a faithful sketch of what passed to the best of "my belief, and the extent of my impressions.

"Mr. Ballard (P25644) had twice rendered himself in the preceeding month "obnoxious to special censure, and has been reprimanded by the "Chairman by order of the Faculty, for rudeness and insubordination.-

"Since then, he has left the lecture room towards he close, "and answered with great rudeness when informed that it was "against order.-

"On the following day he answered to his name on being called "in such a way as to excite laughter in the whole class, and drew "down from me the reprimand for persisting to adopt this peremptory "tone in addressing me -"he forgot what was due to his own position "the probability of personal violence.-

Resolved that Mr. Ballard (P25644) be summoned before the Faculty - He appeared, and commenced making his statement, but before he concluded Professor Sylvester (P43671) withdrew from the Meeting.- After Mr. Ballard (P25644) had retired, he returned and stated by way of explanation that the first occasion on which he used the term gentleman, it was not applied to Mr. Ballard (P25644), not could it be so understood; that the second time he used the term, it was applied to Mr. Ballard's (P25644) conduct & language, after he had used the insulting epithets before mentioned- After making this explanation Professor Sylvester (P43671) again retired.

Mr. Ballard (P25644) stated that he was attentive during part of the lecture, and during part of the time he was inattentive.- his inatten- tion consisted in not having his eyes directed all the time to the black board -

After lecture Mr. Sylvester (P43671) called him and told him that he must be more attentive during lecture - and that he must look at the black board.- Mr. Ballard (P25644) replied, that he could follow him through his sums as well without looking on the black board as by doing so- and that he did not wear his spectacles constantly - Mr. Sylvester (P43671) told him that he must bring his spectacles; that he must be more attentive to his lectures or not attend them in furure - Mr. Ballard (P25644) replied that he would cease to attend his lectures, and that he had his spectacles with him, but did not wear them all the time - Mr. Sylvester (P43671) said that he must not address him in such a manner and that he must leave the room - thus Mr. Ballard (P25644) refused to do - Mr. Sylvester (P43671) said he was no gentleman or considered that he was imposed upon, and spoken to in an authoritative manner - as an overseer speaks to a negro slave - Some further words having passed Mr. S. (P43671) ordered him to leave the room - upon which Mr. B. (P25644) said that he would see him in

hell first - Mr. S. (P43671) went on to say, that he would have no further altercation with Mr. Ballard (P25644), but as Mr. B. (P25644) was about to quit the room, Mr. S (P43671) again commenced addressing himself to him directly and through the byestanders in the same tone as before - Mr. B. (P25644) then told him if he Mr. S (P43671) would desist from speaking to him - he (Mr. B (P25644)) would also desist - and when he told Mr. S. (P43671) to hold his jaw it was in reply to language of the same import used by Mr. Sylvester (P43671) to him - when reprimanded in the lecture room - Mr. S. (P43671) expressed himself satisfied that Mr. B. (P25644) knew his lessons - reason of Mr. B's (P25644) apparent inattention, was that he had studied the subject (arithmetic) before and was acquainted with it - it was a newspaper and not a book he was reading.- He always answers Prof. Sylvester (P43671) as he does every other Professor- means no disrespect to him or to them - never on any previous occasion did he mean any disrespect to Prof. Sylvester (P43671) - He thought that he was imposed on when ordered out of the room - till then his language was not vio- lent - or he did not intend that it should be so.- Mr. Ballard (P25644) on retiring requested the Faculty to examine some of the byestanders -

Mr. A. H. Michie (P40950) was sent for, but the Janitor (P44285) could not find him.-

Mr. Farish (P32782) was then sent for and appeared,- He heard part of the altercation - Heard Mr. Sylvester (P43671) say, that Mr. Ballard (P25644) acted in a very indecorous and ungentlemanly manner.- to which Mr. Ballard (P25644) replied that he should not repeat that language and that he did not act like a gentleman or a Professor.

Mr. William F. Weeks (P29175) was sent for appeared and stated, that after lecuter Mr. Sylvester (P43671) called Mr. Ballard (P25644) - did not hear the first of what was said.- Mr. Ballard (P25644) started to walk out - Mr. Sylvester (P43671) told Mr. Ballard (P25644) that he must be more attentive or he must cease to attend his lectures. Mr. Ballard (P25644) said he would cease to attend if Mr. Ballard (P25644)

wished it - Mr. Ballard's (P25644) manner was not violent in making this reply -

Mr. Sylvester (P43671) said that it was not respectful for a student to answer a Professor - Mr. Ballard (P25644) told him, that it was the first time he had answered him - Mr. Sylvester (P43671) then ordered him to leave the lecture room - Mr. Ballard (P25644) said he would not - Mr. Sylvester (P43671) then again ordered him to leave the lecture room - Mr. Ballard (P25644) said that he had no authority to order him out as he had done lecturing and that he would see him in hell first - The students smiled - Mr. Sylvester (P43671) turned to them and said that this could not be considered brave or gentlemanly in Mr. Ballard (P25644) - He said bravery consisted in mildness (with a few other remarks not now remembered) and that Mr. Ballard (P25644) had never associated with gentlemen or been in genteel society - Mr. Ballard (P25644) then told him that the manner in which he had treated him (Mr. B (P25644)) indicated that he (Mr. S (P43671)) had never associated with gentlemen.-

Remembers to have heard Mr. Sylvester (P43671) say "that he had been in many parts of the world and had never witnessed similar conduct in persons brought up among gentlemen - Similar remarks were twice spoken - but cannot say when they were spoken - does not remember distinctly when -

Mr. Sylvester (P43671) told Mr. Ballard (P25644) he would report him - Mr. B. (P25644) told him to do so - Mr. Sylvester (P43671) told Mr. Ballard (P25644) that he did not wish to say any thing more to him, and that he would not say anything more to him - and started to get his hat - and reached the table and turned round and said something more about gentlemanly conduct- Mr. Ballard (P25644) asked him if he had not broken his word, and if he had not promised him not to speak to him again, and asked him if he considered that gentlemanly, to brek his word - Mr. Sylvester (P43671) then continued making his remarks about gentlemanly conduct &c and Mr. Ballard (P25644) walked up to the platform - (Mr. Sylvester (P43671) was on the Platform and Mr. Ballard (P25644) on the floor) and told Mr. Sylvester (P43671) to hush his jaw Mr. Sylvester (P43671) who was walking to and for on the platform - while Mr. Ballard (P25644) was

walking in like manner on the floor - waved his hand to Mr. Ballard (P25644) telling him to go away - he wanted to have nothing to do with him- Mr. Ballard (P25644) then turned and walked towards the body of the students who were standing near the door - Mr. Sylvester walked (P43671) to the opposite side of the room to get his hat - returned and went out -

The following resolutions were then proposed seconded and passed -

After a full consideration of all the circumstances of the case as above recited the following resolutions were adopted.

First. The Reprimand bestowed by the Professor of Mathematics (P43671) upon Mr. Ballard (P25644) being considered by him and the Faculty as adequate to the offence committed during the lecture and the Professor not having reported Mr. Ballard (P25644) for this Offence - Resolved, that in this particular no subject is presented for the action of the Faculty -

2nd. In view of the transactions posterior to the termination of the lecture, and the reprimand of the Professor; while the Faculty cannot but reprehend the violent language indulged in by Mr. Ballard (P25644) towards Professor Sylvester (P43671), being unable to determine in how far the remarks of the Professor as understood by Mr. Ballard (P25644) might extenuate his conduct in reply - Resolved, that it is expedient that this much of the transaction in question be Submitted to the Visitors (CB0042) of the University at their next meeting for their decision -

"He dees not allow that the words attributed to him by Mr. "Farish (P32782) or equivalent language was used by him.-"

"He furthermore protests against the principle of introducing "students of a class to give evidence against their professor - He "believes that besides other great inconveniences - this practice has "the effect of bringing the Professor into a position of direct "controversy and altercation with those over whom he is placed in a "position of authority -"

"The evidence on the occasion in question was obtained from "students present after the lecture at the time of Mr. Ballard (P25644) being "called on to be privately admonished -"That such presence is in "itself an act of insubordination, and very generally made the means "and occasioned by the desire of encourageing the student subject to "reprimand in resistance to the lawful authority of his Professor "

"That Mr. Weeks (P27811) in particular is habitually ill prepared and "has been himself admonished and reported by the Professor of Mathe- "matics -"

"That he has some reason to believe, that previous communication "had passed between Mr. Ballard (P25644) and the witnesses, at all events the "question as to this previous communication was not put to the witnesses"

"Finally he calls attention to the fact, that Mr. Ballard (P25644) was "unable, and did not offer during the first part of his examination "when called on by Mr. S. (P43671) to do so - to point out any inaccuracy or

Mr. Sylvester (P43671) adheres to his first statement in every parti- "cular; in especial he declares, that the conduct of Mr. Ballard (P25644), "between the time of being called upon to be more attentive in future, "and the time of his being ordered to; leave the room, was in the "highest degree both as regards tone, attitude and language, outrageous "and insulting"

Mr. Sylvester (P43671) denies absolutely having ever said to Mr. "Ballard (P25644), "that he had never been associated with gentlemen - or "been in genteel society" - or having used a word to this effect.-

"He denies further, that Mr. Ballard (P25644) ever said that this was "the first time he had over contradicted Mr. Sylvester (P43671), or one word "to this effect.- He affirms on the contrary, that from the beginning "Mr. Ballard's (P25644) attitude was that of open defiance.-

Professor Sylvester (P43671) stated to the Faculty that Messrs. Whitehead (P23544), Cornick (P25027) and Sydnor (P38371) were good students, and he believed, that they would make a correct statement of facts - He then retired from the Faculty, and in accordance with his desire the above named gentlemen were sent for -

Mr. Cornick (P25027) appeared and said that he went away from the Lecture room immediately after lecture and did not witness the altercation between Prof: Sylvester (P43671) and Mr. Ballard (P25644) -

Mr. Sydnor (P38371) could not be found by the Janitor (P44285) -

Mr. Whitehead (P23544) appeared and said that he was there part of the time - heard most of what passed - heard as he was leaving the room their voices raised - then the first thing he could distinguish was rather an imporative order from Mr. Sylvester (P43671) to Mr. Ballard (P25644) to leave the room.- to which Mr. Ballard (P25644) answered in a manner equally abrupt that he would not - then something passed which Mr. Whitehead (P23544) did not hear.- the next thing he could distinguish was another imperative

order from Mr. Sylvester (P43671) to Mr. Ballard (P25644) to leave the room.- to which Mr. Ballard (P25644) replied, that "he would see him in heel first-" Mr. Sylvester (P43671) then remarked that he did not consider Mr. Ballard (P25644) a gentleman.- to which Mr. Ballard (P25644) replied, that Mr. Sylvester (P43671) had not conducted himself like a gentleman since he had been here.- there was so much confusion after this that he could hear nothing more distinctly.-

The tone and manner of Mr. Ballard (P25644) up to the time that their voices were raised, and the order to leave the room given - seemed to him to be respectful -

[EVENT: Student Status:Dismissal  ] Professor Kraitsir (P43671) stated, that on tuesday while he was calling the roll - Mr. Upshaw (P38957), Mr. Bolan (P30788) and Mr. Wade (P24691) were crowding themselves together leaning on each other (Mr. Heath (P31577) was behind them tho' behaving well) and were disposed to be noisy - in apprehension of this, he requested Mr. Wade (P24691) to remove from that seat and take one near him (Professor Kraitsir (P43671)) this Mr. Wade (P24691) refused to be - He then ordered him to leave the room - On his refusing to go out Professor Kraitsir (P43671) left the room amid some noise made by some students with their feet and by clapping of hands.-

On motion - Resolved, that Mr. Wade (P24691) be sent for-

He appeared and said that he refused because he thought Professor Kraitsir (P43671) spoke to him rather roughly - was too imperative in his command - thought that he had ne right to require him to change his seat - Did not then know that a Professor had a right to order a student out of the lecture room.- if he obeyed the order, he thought the students would laugh at him.- thought that he had not misbehaved, and for that reason refused to go out -

Dr. Kraitsir (P43671) then withdrew from the Faculty

Professor George Tucker (P43619) offered the following resolution which was seconded and passed.-

Wade (P24691) having been dismissed from the University on the 6th instant, and the sentence of dismission having been sus- pended on the 12th upon his "engaging during this suspension of his sentence to conform himself to all the laws and regulations of the University as other students." And it appearing to the Faculty that he was guilty of contumacy on the 22nd instant by refusing to leave the lecture room of the Professor of Modern Languages (43674) when required to do so.-

Resolved, that the order of suspension be revoked, and that Mr. Wade (P24691) stand dismissed from the University as under the order of the 6th instant above referred to.-

the following protest and requested that it might be entered on the minutes - whereupon the Chairman prepared the following state- ment of facts, and moved, that the same be spread on the minutes along with Professor Sylvester's (P43671) protest.-

"Mr. Sylvester (P43671) is not conscious of having expressed and "certainly never entertained a desire that further testimony should "be obtained from students after he had withdrawn from the Faculty "meeting of Feby 24th. On being interragated by the Chairman as "to the character of certain members of his class, he spoke favour- "ably of them; and on the question being put to him by the Chairman, "may have gone so for as to say that he would have objected less "to testimony being sought for from them than from Mr. Weeks (P27811) -

"But he left the room without having the faintest idea that when "the case had already been judged by the Faculty and their decision "published, fresh depositions were to have been taken; otherwise "he would certainly under the altered circumstances of his own "position, have remained to address questions to the witnesses.

The Faculty directed that the Secretary (44603) should make an entry on the minutes of the protest of Mr. Sylvester (P43671) in reference to the introduction of the testimony of Mr. Whitehead (P23544) and others, and of the fact that this protest was written by him after on inspection of the Secretary (44603)'s notes of the proceedings of the Faculty meeting.- that the Faculty were well assured at the time, from the circumstances as they arose, and especially from the fact that Professor Sylvester (P43671), when asked by the Chairman, if the Faculty were to understand it to be his wish, that Mr. Whitehead (P23544) and others should be sent for by the Faculty? Answered - that it would be but just and proper, or words of this import.- that the Faculty in sending for Mr. Whitehead (P23544) &c were consulting Mr. Sylvester's (P43671) wishes, and his sense of what was just to himself -

And further, that a chief ground for calling for additional evidence, was undoubtedly the fact that the question had not been decided by the Faculty, but was referred to the Board of Visitors (CB0042),- making it proper, that they should have before them the evidence also of such students as Mr. Sylvester (P43671) beleived would make a fair statement -

He appeared and stated that when he received the first summons, he was not in a condition to appear before the Faculty - and that was the message that he sent by the Janitor (P44285) - it was a more verbal message that he read. from the Janitor (P44285).- He thought that the matter as to his non attendance on the lectures in Modern Languages

had been settled or could be settled without his coming before the Faculty - It was extremely disagreeable to him to come before the Faculty - He thought the Chairman told him he would have the matter settled - He did not suppose that the Faculty had taken any action on his application to quit Modern Languages - He has as much as he can do in his other schools in as much as he is a candidate for graduation in them - attends N. Philosophy, M. Philosophy & Political Economy -

He meant no disrespect for the Faculty in failing to appear before it when first summoned -

Mr. Geo. Tucker (P43619) moved, that Mr. Higginbotham (P32129) be allowed to withdraw from the school of Modern Languages.- and that he he censured for his irregularity in attending the lectures in that school heretofore -

Mr. Rogers (P43658) moved to amend the resolution by inserting the word "not" before the word "allowed".

The question was put on the amendment and lost -

Judge Tucker (P43676) applied for leave to withdraw his son J. Randolph Tucker (P42837) from Mathematics and from the Junior class of Morel Philosophy

On motion - Resolved, that his application be granted -

On motion - Resolved, that Mr. Martin P. Scott (P26848) be summoned to appear before the Faculty to answer in regard to his inattention in his Schools.- The Janitor reported, that he could not find him.-

The Faculty met April 9th 1842

The Chairman laid before the Faculty a letter from John J. H. Straith Esq. (P44365) of Jefferson County (PL6089) to Judge Tucker (P43676) giving to the Library folio Editions of the works of Plato & Demosthenes.

On motion - Resolved, that Judge Tucker (P43676) be requested to write to Mr. Straith (P44365), and give him the thanks of the Faculty for his valuable donation.

[EVENT: Student Misconduct:Destruction of Property  ] [EVENT: Student Misconduct:Drinking  ] [EVENT: Student Status:Dismissal  ] The Chairman stated to the Faculty that on tuesday evening last Mr. Asa T. Dix (P41014) in company with three others was been by Dr. Kraitsir (P43674) evidently intoxicated.- among other evidences of intox- ication he knocked off some bricke from Dr. Cabell's (P43619) garden Wall.- they then went down the road, and stoped near Wertenbaker's (P43631) and threw stones one of which struck the house.- Information was afterwards given the Chairman, that he attempted to force himself thro' Mrs. Jone's (P44167) gate - He was afterwards seen entering a street from an alley in charlottesville (PL4204) whilet ladies were passing, in a very indecent condition.

On motion - Resolved, that Mr. Dix (P41014) be sent for, He appeared before the Faculty, and said that he was not intoxicated, tho' he drank too much - he drank about a bottle and a half of porter.- He recollects everything that, transpired.- If a man could not walk straight he should consider himself intoxicated - Admits that he was noisy - and that he threw a stone between Hoiskell's & Wertenbaker's - did not attempt to force himself thro' any gate -

He went directly to town - did not go into any alley or come out of one - drank the portor in the University - did not purchase

it - or pay for it, or contribute towards paying for it - Is not in the habit of keeping liquor in his room - Was asked if he was in the habit of drinking?- Answered, that he was not in the habit of drinking too much.-

Dr. Cabell (P43619) offered the following resolution which was seconded and passed -

It appearing to the satisfaction of the Faculty that Mr. Asa T. Dix (P41014) drank to excess within the precincts on tuesday last, and was guilty of disorderly conduct on the road to Charlottes- ville (PL4204); and it further appearing that he has not made due proficiency in his studies - and has on that account received notice of dismission.

Resolved, that he be dismissed from the University and interdicted from the precincts.

On motion of Dr. Cabell (P43619)

Resolved, that whenever a notice of dismission has been given to a student. it shall be considered as in force until withdrawn by a special action of the Faculty.

The Chairman stated to the Faculty, that the Proctor had informed him that he had evidence to satisfy him that Mr. Byne (P22718), who has received notice of dismission for want of proficiency in his studies, was not only neglectful of his studies, but was in- dulging habits of injurious example to the students of the Univer- sity; And that he had prepared a letter to his father advising him to withdraw him immediately, and requesting him to forward the money necessary to carry him home.- The Faculty, hereupon advised that the letter should be sent, and ordered that Mr. Byne (P22718) should remain in the University only until his father should be heard from.- and that only in case he shall conform himself

strictly in the meantime to all the laws requiring good conduct -

On motion -

Resolved, that a committee of three be appointed to device and report a plan for conducting the Examination on the English Language, so as to produce Uniformity in the standard to be attained by the student, in order to pass this examination successfully.- Whereupon, Dr. Cabell (P43619), Mr. G. Tucker (P43619) and Mr. Rogers (P43658) were appointed to constitute the Committee -

[EVENT: Student Status:Dropping a Class Action:postponed ] [EVENT: Course Reference:Mathematics  ] Mr. Edward C. Burke (P43957) made application thro' the Chairman for leave to quit the School of Mathematics. On motion - Resolved, that his application be laid on the table.

[EVENT: Student Status:Dismissal  ] The Chairman stated that Mr. William B. Wade (P24691) who had been dismissed from the University, and whose sentence of dismission had been suspended, on condition that he would conform to all the laws of the University, had gone to a tavern in Charlottesville (PL4204), dined, and did not pay the bill.-

On motion - Resolved, that the resolution of the Faculty of the 12th of February suspending Mr. Wade's (P24691) sentence of dismission, be revoked.-
